CO-OPERATION AGREEMENT BETWEEN THE UNIVERSITY OF LA LAGUNA (ULL – SPAIN) AND , FOR THE EXCHANGE OF RESEARCH STUDENTS (Academic Year: 201_ - 201_) THE PARTIES One the one hand, And on the other hand, the Chancellor of the University of La Laguna (Spain), Dr Antonio Martinón Cejas, appointed by Decree of the Office of the President of the Regional Government of the Canary Islands nº 74/2015, 22nd of May, by virtue of the competences established by article 20.1 of the Universities Act, Organic Law 6/2001, 21st of December, and by articles 167 and 168 of Decree 89/2004, 6th of July, adopting the Statutes of the University of La Laguna. The parties recognise each other in the capacity in which they are acting and also recognise that they each have the legal capacity to sign this document, and to that end DECLARE That the University of La Laguna is a Public Body; recognised as a legal entity in its own right, which engages in the activities of teaching, research and scientific and technological development; interested, pursuant to article 2 of its Statutes, in enhancing international co-operation by means of the exchange of members of the university community, collaboration in the field of teaching, research, technological development and innovation, declaring that one of the objectives of the University of La Laguna is that all its students have the chance to follow a period of their university studies in the universities of other countries. That the University of Considering the above, the ULL and decide to sign a Co-operation Agreement for the Exchange of Students, pursuant to the following CLAUSES ONE - OBJECT OF THE AGREEMENT The object of this agreement is to define the terms of co-operation between the ULL and the to establish a research student exchange programme for the academic year 201_ - 201_. TWO - SUBJECTIVE SCOPE This agreement shall only be applicable to research students of [Programa de Doctorado] of the University of La Laguna and the research students of (Target Programme and University). THREE - SELECTION OF STUDENTS AND ADMISSION 1-5 The selection of the students participating in the exchange is the responsibility of the university-of-origin, which shall take into consideration the academic performance and level of studies of each candidate, according to its own criteria. Having selected the students to make the exchange, the university-of-origin shall formalise the proposed stage at the target university by presenting an application that shall include the following details of the students proposed for the exchange: - Name and surname/s Address and telephone number Main area of interest Nationality Copy of the academic record Curriculum Vitae. Letter of motivation FOUR - PRINCIPLE OF RECIPROCITY The principle of reciprocity shall always govern the exchange of students covered by this agreement, whereby, the number of students received by each university for an exchange shall be equal to the number sent out on an exchange. For the first year of application of this agreement, a maximum of 2 students per university is hereby set. In exceptional circumstances, and always with the consent of both universities, there may be an imbalance, in which case an adjustment will be agreed upon for the following academic period. FIVE - DURATION OF THE EXCHANGE Exchanges shall be for a maximum of 12 months. SIX - CONDITIONS OF THE EXCHANGE A) FINANCIAL CONDITIONS AND HEALTH INSURANCE - Students participating in the exchange shall pay their tuition fees in their university of origin, and shall be exempt from any payment for tuition rights in the target university, insofar as the exchange does not imply issuing an official title by the latter. - Exchange students will only have to pay the dues or public prices that may have been established at the target university for accessing certain services (sports, Internet and others) under the same conditions as the other students of that university. In this case, the target university shall inform exchange students of such dues before they arrive. - Before arriving at the target university, students must have an international medical expense and accident insurance policy, payment for which shall be the responsibility of the students. Said insurance shall be accredited by the student at his/her university of origin before leaving, and is, in any event, a necessary condition for making the exchange. - Any processes necessary for obtaining a visa and immigration documents allowing the student to enter the country for the exchange stage are the responsibility of the student. Each target university shall provide the student 2-5 with an acceptance letter, specifying that the person involved is an exchange student who has been admitted to that university. - Students must cover their own accommodation and maintenance expenses at the target university, together with travel expenses, books, personal expenses and workshops. - The university-of-origin will not cover any expenses arising from the exchange, which shall be the responsibility of the student involved in the exchange. B) BENEFITS AND SERVICES OF THE TARGET UNIVERSITY - The target university shall provide any assistance that may be necessary to the students it receives under this agreement, for the adequate preparation of their stay and for the exchange to take place in optimum conditions through its general and international relations services. To this end, the target university will provide support for exchange students in their search for accommodation in accordance with the resources it has. - Exchange students shall enjoy the same rights and benefits as those conferred by the target university on its own students. To this end, the target university shall provide a card or similar document to each exchange student, entitling him or her to access all the target university services under the same conditions as its own students. C) ACADEMIC COMMITMENTS - Before leaving, students participating in the exchange shall prepare a work proposal that must be approved by both universities. - At the end of the exchange period, the target university shall issue a certificate accrediting the work completed by each student and its duration. SEVEN - CO-ORDINATOR Each university designates a co-ordinator for this agreement, who shall act as interlocutor for it. The address of the co-ordinator shall be the address used for any notifications that the parties must send to each other by virtue of this agreement. - At the ULL, it will be [MENTION THE POST] - At the , it will be [MENTION THE POST] EIGHT - MONITORING AND CO-ORDINATION COMMITTEE For the purposes of control, monitoring and interpreting the rights and obligations arising from signing this agreement, a committee shall be set up, comprised of representatives of the signatory universities, who shall be responsible for issues relating to its implementation, follow-up and quality guarantee. This committee shall assess the application of the agreement and shall promote common lines of policy and any co-ordination activities that may be considered necessary. 3-5 This committee shall be comprised of: - At the ULL - At the Every year, the Monitoring and Co-ordination Committee of each university shall set the number and conditions for the exchange places offered sufficiently in advance of the dates of the call for candidates for the exchange programme. The Committee shall set the internal operating rules governing its actions, albeit respecting any limits established in this Agreement. NINE - EFFECT AND DURATION This agreement shall come into effect at the moment in which it is signed and shall remain in effect for years, although it may be renewed for equal periods of time by the express agreement of the parties. ELEVEN - AMENDMENT The parties may amend this agreement at any time by an express agreement of the signatories. TWELVE - TERMINATION OF THE AGREEMENT This agreement may be cancelled for the following reasons: 1 - By mutual agreement among the parties 2 - If the initial term, or its extensions, expires 3 - For breach of the obligations agreed upon or for having infringed the duty of good faith 4 - By the unilateral decision of one of the parties, giving six months’ notice to the other party of its intention to terminate the agreement 5 - Should any of the doctorate programmes covered be cancelled In the event of this agreement being terminated, both parties undertake to complete the activities already initiated at the time of giving notice of termination. THIRTEEN - AGREEMENT LANGUAGE This agreement is signed in Spanish and in , and both texts are genuine. shall be used in the working relations between the parties. FOURTEEN - CONTROVERSY RESOLUTION The parties undertake to resolve any disagreement that may arise in the implementation of this agreement in a friendly fashion within the Monitoring and Coordination Committee, in the understanding that the criteria of good faith and a will to reach an agreement will have been applied beforehand. In the event of a conflict, the 4-5 parties shall appoint an External Arbitration Committee by common accord, whose ruling shall be binding. FIFTEEN - PERSONAL DATA PROTECTION Pursuant to the Personal Data Protection Act, Organic Law 15/1999, 13th of December, the ULL hereby informs those concerned that by signing this document, they authorise said university to process the personal details contained therein, which shall be included in a file for the purposes arising directly from the relations established with the ULL, and with the constraints arising from this agreement. Signatories are also informed that they may exercise their rights to access, rectify, cancel and challenge said information by writing to the ULL, at the following address [DETERMINE WHICH UNIT IS RESPONSIBLE] The ULL undertakes to treat the personal details of the members of the ULL provided within the framework of the relations maintained confidentially, to treat them pursuant to personal data protection legislation and to use them solely for the aforesaid ends.
