Note 1: Unincorporated Body
For an unincorporated organisation, please confirm that at least 21 members are
included in the North Dorset District Council’s register of electors or of a neighbouring
local authority, and provide their names and addresses, as an attachment.
Note 2. Boundaries
The boundaries do not have to be the same as ownership boundaries, for instance as
shown on the Land Registry plan if the land is registered; nor is it necessary for all parts
of the nominated site to be in the same ownership
Note 3: Ineligible assets
Refer to Schedule 1, Assets of Community Value (England) Regulations 2012, but in
summary are:
 Residential property, unless integral to the asset
 Property which has planning permission for residential development
 Operational land for statutory undertakers & utilities, e.g. water, energy, roads
 Caravan parks
Note 4: Asset of Community Value
Refer to Sect 88, Localism Act 2012, but in summary is that land or a building will be
considered an asset of community value if, in the opinion of the local authority:

An actual current use, that is not an ancillary use, furthers the social wellbeing or
social interests of the local community, and it is realistic to think that there can
continue to be a use, which is not ancillary, which will further, whether or not in
the same way, the social wellbeing or social interests of the local community.

There is a time in the recent past when an actual use of the property, which was
not an ancillary use, furthered the social wellbeing or social interests of the local

community, and it is realistic to think that there is a time in the next five years
when there could be non-ancillary use which would further, whether or not in the
same way, the social wellbeing or social interests of the local community.
Note 5: Examples of the issues that your answer to this question could usefully address
are:
 Why do you consider that the current use, or a use of the asset in the recent
past, furthers (or furthered) the social well-being an interests of the community?
 Can you confirm that the use described above is (or was) its main use and not an
ancillary (i.e. an additional) use
 Can you confirm that demand for the existing (or a proposed new use) would
continue into the future (5 years), and that the asset would continue to further the
social well-being or interest of the community in the future?
 Why is the current or future activity dependent on securing the asset for
community use? (i.e., are there alternatives or similar facilities in the local area
that could support the current or future proposed activity?)
 Are you confident that the community can viably manage the asset and has the
capacity to raise the necessary capital or could reasonably expect to do so within
six month moratorium allowed by the regulations? This is not a requirement of
the legislation but it is important that you think it through and understand the
implications.
