MEDICAL MARIJUANA TRANSFER OF OWNERSHIP APPLICATION CHECKLIST These documents are to be completed by the Buyer, unless otherwise indicated. A Transfer of Ownership is a complete sale from the licensed entity to a new entity. If the licensed entity is remaining the same, but the parties within the entity are changing, see instead Change of Ownership forms. Applications will be accepted by appointment only. Call 970‐416‐4206 to schedule an appointment. Applications must be complete in all aspects. Please organize your application documents in the same order as the checklist below and place the checklist on top. Incomplete applications will not be accepted. The City Clerk=s Office will not provide notary services for application documents. MAIN APPLICATION DOCUMENTS License Application for each Center and/or each Medical Marijuana‐infused Products Manufacturing facility being transferred to the Buyer (DR 8530) Local Oath for DR 8530 (Fort Collins Form) Authorization and Consent to Release Information (Business) (City of Ft Collins) Copy of a valid City sales tax license issued to the Buyer Fees (certified funds or money order only, payable to ACity of Fort Collins@) Application and license fees (see Fee Schedule) Annual inspection fee of $700‐ DUE AT TIME OF ISSUANCE OF LICENSE DOCUMENTS RELATING TO INDIVIDUAL PERSONS MMED Associated Person and Associated Key License Application Form (DR 8520e). Associated Key: Any stockholder holding an interest in a marijuana licensee, or any officer or director, who acts as a key executive, employee or agent while physically working in a licensed establishment, Optional Premises or Infused Products Manufacturer location. Associated Person and Associated Key Oath (Fort Collins Form) Authorization and Consent to Release Information (Individual) for each person completing a DR 8520e. (Fort Collins Form) Fingerprints (2 cards) for each person named in application (officers, owners and manager). Fingerprint cards must be submitted with the application documents B not kept by the fingerprinting agency. See fingerprint instructions and important notice. Check payable to AColorado Bureau of Investigations@ for $39.50 per person (business check or money order only; no cash, or temporary or personal checks) Form of identification (must contain a photo) for each person a state‐issued identification card a valid state driver=s license a military identification card a valid passport an alien registration card BUSINESS ENTITY DOCUMENTS For a Corporation: proof of registration with the Colorado Secretary of State, certificate of incorporation, certificate of good standing or certificate of authority (dated within the past two years) For a Partnership: a partnership agreement, or operating shareholder aggreements proof of registration with the Colorado Secretary of State For a Limited Liability Company: proof of registration with the Colorado Secretary of State, articles of incorporation, or certificate of good standing or certificate of authority (dated within the past two years). Including amendments for corporations Articles of Organization, including amendments and operating agreement for LLC For a Limited Liability Partnership: proof of registration with the Colorado Secretary of State, articles of partnership or certificate of good standing or certificate of authority (dated within the past two years) For an Association or Other Entity: copy of agreement(s) creating association or relationship between parties PROPERTY‐RELATED DOCUMENTS Proof of possession of the property (deed or lease) for each location. Leases must be current and valid for at least one (1) year from date of execution of the lease. Option‐to‐lease documents are not acceptable. Because Buyer cannot operate the business until approved by the State and Local Licensing Authorities, lease should be contingent upon approval and not effective until approval. OTHER A Ato scale@ site plan, no larger than 11" x 17", for the parcel on which the business will be located showing the parcel lot lines, location of the building on the site, location of the tenant space within the building (if leasing a portion of the building), and loading zones. Aerial photos and internet graphics are not acceptable. A Ato scale@ diagram of the proposed licensed premises, no larger than 11" x 17", showing building layout, all entryways and exits, loading zones, and all areas in which medical marijuana will be stored, grown, manufactured or dispensed. This should be a new drawing prepared by the Buyer, but if Buyer chooses to submit a drawing prepared by the Seller, it must be signed and dated by the Buyer as being accurate. Zoning Report ‐ To be submitted to the Zoning Department for its review and comment and submitted by the applicant as a part of the application. A comprehensive business operation plan prepared by the Buyer containing: a security plan which complies with the requirements of the Colorado Medical Marijuana Code and all applicable rules and regulations promulgated thereunder. a description of all products to be sold. a plan for exterior signage that is in compliance with all applicable requirement of the City Code and the Land Use Code, including photographs and/or illustrations of proposed signage. Copy of Agreement of Sale and Purchase between the Seller (licensee) and the Buyer (applicant). Affidavit of Consent to Transfer (completed by the Seller). The City of Fort Collins reserves the right to request additional information and documentation throughout the course of the application review.
