Tax I.D. #95-4688722. 20th Annual Heads Up Youth Foundation Charity Golf Tournament Helicopter Golf Ball Drop Rules and Regulations 1. Entry fees are $20 for one golf ball, $50 for four golf balls, $100 for 12 golf balls or $200 for 36 golf balls. 2. The Heads Up Youth Foundation (“Charity”) 20th Annual Heads Up Youth Foundation Charity Golf Tournament Helicopter Golf Ball Drop (“Helicopter Golf Ball Drop”) will take place on Monday, July 17, 2017 at MountainGate Country Club, 12445 MountainGate Drive, Los Angeles, CA 90049. Participants in the Helicopter Golf Ball Drop may enter more than once. All golf ball numbers will be issued at random to qualifying participants. Each golf ball sold will be uniquely and consecutively numbered. Numbers will be assigned as entries are received. 3. On Monday, July 17, 2017, golf balls bearing numbers issued to the participants will be placed randomly in bags, flown in a helicopter and dropped over a marker on the #9 fairway at MountainGate Country Club. The participant whose golf ball falls into the hole will receive a $2,000 cash prize. In the event more than one golf ball falls into the hole, the ball on the bottom of the hole will be the winner. If no ball falls into the hole, the ball closest to the hole will be deemed the winner. If it is determined that more than one golf ball comes to rest equally closer to the marker than any other golf ball, the prize of $2,000 will be split evenly amongst the participants issued such equally closer golf balls. Depending on the capacity of the bags, the golf balls bearing numbers issued to the participants may be divided and separately dropped in more than one drop, but in all events, the winner of the cash prize will be determined based upon the location of all dropped golf balls following completion of all such drops. Determination of the winner(s) of the cash prize will be made by the Charity, and such determination, upon completion, shall be final. Odds of winning are based on number of balls sold. 4. The winner of the cash prize will be announced at the site of the 20th Annual Heads Up Youth Foundation Charity Golf Tournament and need not be present to win. The winner will be notified via phone and/or email in the event the winner is not present at the 20th Annual Heads Up Youth Foundation Charity Golf Tournament. 5. If the Helicopter Golf Ball Drop should be cancelled for any reason at all, including without limitation, insufficient participation in the Helicopter Golf Ball Drop, cancellation or postponement of the 20th Annual Heads Up Youth Foundation Charity Golf Tournament, inclement weather, emergency conditions or flight restrictions, or helicopter malfunctions or other operational failures, all money collected will be automatically deemed donated to the Charity. Charity, MountainGate Country Club and Helinet are not responsible for any cancellation of the Helicopter Golf Ball Drop and will not substitute the prize should this occurrence arise. 6. To participate in the Helicopter Golf Ball Drop, an entry form must be fully completed, signed and mailed or delivered in person with payment in full to: Heads Up Youth Foundation, 12400 Ventura Blvd., #1221, Studio City, CA 91604. Completed, signed and paid in full entries will also be accepted in person at the 20th Annual Heads Up Youth Foundation Charity Golf Tournament. All entry fees are non-refundable. 8. By participating, each participant, to the maximum extent permitted by law, unconditionally, irrevocably and forever releases, discharges, indemnifies, and holds harmless Charity, MountainGate Country Club and Helinet, each of the foregoing’s respective affiliated companies or organizations, and each of the foregoing’s respective officers, directors, employees, agents, representatives, advertising agencies and promotional partners (collectively, the “Releasees”) from any and all liability, claim, loss, harm, injury, damage, cost, expense, or federal, state, or local tax, interest or penalty, whatsoever directly or indirectly arising from or related to the Helicopter Golf Ball Drop, its operation or its cancellation (including, without limitation, any physical injury, death, determination of the winning participant, acceptance of any prize or claim by any other participant in the Helicopter Golf Ball Drop) or such participant’s participation in the Helicopter Golf Ball Drop. 9. Acceptance of a prize constitutes such winner’s unconditional and irrevocable permission for the Charity to use such winner’s name, address, photograph, testimonial or other likeness and/or prize information or personal exposition (and/or any edited portion thereof) for promotional, advertising, and/or publicity purposes in any media, now or hereafter known throughout the world in perpetuity, without compensation or notice to, or further consent of, such winner, to the maximum extent permitted by law. 10. All federal, state and local taxes are the sole responsibility of any winner of the cash prize. IRS reporting and withholding requirements apply. 11. Entry fees to participate are not tax deductible, and are in addition to playing in the 20th Annual Heads Up Youth Foundation Charity Golf Tournament, or for any special events sponsorship. A participant need not be a member of the Charity or a golfer entered to play in the 20th Annual Heads Up Youth Foundation Charity Golf Tournament, to participate in the Helicopter Golf Ball Drop.
