GENDER DISCRIMINATION SEXUAL HARASSMENT SEXUAL MISCONDUCT Wilmington University is committed to providing a safe and secure environment for all faculty, staff and students. Inside this brochure you will find an overview of our sexual misconduct policy, how to get help for anyone experiencing sexual misconduct, sex or gender-based harassment, or discrimination, where to report incidents and the community resources available to staff and students. Stalking is defined as engaging in a course of conduct directed at a Understanding Sexual Misconduct Sexual Misconduct offenses include, but are not limited to sexual harassment, sexual violence, sexual coercion, sexual exploitation, gender discrimination, dating/domestic/intimate partner violence, stalking, and retaliation. . Sexual Harassment is defined as unwanted attention or an unwel- come action based on one’s gender that is so severe, or pervasive that it unreasonably interferes with the work or educational environment. . Sexual Violence . is defined as physical sexual acts perpetrated against a person’s will or where a person is incapable of giving consent. A number of acts fall into the category of sexual violence, including but not limited to rape, sexual assault, sexual battery, misconduct, and sexual coercion. Sexual Coercion is defined as the act of using pressure (including physical, verbal or emotional pressure), alcohol, medication, or drugs, or force to have sexual contact against someone’s will or with someone who has already refused. . Sexual Exploitation is defined as taking sexual advantage of another. . specific person that would cause a reasonable person to (a) fear for his or her safety or the safety of others; or (b) suffer substantial emotional distress. . Retaliation is defined as any attempt to penalize or take an adverse employment, educational, or institutional benefit action because of participation in a complaint. Mandatory Reporting Faculty and staff are required by law to report incidents of sexual misconduct to the Title IX Coordinator. When a faculty or staff member becomes aware of an allegation of the university’s Sexual Misconduct, Discrimination or Harassment Policy committed by someone affiliated with the university (e.g. faculty, staff, student, volunteer, vendor, contractor) or the incident occurs within an environment controlled by the university (e.g. field trip) he/she must notify the university immediately by contacting Dr. Nicole Romano, Title IX Coordinator at 302-356-6846 or reporting the incident to University Safety. Consent is defined as the act of willingly agreeing to engage in sexual contact/conduct. In order to give consent, one must be of legal age and have the capacity to consent. There are limited exceptions to the mandatory reporting obligations. For incidents of abuse or neglect of minors, Delaware law requires reporting of abuse or neglect to the Department of Services for Children, Youth and their Families at 800-292-9582 and/or local law enforcement. Partner Violence is defined as violence, including assault, battery or other physical abuse between those in an intimate, dating or romantic relationship with each other. Dating/Domestic/Intimate Victim’s Rights & Reporting Victims of sexual misconduct are strongly encouraged to go to the nearest hospital for medical services and a forensic exam. The university has an obligation to investigate all reports of sexual misconduct and take prompt and appropriate action. Victims may choose not to report or file a complaint and get confidential support from the National Crisis Hotline at 800.273.8255. Additional resources are located in Chapter V of the Student Handbook, Appendix A of the Annual Security Report, or with University Safety or Title IX Coordinator.
