Election Year Issues for Tax-Exempt
Organizations
What (and how much) can 501(c)(3)s and other
types of tax-exempt organizations do in an election
year? How can a 501(c)(3) comment on issues
driving the current political debate without running
afoul of the ban on 501(c)(3) political campaign
intervention? When are 501(c)(3)-sponsored
candidate debates, voter registration programs, or
voter guides permissible non-partisan activities,
and when do they cross the line? When is a 501(c)
(4) doing too much electioneering and failing to
be “primarily” engaged in its exempt social welfare
purpose? (And how do we know now that Congress
won’t let Treasury write regulations to tell us?) Come
and learn how your organization can learn to take
advantage of the opportunities to advance your
issues in an election year without losing your taxexempt status.
