It upends families and forces couples who once expected to grow old together to untie the knot and rebuild their lives. While the emotional toll of divorce is devastating, the financial toll is often just as severe. Many couples need two incomes to maintain their lifestyle and, if the couple was living on just one income, it will now have to support two households, at least temporarily. If a couple has children, a divorce often results in unforseen additional costs, such as increased travel expenses to visit children and the need for duplicate sets of things like toys and clothes. Whether you are the main breadwinner, half of a dual-earner couple, stay-athome mom, or childless, you will want to be prepared to secure the best financial outcome. This entails gaining a thorough understanding of your finances as well as knowing exactly what you are entitled to. You will also need to think through the consequences of any financial decisions you make during the divorce proceedings. For example, you may be emotionally attached to the family house but will you be able to afford its upkeep once you are divorced? Once you have a thorough understanding of your total assets and what you want from the divorce, you will need to consider the way in which you wish to receive your settlement. If you are awarded alimony you will have the option to receive a lump sum or regular periodic payments. Similarly, if you claim a share of your former spouse’s retirement benefits you could take an immediate payment based on an estimate of the future value of your ex-husband’s pension. Or, you could seek a deferred payout of benefits, which would begin as soon as your ex-husband starts collecting his pension and would be paid out in regular periodic payments. The financial decisions you make during this emotionally challenging time can have significant long-term consequences, but you needn’t go it alone. These six steps can help ensure the best possible financial outcome for you and your family. STEP 1 Get Expert Advice STEP 2 Become Financially Independent STEP 3 n Get a credit card in your own name. n Close all joint accounts or, at the very least, change signature authority on any joint accounts so both parties must sign to complete a transaction. Compile a Financial Inventory In any divorce case, an attorney’s or financial advisor’s advice—and the award you eventually get— depends largely on the information you provide. So you will want to compile a detailed financial inventory, including all pay stubs, bank statements, and tax returns for the past seven years and as well as a complete list of assets. Also include a list of all passwords for any online financial records. STEP 4 Learn What You Are Entitled To and Assess Financial Consequences Should you keep the primary home, vacation home, or do you want the stock portfolio? Before you decide on how to divide marital assets you will want to consider all the related financial consequences and tax implications. Here are things to keep in mind: STEP 5 n Retirement funds can be a couple’s largest single asset, so consider asking for a share of your spouse’s pension or retirement savings. Be careful to determine how these assets will be distributed and when. n You may be entitled to 50% of your former spouse’s Social Security benefit. n Payouts give you control of any monies due you but can generate a tax burden depending on what you do with the money. n As you divide assets, take taxes into account. Whoever receives assets that have appreciated in value will get stuck with the tax bill. Look Beyond Child Support You will want to address as many child-related financial issues as possible in the divorce agreement. For example, if your child has special needs or gifts, who will pay for related services? Who is going to pay for summer camp? And, if your kids are approaching driving age, who will pay for car expenses? You may also wish to build into the divorce agreement a procedure for periodically reviewing the settlement to allow for changes in the financial needs of your children. And, most importantly, don’t pretend that nothing has changed financially. Let your kids know about the financial impact the divorce will have on their lives and work with them to help reduce costs. STEP 6 Moving On Once you are divorced, make sure that all beneficiaries of your and your ex-spouse’s retirement accounts and insurance policies are in line with your settlement agreement. Also, if you gave your former spouse power of attorney or if you gave him a healthcare proxy through a health care directive, you will likely want to change this. You may also wish to name a property guardian to manage your children’s finances in the event that something happens to you. If remarriage is in your future, consider a prenuptial agreement. Should you get divorced a second time, a prenuptial agreement will make the process less complicated and will protect you financially.
