Factors taken into account by the parties to choose an arbitration center
A survey carried out among the participants of the V Regional Arbitration
Congress held on August 11, 2016 in Arequipa (Peru), about which
factors are more important to choose an arbitration center, highlights the
fact that an arbitration center rule requiring the disclosure of the
participation of a third party funder is the least relevant factor to choose
an arbitration center.
This finding reinforce the argument that the source of funding does not
affect the merits of the case and the evaluation of any potential conflict
of interest of the arbitrators is something can be addressed by the
funders. So the result of the survey considers that it is not a priority to
require such disclosure, especially when there are several important
factors which require more urgent attention in order to satisfy the needs
of the parties involved in arbitration procedures.
