Wilmington University is committed to providing a safe and secure environment for all faculty, staff and students. Inside this brochure you will find an overview of our sexual
misconduct policy, how to get help for anyone experiencing sexual misconduct, sex or gender-based harassment, or discrimination, where to report incidents and the community resources available to staff and students. Wilmington University, in compliance with all applicable federal and state laws and regulations, does not discriminate on the basis

Understanding Sexual Misconduct
Sexual Misconduct offenses include, but are not limited to sexual
harassment, sexual violence, sexual coercion, sexual exploitation, gender
discrimination, dating/domestic/intimate partner violence, stalking,
and retaliation.
. Sexual Harassment is defined as unwanted attention or an unwel-
come action based on one’s gender that is so severe, or pervasive that
it unreasonably interferes with the work or educational environment.
. Sexual Violence

is defined as physical sexual acts perpetrated
against a person’s will or where a person is incapable of giving
consent. A number of acts fall into the category of sexual violence,
including but not limited to rape, sexual assault, sexual battery,
misconduct, and sexual coercion.
Sexual Coercion is defined as the act of using pressure (including
physical, verbal or emotional pressure), alcohol, medication, or drugs,
or force to have sexual contact against someone’s will or with
someone who has already refused.

Sexual Exploitation is defined as taking sexual advantage of another.

her safety or the safety of others; or (b) suffer substantial emotional
distress.

employment, educational, or institutional benefit action because of
participation in a complaint.

Mandatory Reporting
Faculty and staff are required by law to report incidents of sexual misconduct to the Title IX Coordinator. When a faculty or staff member
becomes aware of an allegation of the university’s Sexual Misconduct,
Discrimination or Harassment Policy committed by someone affiliated
with the university (e.g. faculty, staff, student, volunteer, vendor, contractor) or the incident occurs within an environment controlled by the
university (e.g. field trip) he/she must notify the university immediately
by contacting Dr. Nicole Romano, Title IX Coordinator at
302-356-6846 or reporting the incident to University Safety.
Consent is defined as the act of willingly agreeing to engage in
sexual contact/conduct. In order to give consent, one must be of legal
age and have the capacity to consent.
There are limited exceptions to the mandatory reporting obligations. For

Victim’s Rights & Reporting
Victims of sexual misconduct are strongly encouraged to go to the nearest
hospital for medical services and a forensic exam. For emergency help or
to report the incident to local authorities, call 911. The university will
assist any victim with accessing law enforcement. Contact the Title IX
Coordinator or campus safety.

Victims of sexual misconduct may also file a formal complaint within the
university system and are encouraged to do so with either the Title IX
Coordinator or University Safety. The university has an obligation to
investigate all reports of sexual misconduct and take prompt and
appropriate action.
Victims may choose not to report or file a complaint and get confidential
support from the National Crisis Hotline at 800.273.8255. Additional
resources are located in Chapter V of the Student Handbook, Appendix A
of the Annual Security Report, or with University Safety or Title IX
Coordinator.
