1.
THE ACP FILMS PROGRAMME
1.1
Background
Article 27 of the EU-ACP Partnership Agreement1 signed in Cotonou states that the cooperation is aimed at
‘recognising, preserving and promoting cultural values and identities to enable inter-cultural dialogue’.
It is also aimed at ‘developing cultural industries and enhancing market access opportunities for cultural
goods and services’.
Furthermore, the Dakar Declaration on the promotion of ACP cultures and cultural industries, adopted after
the 1st meeting of ACP Ministers of Culture on 20 June 2003, recognises the great potential and considerable
value of these industries and their contribution to the economic and social development of the ACP States
and regions.
The agreement also highlights the importance of the movement of ACP artists and cultural goods within the
ACP States and internationally, as well as access for professionals to the goods and services markets.
Under the implementation of the Dakar Action Plan, the ACP Secretariat has worked with the European
Commission to define a support programme for the ACP cinema and audiovisual sector, financed from the
‘intra-ACP’ budgetary line of the 9th European Development Fund (EDF).
The ACP Secretariat is responsible for implementing this Programme, entitled ‘ACP FILMS’, a EU-ACP
support programme for the ACP cinema and audiovisual sector (Programme) and is responsible for the
decision to award grants from the EDF intra-ACP budget.
A Programme Management Unit (PMU) provides the technical assistance to the ACP Secretariat.
These guidelines aim to present and define the conditions of the ‘open call for proposals’ that enables
the implementation of these programme Actions.
DEFINITIONS
For the purpose of this call for proposals the following definitions shall apply:
Action: all the production, distribution and training activities for which the beneficiary receives
financial support from the ACP Films programme. The ‘Action’ covers the preparation and
implementation stages as well as the evaluation and dissemination of the results of these.
Activity: the different stages of the implementation of the Action.
Beneficiary: Applicant with whom a grant award will be signed.

Indirect/final beneficiaries:
Any person from an ACP State that benefits from the funded Action:
in production: directors, writers, technicians and the partner structures and associates,
in distribution and dissemination: cinema owners, television channels and the partners and
associates and all professions linked to promotion, distribution and networking, in training and
professional development : participants
Applicant: Lead operator that submits the proposal.
Duration of the Action: The minimum duration is 6 (six) months, the maximum duration is 24
(twenty-four) months; all activities must be completed before 30 April 2011
EDF: European Development Fund. The ACP Films programme is financed from the 9th EDF.
Partner: Member organisation of the partnership other than the applicant
Associate: Organisation that has a real role in the action but cannot receive funding from the
grant, except for travel and subsistence costs.
Partnership: A consortium set up temporarily to submit a proposal, and, if successful, to implement
the action. The consortium need not have existed previously and its constitution should be proven by
signed partnership statements, as required in Section III of the Application Form.
Legal entity: Organisation with a legal status that is independent of the natural persons that make it
up, and with a defined activity and registered statutes
Relevance: Related closely to and adapted to the issue in hand.
ACP regions: Grouping of the 79 ACP States that are signatories of the Cotonou Agreements, with six
geographical zones: Southern Africa2, Central Africa3, East Africa4, West Africa5, Caribbean6, Pacific7
Grant: The financial support awarded to the selected applicant.

With the development of digital technology, cinema and audiovisual works have become one of the most
mobile and accessible cultural goods. Their content can be entertaining or moving, but above all they can
lead viewers to discover and reflect.

Cinema and audiovisual works can raise awareness and help with development, both socially and
economically. Their production and dissemination generate jobs and financial flows at the national, intraACP and international levels, in the sector concerned as well as in other sectors.
Against this background, the general objectives pursued by the ACP Films Programme are described below.
1.2.1
Overall objective
The programme’s overall objective is to contribute to the development and structuring of the ACP States’
cinema and audiovisual industries, so that they can create and distribute their own images more effectively. It
also aims to enable more promotion of cultural diversity, the networking of ACP cultural identities and
intercultural dialogue.
The integration of digital technology represents an opportunity to increase control over the whole chain of
production and dissemination of images.
1.2.2
Specific objectives
Thus the ACPFILMS Programme finances projects aiming at the following results:
Emergence and/or strengthening of the production capacities of the cinema and audiovisual industries
in the ACP States;
 Dissemination as wide and realistic as possible in the ACP States, including through ACP television
channels of fiction, animation, and documentary films and series
Improvement of the circulation of ACP cinema and audiovisual works at the intra-ACP level (as a
priority), in the EU and internationally, especially South-South;
 Training and professional development (artistic, technical and management) of the cinema and
audiovisual professions
 Facilitation of access to training for young professionals
1.3
Financial allocation provided by the ACP Secretariat
The overall indicative amount made available under this call for proposals is 6.5 million €, which breaks
down as follows:
Lot 1: Support for the production of cinema and audiovisual (television) works in the ACP States
Budget available: 3.8 million €
Lot 2: Support for the promotion, distribution, dissemination and networking of the cinema and audiovisual
sector in the ACP States
Budget available: 1.7 million €
Lot 3: Support for the professional development and training of ACP professionals in the cinema and
audiovisual sector

2.
RULES OF THIS CALL FOR PROPOSALS
These guidelines set out the rules for the submission, selection and implementation of Actions financed
under this call, in conformity with the provisions of the Practical Guide to contract procedures for EC
external Actions, which is applicable to the present call, available on the Internet at this address:

and in compliance with the specific contractual terms for this call for proposals.
The contract models with the specific conditions for each Lot are found in annex G1/G2.
2.1
Eligibility criteria
There are three sets of eligibility criteria, relating to:
Applicant(s) which may request a grant (2.1.1), and their partners (2.1.2),
Actions for which a grant may be awarded (2.1.3),
Types of costs that may be taken into account in setting the amount of the grant (2.1.4).
2.1.1
Eligibility of applicants: who may apply?
In order to be eligible for a grant, applicants must:
Be nationals8 of a Member State of the ACP Group9 (except Cuba) or of the European Union10;
 Be a properly constituted legal person for 12 months11 from the launch date of the call for proposals
and capable of producing a balance sheet or a progress and financial report (see 2.4);
Be directly responsible for the preparation and management of the Action and not acting as an
intermediary;
Have stable and sufficient sources of funding to ensure the continuity of its organisation throughout the
Action for which a grant is sought;

Have sufficient experience and be able to demonstrate its capacity to manage Actions of the same scale
as the Action for which a grant is requested;
Specifications by Lot
Lot 1: Specification for the production Actions
Be an enterprise/organisation involved in audiovisual production, the copyright holder for the proposed
Action, and be associated with one or several director(s) from an ACP State.
Lot 2: Specification for the promotion, distribution, dissemination and networking Actions
Be an enterprise that has distributed or been associated with the distribution of at least one full-length
film or a televised programme over the last three years;
Be involved in the distribution or the future dissemination (holding the exploitation rights) of at least
two full-length films or a project for a TV series in the ACP States.
Lot 3: Specification for the training and professional development Actions
Be an educational enterprise/organisation or a body linked to the audiovisual or cinema sector of the
ACP States for at least one year.
Exclusion situations
In every instance, potential applicants and/or partners cannot participate in calls for proposals or be
beneficiaries of a grant if they are in one of the situations described in point 2.3.3 of the Practical Guide to
Contract Procedures for EC external actions (available at the following internet address:
http://ec.europa.eu/europeaid/work/procedures/implementation/practical_guide/index_en.htm)
Applicants must sign a declaration on their honour (Part B, section VI of the Application Form) certifying
that they are not in any of these situations.
2.1.2
Partnerships and eligibility of partners
2.1.2.1 Partnerships
Applicants must apply from and work for a partnership involving at least three partners, one of which is the
applicant, with their headquarters in at least two different ACP States.
The number of partners from the eligible ACP States must always exceed the number of European, South
African and/or Cuban partners.
If there are several EU partners, they must have their headquarters in different EU countries.
2.1.2.2 Partners
Applicants’ partners participate in designing and implementing the Action. The costs they incur are eligible
in the same way as those incurred by the grant beneficiary. They must therefore satisfy the same eligibility
criteria as the applicants. However, enterprises/organisations from Cuba are eligible as partners.

The following are not partners and do not have to sign the ‘partnership statement’:
1. Associates
Other organisations may be involved in the Action. Such associates play a real role in the Action but
may not receive funding from the grant with the exception of per diem or travel costs. These
associate enterprises/organisations do not have to meet the eligibility criteria referred to in section
2.1.1.
The associates have to be mentioned in Part B section IV – ‘Associates of the Applicant participating
in the Action’ – of the Grant Application Form.
2. Subcontractors
The grant beneficiaries have the possibility to award contracts to subcontractors. Such subcontractors
are neither partners nor associates, and are subject to the procurement rules set out in Annex IV to
the standard grant contract.
The applicant will act as the lead organisation and, if selected, as the contracting party (the "Beneficiary").
2.1.3
Eligible Actions: Actions for which an application may be made
Definition: An Action (or project) is composed of a set of activities.
Duration of the Actions
The planned Action may not ever be of a duration of less than 6 (six) months or more than 24 (twenty-four)
months. All contracts must be signed at the latest by 19 July 2009 and end before 30 April 2011.
Sectors or themes
The Actions selected must have, as their main objective or the result of the Action, a contribution to
the long-term structuring of the audiovisual and cinema sector of the ACP States: economic
development, employment, training, technology, partnership, networks, etc.
These priorities represent a support for the professional development of many categories (directors, dialogue
writers, actors, technicians, etc.), who can develop their professional experience around this diversification
of products.
Types of Action
Lot 1: Support for the production of cinema and audiovisual (television) works in the ACP States and for
ACP producers
The films can be made in 35mm, Super 16 or digital format.
Projects for full-length fiction films, animation (short- and medium-length), and documentary films
(medium and long), but excluding reporting and television magazines, company/organisation or
institutional films.
Projects for the production of TV films, fiction series, documentary series and animation series.
Only series that include a minimum of six episodes will be taken into account by the support
programme. However, mini-series (of at least three episodes) will be taken into account, if the length
of each episode is more than 30 minutes.
Projects for finishing (post-production) fiction and animation films as well as documentary films:
laboratory work, editing (sound and vision), adding soundtracks, dubbing (and sub-titling), and
previews.

Lot 2: Support for the promotion, distribution, dissemination and networking of the ACP cinema and
audiovisual sector
Support for the networking of distributors, and sales representatives for the exchange of audiovisual
works between ACP States, in Europe and internationally.
Digital dissemination and exploitation in the ACP States (e.g. developing the dissemination of digital
cinema in urban areas).
Support for the visibility of ACP audiovisual works through promotion Actions: locally, in the
international markets and in festivals, as well as through all media (previews, posters, folders, etc.) and
through marketing Actions.
Actions for networking professionals, aimed at enabling the development of relations between the ACP
States and regions (e.g. through stands and joint stands) and the creation or consolidation of ACP
markets (database, professional meetings).
Lot 3: Support for the professional development and training of ACP professionals in the cinema and
audiovisual sector
The proposed Actions should aim to develop capacities in the cinema and audiovisual trades, to perceive and
integrate the ACP environment aspect in the work.
The training organised chiefly on the spot in the ACP regions by training organisations must have
sustainable impact on the development of the ACP cinema and audiovisual sector.
Training in screenplay writing techniques
Dramatic and visual writing techniques – identification of public targets – international standards for
writing and presentation of screenplays – creative collaboration between writers, publishers of
screenplays, producers, directors, directors of photography and sound recording.
Technical training
Direction of actors – cinema play – shooting techniques – sound and lighting techniques – editing
techniques – exploitation and maintenance – dubbing and sub-titling – creative collaboration
between technicians and other artistic fields such as photography, sound, and music.
Training in new technologies
Application of new technologies in the audiovisual field: production, post-production, distribution,
marketing, new markets.
Training in economic, financial and commercial management
Economic skills (management, accounting, marketing, promotion and presentation) – production –
distribution/exploitation – legal and financial aspects of co-production – understanding international
markets – networking and accessibility of the international markets.
Training of trainers
Economic and financial management – screenplay techniques – telecine techniques – new
technologies.
Number of proposals and grants per applicant or partner
An applicant or partner may not submit or participate in more than two proposals for Actions for
the call as a whole.
An applicant may not be awarded more than two grants under this call for proposals.

Are not eligible
Production and development activities from the following categories of works and Actions:
Actions that directly or indirectly promote messages that are contrary to the policies of the European
Union. For example, no grant will be awarded for a work that goes against EU policy on public health
(alcohol, tobacco, drugs), respect for human rights, citizens’ security, freedom of expression, and the
equality of people;
Actions that justify violence and/or racism, Actions with pornographic content;
Actions focused only or mainly on sponsoring the participation of individuals in workshops, seminars,
conferences or congresses;
Actions and institutional productions aimed at promoting an institution and/or its work;
Educational programmes;
Propaganda or proselytising productions;
Quiz shows, talk shows, reality shows, docu-soaps;
TV reports and information programmes, and enterprise/organisation and institutional films;
Tourism promotion documentaries, news reports;
Productions of an advertising nature.
Geographical coverage
The Actions must be implemented in one or more of the countries mentioned in 2.1.1 (footnotes 9 and 10).
However, Actions implemented in South Africa and Cuba are not eligible and thus cannot be financed.

2.1.4
Eligibility of costs: costs which may be taken into consideration for the grant
Only ‘eligible costs’ can be taken into account for a grant. The budget is therefore both a cost estimate and a
ceiling for ‘eligible costs’. Note that the eligible costs must be based on real costs, not lump sums (except for
subsistence costs and indirect costs).
Recommendations to award a grant for a proposal are always subject to the condition that the checking
process, which precedes the signing of the contract, does not reveal problems requiring changes to the budget
(for instance arithmetical errors, inaccuracies or unrealistic costs and ineligible costs).
The checks may give rise to requests for clarification and may lead the ACP Secretariat to impose
modifications or reductions to address such mistakes or inaccuracies. The amount of the grant and the
percentage of co-financing may not be increased in any case as a result of these corrections.
It is therefore in the applicant's interest to provide a realistic and cost-effective budget.
The total cost of the Action and the contribution requested from the ACP Secretariat as well as the cofinancing must be expressed in euro (€). Applicants from States that are not in the euro zone must use the
conversion rates published in the Official Journal of the European Union, series C, in force during the month
of the submission of the provisional budget, available at the following website:

Eligible costs must be based on real costs based on supporting documents (except for subsistence costs
and indirect costs where flat-rate funding applies).
Eligible direct costs
To be eligible under the Call for Proposals, costs must respect the provisions of article 14 of the General
Conditions to the Standard Grant Contract annexed to the grant contract.
Costs of staff working for the project
Staff costs shall mean any payment made to a person working for a member of the partnership, on a
permanent or temporary basis, for any task directly related to the Action. Staff costs shall be calculated on
the basis of the actual salary/fee of the employer/service provider, multiplied by the number of months/days
to be spent on the project.
This calculation shall include all the ‘normal’ charges paid by the employer, such as social security
contributions and related costs, but shall exclude any bonus, incentive and profit-sharing arrangements or
running costs.
The cost of staff assigned to the Action is an eligible cost and is not a contribution in kind.
Equipment
Expenditure relating to investment in facilities or the purchase of equipment should only account for a minor
proportion of the total eligible costs, and in any case should represent no more than 15% of these.
Participation in stakeholder meetings
For stakeholder meetings organised by the ACP Secretariat, an amount of EUR 5,000 per year for the
duration of the project must be entered under the budget line ‘Participation in seminars/conferences’ and
‘Trips for participating in the conferences/seminars’.
Contingency reserve
A contingency reserve not exceeding 5% of the sum of the Action’s direct eligible costs may be included in
the budget of the Action. It can only be used with the prior written authorisation of the ACP Secretariat.

Eligible indirect costs (overheads)
Indirect costs incurred in carrying out the Action are eligible for flat-rate funding fixed at not more than 7%
of the total eligible direct costs.
However, if the applicant is in receipt of an operating grant financed by the European Commission, no
indirect costs may be claimed within the proposed budget for the Action.
Contributions in kind
Any contributions in kind do not represent actual expenditure (‘in cash’) and may not be treated as cofinancing. They must be mentioned separately in the Application Form (see Application Form, Part B,
Section I, 3).
Ineligible costs
The following costs are not eligible:
debts and provisions for losses or debts;
interest owed;
items already financed in another framework;
purchases of land or buildings, except where necessary for the direct implementation of the Action, in
which case ownership must be transferred to the final beneficiaries and/or local partners, at the latest by
the end of the Action;
currency exchange losses;
taxes, including VAT, unless the Beneficiary (or the Beneficiary’s partners) cannot reclaim them and
the applicable regulations do not forbid coverage of taxes;
credits to third parties.
Co-financing
Only monetary contributions (cash) are considered as co-financing.
Budget and sources of financing
The budget of the Action attached to the request must be balanced for expenses and receipts and must
indicate clearly the eligible costs that could lay claim to financing from the Community budget.

2.2
How to apply and the procedures to follow
2.2.1
Application Form and other documents to accompany the application
Applications must be submitted using the Application Form annexed to these guidelines (annex A). This
form includes guidance for the Concept Note, which must also be drafted. Applicants must keep strictly to
the format of the application and fill in the paragraphs and the pages in order. Please provide a budget (annex
B) without mentioning cents/centimes (round down if the number is less than 0.50€; round up if the number
is more than 0.50€).
Applications must be in either English or French.
Please complete the Application Form as carefully and clearly as possible, to facilitate its evaluation.
Any error related to the points listed in the checklist (Part B section V of the Application Form) or any major
inconsistency in the Application Form (e.g. the amounts mentioned in the budget are inconsistent with those
mentioned in the Application Form) may lead to the rejection of the proposal.
Clarifications will only be requested when information provided is unclear, thus preventing the ACP
Secretariat from conducting an objective assessment. Hand-written applications will not be accepted.
Only the Application Form and the published annexes (budget, logical framework), which should be
completed, and the separate annexes listed below, will be transmitted to the evaluators and assessors. It is
therefore of utmost importance that these documents contain ALL relevant information concerning the
Action.
The application file includes the following documents to submit (separate from the Application Form):
Lot 1: Support for production
1. Screenplay, including the storyboard;
2. List of audiovisual works produced before by the production company;
3. Curriculum Vitae of the producer and the director;
4. Short description of the production company/organisation behind the project and of the co-producing
structures where appropriate;
5. Copy of the transfer of rights contract between the producer and the writers for: the subject,
screenplay, adaptation, music, etc.;
6. Copies of the co-production agreements or letters of engagement (in the case of co-production);
7. Any confirmations of options;
8. A recording (DVD or VHS cassette) of a previous work by the director (different from the cassette of
the pilot, in the case of a series);
9. For a work intended for a first screening on television, the copy of the co-production (or option
agreement) of an ACP television channel or a European Union channel is mandatory;
10. For a series, a recording (DVD or VHS cassette) of the pilot of the series;
11. For an application focused on post-production, a recording (DVD or VHS cassette) of the final
available version of the project (rushes or pre-editing).

Lot 2: Support for the promotion, distribution, dissemination and networking of the ACP cinema and
audiovisual sector
For all the Actions in Lot 2
1. Project for distribution, promotion or networking;
2. Curriculum Vitae of the project leader;
3. Short description of the production company/organisation leading the project and of partner structures.
Distribution Actions
3. Copy of the distribution contract between the distributor and producer;
4. Signed copies of the distribution agreements or letters of engagement of at least two full-length films
or a TV series. For a TV work, the signed copy of the dissemination agreement from an ACP television
channel is obligatory;
5. A recording (DVD or VHS cassette) of the work/s to distribute;
6. For a series, the catalogue of works distributed by the applicant.
Promotion Actions
7. For an application focusing specifically on promotion, a recording (DVD or VHS cassette) of the last
available version of the film (rushes, pre-editing or final edit).
Lot 3: Support for the professional development of training
1. Training project for professional development;
2. Curriculum Vitae of the project leader;
3. Short description of the company/organisation in the Action, and the structures of partners;
4. Curriculum Vitae of the trainers/tutors in the training Action for professional development.
5. Copies of any agreements, or framework agreement between the partner or associate organisations, or
subcontractors.
No additional annex must be sent.

Applications must be submitted in a sealed envelope by registered mail, courier service or by hand-delivery
(a signed and dated certificate of receipt will be given to the deliverer in this case) at the address below:

The Application Form must not be split into several different files.

Applicants must verify that their application is complete by using the Checklist (see Application Form,
Section V, Part B) and by signing the ‘Declaration by the Applicant’ (Application Form, Section VI, part B).
Incomplete applications may be rejected.
Signing of documents
The legal representative of the company/organisation that submits the Application Form must sign the
‘Declaration by the Applicant’. Furthermore, the part of the Application Form identifying the applicant
(Introduction, page 2) must indicate the contact person to whom all requests for clarification or further
information concerning the proposal will be addressed.
The applicant only has to sign the ‘Declaration by the Applicant’.
The applicant does not have to sign a ‘Partnership Statement’ (see Application Form, Section III).
The ‘Description of Partners’ (Section III of the Application Form) has to be filled in either by the legal
representative of the partner himself or by the applicant on the basis of the information provided by the
partners.
The ‘Partnership Statement’ must be filled in by each partner and signed by the person legally authorised to
represent the partner institution.
2.2.3 Deadline for submission of applications
The deadline for submission of applications is 3 September 2008, as evidenced by the date of dispatch, the
postmark or the date of the deposit slip.
In case of hand-delivery, the deadline for submission is 15:00 Brussels time of that same day, as evidenced
by the signed and dated receipt.
Any application sent or submitted after the deadline will automatically be rejected.

disclosed. Any attempt by an applicant to influence the evaluation process in any way (whether by initiating
contact with the members of the Evaluation Committee or otherwise) will result in the immediate exclusion
of its proposal from further consideration and its exclusion from participating in new calls for proposals for a
period of two years.
However, applicants whose proposals are rejected at different phases of the evaluation process will be
informed of the reasons for that decision.

2.3
Evaluation and selection of applications
Applications will be examined and evaluated by the ACP Secretariat with the assistance of external experts
(assessors). All Actions submitted by applicants will be evaluated according to the following steps and
criteria.
(1)
STEP 1: OPENING SESSION AND ADMINISTRATIVE CHECK
The following will be assessed:
The deadline for receipt has been respected.
If the deadline has not been respected, the proposal will automatically be rejected.
The Application Form satisfies all the criteria mentioned in the Checklist (section V of Part B of
the Application Form).
If any of the requested information is missing or incorrect, the proposal may be rejected on that sole
basis and the proposal will not be evaluated further.
Following the opening session and the administrative check of the applications, the ACP Secretariat will
send a letter to all applicants, indicating whether their application was submitted prior to the deadline,
informing them of the reference number they have been allocated, whether they have satisfied all the criteria
mentioned in the Checklist and whether their Concept Note has been recommended for evaluation.
(2)
STEP 2: EVALUATION OF THE CONCEPT NOTE
The evaluation of the Concept Notes that have passed the administrative checks will cover the relevance of
the Action, its merits and effectiveness, its viability and sustainability. The ACP Secretariat reserves the right
to skip the evaluation of the Concept Notes, whenever considered justified (e.g. when a less-than-expected
number of proposals is received), and to proceed straight to the evaluation of the corresponding full
proposals.
Please note that the scores awarded to the Concept Note are separate from those given to the Full
Application.
The Concept Notes will be given an overall score of 50 points in accordance with the breakdown provided in
the Evaluation Grid below. The evaluation shall also verify the compliance with instructions provided in the
guidance for the Concept Note, Part A of the grant Application Form.
If the examination of the Concept Note reveals that the proposed Action does not meet the eligibility criteria
stated in paragraph 2.1.3, the proposal shall be rejected on this sole basis.

Once all Concept Notes have been evaluated, a list will be established with the proposed Actions ranked
according to their total score.
Firstly, only the Concept Notes which have been given a minimum score of 12 points in the ‘relevance’
category as well as a minimum total score of 30 points will be considered for pre-selection.
Secondly, the list of Concept Notes will be reduced in accordance with their ranking in the list, to those
whose sum of requested contributions amounts to twice the available budget for the corresponding Part,
that is to say:
7.6 millions € for Lot 1 support for production
3.4 millions € for Lot 2 support for promotion, distribution, dissemination and networking
2 millions € for Lot 3 support for professional development and training.
The evaluation committee will then evaluate the full proposals of the pre-selected applicants.

STEP 3: EVALUATION OF THE FULL APPLICATION
An evaluation of the quality of the proposals, including the proposed budget and the capacity of the applicant
and its partners, will be carried out in accordance with the evaluation criteria set out in the Evaluation Grid
included below.
The evaluation criteria break down into selection criteria and award criteria.
The selection criteria are intended to evaluate the applicant’s financial and operational capacity (see section 1
of the Evaluation Grid below) to ensure that they:
have stable and sufficient sources of finance to maintain their activity throughout the period during
which the Action is being carried out and, where appropriate, to participate in its funding (see Part B of
the Application Form section II 3.2);
have the management capacity, professional competencies and qualifications required to successfully
complete the proposed Action (see Part B of the Application Form section II 3.1 and 3.3).
This also applies to any partners of the applicant.
The award criteria allow the quality of the proposals submitted to be evaluated in relation to the set
objectives and priorities, and to award the grants to Actions that maximise the overall effectiveness of the
call for proposals.
They enable the selection of proposals which the ACP Secretariat can be confident will comply with its
objectives and priorities and guarantee the visibility of the EDF financing.
They cover such aspects as the relevance of the Action and its consistency with the objectives of the call for
proposals, quality, expected impact and sustainability of the Action, and its cost-effectiveness.
If the examination of the proposal reveals that the proposed Action does not meet the eligibility criteria
stated in paragraph 2.1.3, the proposal shall be rejected on this sole basis.
Scoring:
The evaluation criteria are divided into sections and subsections. Each subsection will be given a score
between 1 and 5, in accordance with the following guidelines:
1 = very poor; 2 = poor; 3 = adequate; 4 = good; 5 = very good

(4) STEP 4: VERIFICATION OF ELIGIBILITY OF THE APPLICANT AND PARTNERS
The eligibility verification, based on the supporting documents requested by the ACP Secretariat (see 2.4),
will only be performed for the proposals that have been provisionally selected according to their score and
within the available financial envelope.
·The Declaration by the applicant (Part B, Section VI of the Grant Application Form) will be crosschecked with the supporting documents provided by the applicant. Any missing supporting document or
any incoherence between the Declaration by the applicant and the supporting documents may lead to the
rejection of the proposal on that sole basis.
·The eligibility of the applicant, the partners, and the Action will be verified according to the criteria set
out in sections 2.1.1, 2.1.2 and 2.1.3.
Following the above analysis, if necessary, any rejected proposal will be replaced by the next best placed
proposal in the reserve list that falls within the available financial envelope, which will then be examined for
the eligibility of its applicant and the partners.
The legal validity of the statutes, contracts and supporting documents provided by the applicant may be
examined and give rise to requests for clarifications that will enable finalisation of the dossier selection.
The ACP Secretariat reserves the right to reallocate the sum available from a Lot, if the total sum of the
budgets of the Actions selected does not use up the budget of this Lot.

2.4
Submission of supporting documents for provisionally selected proposals
Applicants who have been provisionally selected or listed under the reserve list will be informed in writing
by the contracting authority. They will be requested to supply, in the 20 calendar days following the ACP
Secretariat’s receipt of the pre-selection notification, the following documents in order to allow the ACP
Secretariat to verify the eligibility of the applicants and their partners:
1. The statutes or articles of association of the applicant organisation12 and of each partner organisation, and
the place and date of registration (or the receipt for the filing date for the application for registration) of more
than one year from the date of the launch of this call for proposals.
2. Where the grant requested exceeds 500,000 €, an external audit report produced by an approved auditor,
certifying the accounts for the last financial year available.
3. A copy of the applicant’s latest accounts (the profit and loss account and the balance sheet for the previous
financial year for which the accounts have been closed)13.
4. Legal entity sheet (annex D) duly completed and signed by the applicant, accompanied by the justifying
documents that are requested therein. If the applicant has already signed a contract with the European
Commission, instead of the legal entity sheet and its supporting documents the legal entity number may be
provided, unless a change in legal status has occurred in the meantime.
5. A financial identification form for the specific account for the Action (annex E), conforming to the model
attached in annex E, certified by the bank to which the payments will be made. This bank must be located in
the States where the applicant is registered.
6. The original supporting documents of the co-financing, for all the co-financing announced in annex B, by
using the model in annex F.
7. The name, complete address and contact details of the audit firm that will carry out the
verification referred to in Art. 15.6 of the General Conditions. The selected audit firm must be a
member of an internationally recognised supervisory body for statutory auditing.
The supporting documents requested must be supplied in the form of originals or photocopies of the said
originals. However, the legal entity sheet and the financial identification form must always be submitted in
originals.
Where such documents are not in French or English, a translation into one of these two languages for the
relevant parts of the document proving the eligibility of the applicant must be attached and will prevail for
the purpose of analysing the proposal.
If these supporting documents are not provided before the set deadline (20 calendar days from the receipt of
the letter sent by the ACP Secretariat), the application may be rejected.
Based on the verification of the supporting documents by the evaluation committee, the latter will make a
final recommendation to the ACP Secretariat, which will decide on the awarding of grants.

2.5
Notification of the Contracting Authority’s decision
2.5.1 Content of the decision
Applicants will be informed in writing of the ACP Secretariat’s decision concerning their application and the
reasons for the decision.
Applicants believing they have been harmed by an error or irregularity during the award process may
petition the ACP Secretariat directly. The ACP Secretariat must reply within 90 days of the date of receipt of
the complaint.
Where the European Commission is informed of such a complaint, it must communicate its opinion to the
ACP Secretariat and do all it can to facilitate an amicable solution between the complainant (applicant) and
the ACP Secretariat. If this procedure fails, the applicant may have resource to procedures established under
the recipient’s national legislation.
Note: at the end of the selection procedure, no file or any material accompanying the file (cassettes,
CD-ROMs, plans, etc.) will be returned to the applicants.

Conditions applicable to implementation of the Action following the ACP Secretariat’s
decision to award a grant
Following the decision to award a grant, the Beneficiary will be offered a contract based on the ACP
Secretariat's standard contract annexed to these guidelines (annex G1 or G2).
By signing the Application Form (annex A), the applicant declares accepting, in the case where it is awarded
a grant, the contractual conditions as laid down in the G1 and G2 contracts in annex.
Implementation contracts
Where implementation of the Action requires the Beneficiary to award procurement contracts, it must award
the contract to the tenderer offering the best value for money, that is to say, the best price-quality ratio, in
compliance with the principles of transparency and equal treatment for potential contractors, care being taken
to avoid any conflict of interests. To this end, the Beneficiary must follow the procedures set out in Annex
IV to the contract.
