The purpose of this agreement is to provide the Bureau of Land Manag~went (BLM) and
Environmental Planning Group, LLC, with the capability to share sensitive repmts, documents,
tables, and Geographic Information Systems (GIS) data.
!I.
OBJECTIVES
A. To provide a vehicle for sharing sensitive repot1s, documents, tables. and GIS dat'L
B. To moperate in the sharing of reports, documents, tables, and GIS data to realize
maximum operating efficiency and cost savings. On request, the BLM will provide
sensitive duta to the Env-ironmental Planning Group, LL..C. Environmental Planning
Group, LLC, will provide the BLM with sensitive data on request as approved hy the
designated official tor Environmental Planning Group, LLC.
C. To avoid duplication of etfot1 in the collection of reports, documents, tables, and
GIS data.
D. To improve the accuracy of the reports. documents, tables, and GIS data.

Infrastructure.

IHcFINITIONS
A. Agreement- data sharing/data exchange agreement.
B. BLM ... the Bureau of Land Management in Oregon/Washington.
C. Data Steward- the person(s) so designated by his/her agency/organization as
having the program subject matter expertise for his/her area or resource of concem.
The Data Steward will: (l) determine the appropriate data standards to be applied.
cniorccd, and developed; (2) verify that the data is accurate and eun·enl and properly
reflects the resource or program arca(s) in terms of authenticity; and (3) determine if
data can/should be shared or exchanged.
D. Digital Data- data in a form that can be processed by a computer.
E. Effective Date- the date of the last signatnre of the BLM Oregon/Washington State
Director or Director of Environmental Planning Group, LLC, on the agreement or
any modification of the at,>rcemcnt.
F. FOIA ·The Freedom of Information Act {FOIA) pcttains to the disclosure of
Fedeml agency records, 5 U.S.C. § 552. The FOlA generally gives the public the
right to inspect and request copies of Govcmment records but has exemptions that

numeric, and "'X''/HY'' coordinate data or other spatial characteristic. lt rdCrs to
geographically referenced features that are described by geographic positions and
attributes in an analog/or computer readable (digital) form.

Environmental Planning Group, LLC, and the BLM agree that:
A. Preparation of their respective reports, documents, tables, and spatial data is the
responsibility of the owner, originator, or maintainer of the information. Spatial data
shared must be documented with the lollowing information contained in the Federal
Geographic Data Committee (FGDC) compliant metadata:

B. If either party receives requests ibr sensitive infor11natllon by the ot11er party or wisht.:s
to disclose the shared in!(lmmtion to a third party, the recipient ofthc request will
contact the dala owner tor permission to disclose the infom1ation tirr each specific
instance. The data owner will make a written decision'"' to whether the inf~rrrnation
may be released and the conditions under which it may be released. The written
decision must specify the date and the sensitive dataset to he released liS well as
whether the in!(mnation is released as a hard copy product viewing or whether the
spatial data itself will be provided to the requestor. Each party to this agreement will
protect and f()llow the \Vrittcn instructions f'Or disclosing the sensitive inJhrmation to
the third party to the extent pem1ittcd by the FOIA and/or PA.
VII.
TERM OJ<' AGREEMENT
This agreement has a tenn of five (5) years from the date of approval by the BLM, at the end of
which, it expires unless earlier terminated or extended. This agreement may be revised as
necessary by mutual consent of the pmties fbllowed by the issuance of a written amendment
signed and dated by the parties. This agreement may he terminated by either party provided 90
day's written advance notice is given. This agreement will be reviewed annually to verify
whether to maintain the agreement in an active data status.

Data Released by the BLM:
The Environmental Planning Group, LLC, shall maintain confidentiality of
information/data that is provided under this agreement by the BLM. The BLM has
dctcnnincd that some of the infonnation, and intormation derived thereof; provided
under this agTcement will be of a sensitive nature and protected by Federal law or
statute.
The Environmental Planning Group, LLC, except as expressly provided in this
agreement or required by Federal law, shall not disclose, by sharing of data or maps.
sensitive infonnation to anyone without the BLM's prior wdtten consenL
Environrnental Planning Clroup, LLC, will not use or permit others to usc sensitive
inH)J·maiion for any purpose other than updating and enhancing the Geographic
Inibrmation System of the Environmental Planning Group, LLC, and fi:Jr internal
planning purposes.
The Environmental Planning Group, LLC, shall take all reasonable measures to
avoid disclosure, dissemination, or unauthorized use of sensitive information
including, at a minhuum, those measures it takes to protect its own sensitive
infonnation of a similar nature and as provided by Federal law.
The Enviromnental Planning Group, LLC, agrees not to transmit or otherwise
divulge this infonnation or to send sensitive inlonnation over the Internet without
appropJiate security protection (e.g., encryption or other method approved ofby the
BLM).

participants.
13. Conflicts between the participants conceming procedures which cannot he n•::solvcd
at the operational level will be referred to the next higher leveL
C. Any specifics related to the identification of any data which require prior approval,
such as drali reports, work phases, etc,, must be defined, Written or verbal approval
will be specified, Time periods within which to respond will also be identified.

F. Order of Precedence. Any inconsistency in this agreement will be resolved by
givinL\ precedence in the l(>llowing order: (I) applicable Federal laws and
regulation; (2) any national policy requirements or standards; (3) special terms and
conditions; (4) all cooperative agreement sections, documents, exhibits, and
attachments.
G. Records Management: The BLM owns the rights to all data/records produced as
part of this agreement All records (in all media, paper and electronic) created or
produced in pm1 or in whole are to be maintained for the duration of the agreement,
made available upon rcXJuest. and. upon tcnn]nation ofthe agreement, will be turned
over to BLM.
