The Skye Executive Committee and the clubs members are committed to promoting the positive image of Players and their professional and proper conduct. With these aims in mind, the Skye Executive Committee has agreed to formulate this Code of Conduct (“the Code”) for the Clubs Players. 1.2 Purpose The Code seeks to promote and strengthen the good reputation of Cricket, the Skye Cricket Club and its Players by establishing standards of performance and behaviour for Skye Players. In addition, it seeks to deter conduct which could have an adverse affect on the standing and reputation of the club and all participants. A Skye Cricket Player is entitled to have his privacy, including that of his family and friends, respected and the Code is not intended to apply to activities engaged in by a Player of a private nature, which may include activities with family, friends and/or other Club Players. 1.3 Player Contracts This Code is intended to clarify the duties and obligations set out in the Standard Playing Contract (“the Contract”) binding the Senior Players of the Skye Cricket Club. However, it is not intended that this Code supplant the Contract. Where inconsistencies appear between this Code and the Contract, the latter shall prevail to the extent of such inconsistency. 1.4 Discipline In addition to breaching this Code, misconduct by a Player may give rise to actions against the Player under or pursuant to any one or more of the following: Civil and/or criminal laws; The Club Constitution; and The Contract (where the Contract may be terminated for misconduct). Breaches against this code will be dealt with under Section 7 of this document and will be considered by a specifically formed Disciplinary Sub-Committee, which will have at least an Executive Committee representative, a players advocate and a coach or captain representative. A disciplinary hearing must be held within 5 days of the relevant incident. A player can raise an appeal or grievance against a decision from the disciplinary committee to the Club Disciplinary Dispute Panel for review. Page 4 of 8 2 General Responsibilities 2.1 Behaviour Skye Players must at all times behave in a sportsmanlike manner and uphold the highest standards of professional conduct so as not to compromise the integrity and dignity of game, the Skye Cricket Club, the Skye Executive Committee and other club Players. As Skye Cricket Club are also trying to portray and encourage a “family friendly” environment at the club, it is expected that players will conduct themselves appropriately around children and the spectators. As an example, where a Player commits a significant or serious breach, the Player shall forfeit: 1st breach Forfeiture of up to $50 or team demotion or suspension from playing 2nd breach Forfeiture of up to $100 or suspension from playing or suspension from the club 2.2 Fitness (Sobriety) Skye Players must present themselves at all Matches, Club training sessions and other related activities in an acceptable state of fitness, as in ready to perform to their relative playing standard while maintaining acceptable risk against injury or accident to the player or his/her team mates. An acceptable state of fitness may be determined by the Club Committee. Primarily fitness for the Skye Cricket Club players will be based on general health, illicit drug and alcoholic intoxication levels. If a player presents themselves to a game or to training under the influence of drugs or alcohol, the club will consider suspending the player from the match or session and hold the right to apply further suspension after presentation of circumstances to a disciplinary sub-committee with the club. Continued breaches of the fitness code may result in exclusion from player rights. 2.3 Club Rules and Regulations The Players and club members must make reasonable endeavours to be and to remain familiar with the rules, regulations and policies of Skye Cricket Club as set out in the Club Constitution, Players Code of Conduct and any specific Mornington Peninsula Cricket Association policies that are relevant to the players and club. The Skye Cricket Club Executive Committee will make these rules available to players and members. 2.4 Property The Players must show due regard for the property and facilities of the Club and staff of those bodies and the property, facilities and staff of other providers (including opposing clubs, bus and ferry operators) which a Player may utilise during any authorised activities in which the Player may be engaged. Where a Player breaches this provision, he/she may be liable to pay the relevant person or body an amount equivalent to the cost of repairing or replacing the damaged property and/or facility. Page 5 of 8 3 Cricket Responsibilities 3.1 Playing Players must not wilfully engage or participate in any activity which may cause or aggravate any injury or illness and which prevents Players from playing cricket to the best of their ability. 3.2 On-field behaviour Players must, during Matches and Club training sessions, behave in the same manner as required in Clause 2.1 of this Code. Findings by the clubs disciplinary sub-committee of misconduct against a Player will be dealt on a case-by-case basis. 3.3 Attendance and apparel Players must (unless granted express permission otherwise or provide an explanation satisfactory to the Club) attend, and attend punctually, all Matches, Mandatory Training Sessions, Club nominated events and activities. Players must wear appropriate apparel during all Matches and Club training. Where a Player breaches this provision, the Player shall be potentially liable to forfeit the right to play 3.4 Vilification In accordance with the Mornington Peninsula Cricket Association regulations, Players must not vilify other Players on the basis of their race, religion, colour, sex, sexual orientation or other related characteristics. Breaches of this provision are to be dealt with in accordance with MPCA Rules. 4 Public and Related Responsibilities 4.1 Public conduct Players must, at all times and while in public, behave in a manner which upholds and promotes the appropriate standards of integrity and dignity. Players must not behave in any way so as to bring the MPCA, the Skye Cricket Club or their team mates into disrepute. Public behaviour includes, without limitation, behaviour during travel to or from Matches, participation in authorised Matches, Club Functions, Promotional events and other public venues where the Player is participating in club authorised activities. Breach: Forfeiture of up to $100 or suspension from matches 4.2 Functions Players must (unless granted express permission otherwise) attend, and attend punctually, MPCA and Skye Cricket Club functions. Such functions include (without limitation): Authorised after-Match functions Skye Cricket Club “best and fairest” functions Other authorised MPCA, Skye Cricket Club functions. During such functions, Players must wear appropriate apparel. Non-attendance generally: Forfeiture of up to $50 or demotion to lower team Page 6 of 8 4.3 Promotional events Players must (unless granted express permission otherwise or a satisfactory explanation provided): Generally promote Cricket, the MPCA, Skye Cricket Clubs and the club members Assist the club and sponsors in promotional and developmental activities Attend, and attend punctually, authorised promotional events and other related activities. During such promotional events, Players are encouraged to wear appropriate apparel. 4.4 Sponsors Players may promote the interests of the Skye Cricket Club and/or the Clubs’ Sponsors. Players may also be required to attend, and attend punctually, Club and Club Sponsors’ promotional events in accordance with arrangements made between the Clubs’ Executive Committee, Senior Squad Management Team and the Sponsor. 5 Dispute resolution procedure A player has the right to appeal or submit a grievance on behalf of any disciplinary action taken against them to the Club Disciplinary Dispute Panel i. Before seeking formal review as provided in sub-clause (ii) below, a player should undertake to resolve the concern with the Disciplinary Sub-Committee during a hearing on the allegations of misconduct, or within 48 hours of the hearing. A decision to impose a disciplinary measure on a Player can be overturned by the Disciplinary Sub-Committee within a 48 hour period of the original hearing if further evidence has been presented. ii. If such informal review fails to satisfactorily resolve the Player’s dispute, the relevant Player may formally appeal (within [72 hours] from the date of the Disciplinary Sub-Committees decision to impose a disciplinary measure) to a Dispute Resolution Panel. iii. The Dispute Resolution Panel shall consist of the Club President or his nominated representative; a Club Official from the Skye Cricket Club Executive Committee; a Senior Squad Management Team member or their nominated representative; and a Players Advocate. iv. The Dispute Resolution Panel must conduct a fresh investigation of the alleged breach by the relevant Player and form its own view about the appropriate disciplinary measure, if any, to be taken. Its decision must be made within [72 hours] from the date when the relevant Player first instituted his appeal and must be communicated in writing to the Skye Executive Committee for its records. v. The decision of the Dispute Resolution Panel shall be final and binding on the relevant Player. vi. The time limits set out in this clause may be extended by agreement between the Player and the Club. 6 Confidentiality 6.1 Skye Cricket Club material Players must maintain the confidentiality of all material provided in confidence by the MPCA or Skye Cricket Club to Players. 6.2 Disclosure Players must, so far as is reasonable, disclose to their Club any matter which might adversely affect their performance or that may risk exclusion from insurance claims. Page 7 of 8 7 Discipline 7.1 Purpose This section aims to ensure that the principles and standards set out in this Code are adhered to by all parties, particularly Players. 7.2 Disciplinary measures The particular disciplinary measure which the Skye Cricket Club chooses to impose on the relevant Player must be consistent with and in accordance with the provisions of this Code. Such measures may include (without limitation) the imposition of forfeitures or suspension from Matches and training. 7.3 Forfeitures The maximum allowable amounts that the Club may request or fine the relevant Player for breach of this Code are specified in this Code. The amounts that may be forfeited by a Player are not cumulative. That is, a single act by a Player may breach several clauses of this Code, but the forfeiture of monetary amounts must be no more than the highest single, applicable maximum. The Club may, in appropriate circumstances, require a Player to do the following (without limitation) in lieu of a monetary forfeiture as prescribed by this Code: i. Attend a promotional event or Club activity, ii. Provide a cricket clinic, and/or iii. Attend or perform any other similar event or activity as agreed between the Player and the Club. 7.4 Withholding of amounts due to a Player Where a Senior Paid Player breaches this Code in a manner which amounts to non-performance of the obligations under his Contract, the Club shall be entitled to withhold from any amount due to the Player the amount applicable to the breach as provided in this Code. 7.5 Relevant considerations When imposing a disciplinary measure, the Club may, amongst other things, take the following matters into account: The seriousness of the breach; The extent to which the Player’s breach brings the MPCA or the Club into disrepute; Whether the offence has been repeated by the relevant Player. Page 8 of 8 7.6 Potential Disciplinary Sub-Committee Outcomes The Disciplinary Sub-Committee will consider each case independently on merit and after an initial preliminary review, they will conduct a hearing to allow the player to present their position and provide witness input or supplementary evidence if applicable. The result of the preliminary meeting will result in two outcomes: The Disciplinary Sub-Committee can choose to dismiss a case before the hearing if they believe no breach of the code of conduct has occurred or that there is no evidence to substantiate the claim. The Disciplinary Sub-Committee can determine that there has been a potential breach and that a more detailed hearing is warranted The result of the hearing may also result in two finding: Not Guilty - The Disciplinary Sub-Committee may after hearing the case decide that the player was unjustly accused and acquit the player Guilty - If the Disciplinary Sub-Committee arrive at the conclusion however that a breach has occurred they will have the right to apply any of the following, depending on severity of breach, player record and impact of the breach: i. Reprimand ii. Team Demotion for one or many matches iii. Fine up to the maximum of $100 per incident for non-paid players or up to the value of earnings for a paid player iv. Suspension from Playing in Matches v. Suspension from the Club facilities for a specific period of time vi. Removal of Playing Rights and Life Ban from the Club 8 Monetary Forfeitures Where a Player forfeits monetary amounts for breach of this Code, the amount of the monetary forfeiture shall be retained by the club for operational expenditure.
