Annex 1 - Mandatory conditions 1. No supply of alcohol shall be made under this Premises Licence at a time: (a) when there is no designated premises supervisor in respect of the Premises Licence. (b) when the designated premises supervisor does not hold a personal licence or his or her personal licence is suspended. 2. Every supply of alcohol under the Premises Licence shall be made or authorised by a person who holds a personal licence. 4 Annex 2 - Conditions consistent with the Operating Schedule A) General – all four licensing objectives: All Staff shall be trained in respect of relevant licensing law, the implementation of the licence conditions, health and safety, first aid alcohol and drug awareness and conflict management. B) The Prevention of Crime and Disorder: The premises manager will actively participate and support the local Pubwatch Scheme, when in existence. Where existing, CCTV systems will continue to operate during the additional hours. In line with any new or existing, company Alcohol and Social Responsibility policy, there will be no promotions that encourage illegal, irresponsible or immoderate consumption. All incidents shall be logged and recorded in a log book. A security manual will be available on the premises. Signs will be put up throughout the premises alerting customers to possible theft. Toilets will be checked on average every two(2) hours daily, and a log maintained of times and dates they are visited. A local authority or similar proof of age scheme will be operated at the premises, and any relevant literature displayed. Signs will be displayed warning customers about using drugs on the premises. An over 21 years of age, entrance policy, will be operated on Friday and Saturday after 19:00 hours. Management and staff are to be more pro-active in relation to identification and to log all challenges in a log book, which should be made readily available to Police and Council Officers on demand. Clear, legible and visible notices relating to the over 21 policy on the premises are to be displayed. Staff are to endeavour to check the identification of person’s using the premises, wherever possible. The premises licence holder will have regular meetings with Police to review the current procedures. C) Public Safety: A fire detection and warning system must be in place on the premises, along with fire extinguishers. An emergency lighting system must be in place on the premises. Safety signs and notices must be in place on the premises. Free drinking water must be made available to all customers. A phone number of an allocated taxi firm must be displayed on the premises. Public transport information (including night time travel options) is to be made available to customers 5 D) The prevention of Public Nuisance: Reasonable steps will be taken to recognise the rights of local residents and encourage customers to leave the premises quietly. Managers of the premises will liaise with local neighbours as part of their duties, and resolve any reasonable concerns. Emergency call procedures will be in place. Deliveries are to be conducted during daytime, to control noise nuisance. Notices will be displayed around the premises, requesting patrons to leave the premise quietly. All windows and doors are to be kept shut whilst live entertainment or amplified music is being played. The premises licence holders will be pro-active in monitoring the noise from the premises at the perimeter of the building. E) The Protection of Children from Harm: The premises licence holder will at all times observe the law and ensure that alcohol is not served to people who are under 18 years of age. The manager and staff are to be briefed in the importance of their responsibilities in ensuring that customers are over 18, accordingly. No adult entertainment of a nude physical nature, paid for by the company, is to be permitted at the premises. All children under the age of 16 years are to remain the responsibility of the accompanying adult, when using the premises and/or the exterior area of the premises. Staff will not be allowed to be in sole supervision of children, who will remain to be the responsibility of the accompanying adult at all times. Admittance refused to all persons under the age of 16 years unless accompanied by an adult. Bar and any security staff will be trained to prevent the sale of alcohol to persons under the age of 18 years. No children under the age of 16 years, will be permitted on the premises after 19:00 hours. 6 Annex 3 - Conditions attached after a hearing by the licensing authority Conditions attached to the premises licence at the Committee hearing on 16 March 2006:1. All embedded restrictions imposed by the Licensing Act 1964 and other related legislation are removed. 2. The provisions of the Operating Schedule, with the following additional conditions, as set out in a letter dated 8th February 2006 from the applicants solicitor, (as amended at the Hearing) will apply:a) Drugs awareness course for Personal Licence holders to be completed within 3 months from the date of granting this variation of the premises licence and all new managers to undergo similar training. b) To add further Personal Licence holders to the premises within 3 months from the date of granting this variation of the premises licence. c) To operate an over 21 policy on Friday and Saturday. d) Management and staff to be more pro-active in relation to identification and to log all challenges in a log book, which should be readily available to all Police and Council Officers on demand. e) To put up clear, legible and visible notices relating to the over 21 policy on the premises. Staff are to endeavour to check person’s identification wherever possible. f) The Premises Licence holder will have regular meetings with Police to review the current procedures. 3. All doors and windows are to be kept shut whilst live entertainment or amplified music is played. 4. The premises licence holders will be pro-active in monitoring the noise from the premises at the perimeter of the building. Reasons for the decisions This application is granted in these terms having regard to the need to prevent public nuisance, crime and disorder and to protect children from harm.
