The NECALG annually requests bid offers for the purchase of products as a means of determining vendors for the fiscal year of July through June. Consideration will be given to our evaluation of products we have used in the past, to individual prices, to average for all prices, to freight pricing structure, and to minimum order requirements. Products and services purchased through this Invitation to Bid will be used in the Weatherization Program’s efforts to improve the energy efficiency of residential dwellings. All products and services offered in response to this Invitation to Bid must be appropriate and suitable for that use. All bids must be submitted to the address or fax number above. Please include all pertinent product literature along with bid submittal, including all warranty information (please specify what is and is not covered). The NECALG does not obligate itself to accept the lowest, or any other proposal, and reserves the right to reject or negotiate any or all bids, to waive any informalities or irregularities therein, to make multiple awards, to consider any and all factors the NECALG deems appropriate, and to accept any proposal deemed desirable. NOTE: All offers represented on this bid shall be the final delivered on-site cost for each product. Any price offered if part of a delivery of other items (for example part of a bulk delivery of insulation) or packaged deal (minimum order for the delivered price), must be specified as to limitation of the offer, otherwise we will assume individual order of the item will be at the stated delivered price. Additional information may/should be attached if necessary to explain. Only bid on those items you wish to be considered for becoming a supplier to the NECALG. This “INVITATION TO BID” is for Insulation Products as well as various materials used in weatherization of a home. Vendors may bid all or part of these products. However, All offers represented on this bid shall be the final delivered on-site cost for each product. Again, all material prices must be the final delivered prices for delivery to BOTH the NECALG main Offices’ warehouse located at 201 ½ Railroad Ave, Fort Morgan, Colorado 80701 and the NECALG’s satellite Office, located at 813 E. 18 th St, Greeley, Colorado 80631. IN RESPECT TO THE INSULATION PORTION OF THIS INVITATION, due to space limitations in the Fort Morgan Warehouse, storage space is not sufficient to support quantities such as a 53’ trailer-load cellulose delivery, however, it is desirable and required for cellulose delivery at our Greeley location For this offering, please propose offers that shall not exceed present limits, within limitations of local Fort Morgan warehousing space (a single load of 12,000 lb. of packaged cellulose for example). Each product listed below, unless otherwise stated, must conform to minimal standards noted for that item. Failure to meet such criteria will render the offer rejected. The following “conditions” are in effect for this bidding process: 1. Consideration will be given to our evaluation of products we have used in the past, to individual prices, to average for all prices, to freight pricing structure and to minimum order requirements. 2. An appeals process is available. All appeals must be in writing and addressed to: NECALG Executive Director, 231 Main Street, suite 211, Fort Morgan, Colorado, 80701. Appeals must be made within 15 days of NECALG’s decision. The NECALG Executive Director will issue a decision in written form within 30 days; all appeal decisions made by the Executive Director are final. 3. All bids become the property of the NECALG and will not be returned to the bidder. 4. All price quotes, terms and conditions of the bid shall remain fixed and valid from July 1, 2011 to the end of June, 2012. Please do not offer any quotes that you the vendor cannot comfortably hold for the entire period of this purchase Agreement. All price quotes must include any and all projected cost increases during the time period specified above and final shipping and delivery charges to warehouse locations in BOTH Fort Morgan and Greeley, Colorado warehouse locations. 5. The Bid shall be signed by the person legally authorized to bind the bidder. 6. Failure to furnish any supportive or supplemental information or data if requested or failure to follow the format may disqualify the Bid. 7. A successful Bidder will be formally advised by telephone and/or e-mail within 7 days of Board approval. 8. Issuance of the Invitation to Bid does not constitute a commitment by the NECALG to award a Bid. 9. The Agency will notify unsuccessful bidders within thirty (30) days after bids are received. 10. All items must meet proper ASTM, F.S., CFR and State of Colorado’s Governors’ Energy Office (GEO) Standards, as applicable. Vendors shall warranty all materials for one (1) year against defects in material (and workmanship, if applicable) for the date of provision. 11. Any accepted offer shall not be construed as exclusive for the purchase of weatherization materials. 12. Vendors must be able to supply products within five (5) working days from receipt of the Agency’s Purchase Order. 13. A successful bidder agrees to maintain all records applicable to the materials letter of award for a minimum of four (4) years. Access to these records shall be given to the NECALG, GEO, or representatives of Federal and State governments upon request. 14. A successful bidder agrees to waive the right of placing a lien upon any housing unit served under or through the proposed award as a recourse for nonpayment or any other reason and specifically waives all rights and authorities contained in the Colorado Mechanics Lien Laws, Article 22 of Title 38 CRS 15. A successful bidder agrees to comply with the letter and spirit of the Colorado AntiDiscrimination Act of 1957, as amended, and other applicable laws respecting discrimination and unfair employment practices, (24-34-402, CRS). Supplier shall, in the performance of his obligations under these Conditions, comply with all applicable affirmative action and equal opportunity laws, regulations, and policies. The supplier shall remain in compliance with the Copeland “Anti-Kickback” Act and the provisions of the Contract Work Hours and Safety Standards Act. 16. A successful bidder warrants that no person or selling agency or other organization has been employed or retained to solicit or secure this bid for a compensation, percentage, brokerage, or contingent fee. For breach of violation of this warranty, the NECALG shall have the right to refuse the bid in its entirety. 17. A successful bidder agrees in accordance with the Privacy Act of 1974, that the bidder will be responsible for the confidentiality of all data disclosed to it by the NECALG. 18. Due to NECALG Accounts Payable process, checks are issued following a monthly meeting of regional Board members every third Wednesday of each month. Monthly billing cycle closes after the second working day of each month. Invoices received after that date potentially may not be paid until the next cycle the following month. 19. The NECALG reserves the right to cancel an awarded Vendor with 30 days written notice should continuation of the Award no longer be in the best interest of the NECALG, due to loss of funding, change in scope of program or other conditions detrimental to the Organization such as quality of product or servicing of this Award as detailed. 20. In accordance with Title 8, CRS, Article 17.5, your company’s authorized signature below indicates that “As a prospective contractor for the above mentioned bid, I (we) do hereby certify that, as of the date of the certification, I (we) do not knowingly employ or contract with an illegal alien.” 21. This may include on the insulation offer, (five (5) bags cellulose for equivalent product, two (2) bags blowing fiberglass for equivalent product, and/or samples of the various batting) as well as specific coverage charts, specification sheet, and MSDS for specific calculation and testing. In addition, at least two (2) references of existing weatherization programs that have used the product(s) for more than six months.
