ﻭﺍﻝﺘﻁﻭﻴﺭ ﻝﻠﻭﻗﻑ ﺍﻝﺩﻴﻨﻲ ﻭﻴﻌﺘﺒﺭ ﺍﻝﺼﺭﺍﻉ ﻋﻠﻰ ﺍﻝﻘﺩﺱ ﺼﺭﺍﻋﹰﺎ ﻤﺤﻭﺭﻩ ﺍﻷﻭﻗﺎﻑ ﺍﻹﺴﻼﻤﻴﺔ ﻓﻲ ﻤﻘﺩﻤﺘﻬﺎ ﺍﻝﻤﺴﺠﺩ ﺍﻷﻗﺼﻰ ﻭﻤﺴﺠﺩ ﺴﻴﺩﻨﺎ ﻋﻤﺭ ﺭﻀﻲ ﺍﷲ ﻋﻨﻪ . ﻤﻥ ﻨﺎﺤﻴﺔ ﺍﻝﻔﻘﻬﻴﺔ ﺍﺨﺘﻠﻑ ﺍﻝﻌﻠﻤﺎﺀ ﻓﻲ ﺘﻌﺭﻴﻑ ﺍﻝﻭﻗﻑ ﻭﻝﻜﻥ ﻭﺒﺼﻔﺔ ﻋﺎﻤﺔ ﻴﺘﺴﻊ ﺍﻝﺸﺭﻉ ﻻﺨﺘﻼﻑ ﺍﻝﻌﻠﻤﺎﺀ ﺤﺴﺏ ﻤﻘﺘﻀﻰ ﺃﺤﻜﺎﻡ ﺍﻝﺸﺭﻉ ﻭﻤﻘﺎﺼﺩﻩ . ﻭﺍﺨﺘﻠﻑ ﺍﻝﻌﻠﻤﺎﺀ ﺤﻭل ﺃﻨﻭﺍﻉ ﺍﻝﻭﻗﻑ: 2 ﺃ -ﺍﻝﻭﻗﻑ ﺍﻝﺨﻴﺭﻱ :ﻤﺎ ﺠﻌﻠﺕ ﻓﻴﻪ ﺍﻝﻤﻨﻔﻕ ﻝﺠﻬﺔ ﺃﻭ ﺃﻜﺜﺭ ﻤﻥ ﺠﻬﺎﺕ ﺍﻝﺨﻴﺭ )ﺍﺘﻔﺎﻕ ﺠﻤﻬﻭﺭ ﺍﻝﻌﻠﻤﺎﺀ(. ﺏ -ﺍﻝﻭﻗﻑ ﺍﻷﻫﻠﻲ :ﻤﺎ ﺠﻌﻠﺕ ﻓﻴﻪ ﺍﻝﻤﻨﻔﻕ ﻝﻸﻓﺭﺍﺩ )ﺍﺨﺘﻼﻑ ﺒﻴﻥ ﺍﻝﻌﻠﻤﺎﺀ ﻭﻴﻨﻅﺭ ﻝﻜل ﺤﺎﻝﺔ ﻋﻠﻰ ﺤﺩﺓ(. ﺝ -ﺍﻝﻭﻗﻑ ﺍﻝﻤﺸﺘﺭﻙ :ﻤﺎ ﻴﺠﻤﻊ ﺒﻴﻥ ﺍﻝﻭﻗﻑ ﺍﻝﺨﻴﺭﻱ ﻭﺍﻷﻫﻠﻲ . -1ﺤﻜﻡ ﺍﻝﻭﻗﻑ : ﻴﺭﻯ ﺠﻤﻬﻭﺭ ﺍﻝﻔﻘﻬﺎﺀ ﺃﻨﻪ ﻤﺴﺘﺤﺒﹰﺎ ﻭﻋﻠﻰ ﺤﻴﻥ ﺃﻥ ﺍﻝﺯﻜﺎﺓ ﻤﺎل ﺍﷲ ﻻ ﻴﻤﻜﻥ ﻝﺩﺍﻓﻌﻬﺎ ﺃﻥ ﻴﺴﺘﺭﺩﻫﺎ ﻓﺈﻥ ﺍﻝﻭﻗﻑ ﻜﻤﺎ ﻴﺭﻯ ﺍﻝﺠﻤﻬﻭﺭ ﻻ ﻴﺠﻭﺯ ﺍﻝﺭﺠﻭﻉ ﻓﻴﻪ ﺇﻻ ﺃﺒﻭ ﺤﻨﻴﻔﺔ ﻓﺄﺠﺎﺯﻩ ﺫﻝﻙ ﻤﺎ ﻋﺩﺍ ﺃﻥ ﻜﺎﻥ ﺍﻝﻭﻗﻑ ﻤﺴﺠﺩﹰﺍ ﻭﺫﻝﻙ ﻓﻲ ﺤﺎﻝﺔ ﻅﺭﻭﻑ ﻗﺎﻫﺭﺓ ﻤﺜل ﺍﻝﻜﺎﺭﺜﺔ ﺃﻭ ﺍﻝﺩﻴﻥ . -2ﺃﺭﻜﺎﻥ ﺍﻝﻭﻗﻑ : ﻴﺘﺤﺩﺙ ﺍﻝﺸﺎﺭﻉ ﻋﻥ ﺃﺭﺒﻌﺔ ﺃﺭﻜﺎﻥ :ﺍﻝﺼﻴﻐﺔ ﻭﺍﻝﻭﺍﻗﻑ ﻭﺍﻝﻤﻭﻗﻭﻑ ﻋﻠﻴﻪ ﻭﺍﻝﻤﻭﻗﻭﻑ . * ﺍﻝﺼﻴﻐﺔ :ﻭﻫﻲ ﺍﻝﻠﻔﻅ ﺍﻝﺩﺍل ﻋﻠﻰ ﺇﺭﺍﺩﺓ ﺍﻝﻭﻗﻑ ﻭﻴﻨﻘﺴﻡ ﺇﻝﻰ ﻗﺴﻤﻴﻥ ﺼﺭﻴﺢ ﻭﻜﻨﺎﻴﺔ.ﻭﺫﻫﺏ ﺠﻤﻬﻭﺭ ﺍﻝﻔﻘﻬﺎﺀ ﺇﻝﻰ ﺃﻥ ﺍﻝﻭﻗﻑ ﻜﻤﺎ ﻴﻨﻌﻘﺩ ﺒﺎﻝﻠﻔﻅ ﻴﻨﻌﻘﺩ ﺒﺎﻝﻔﻌل )ﻜﺄﻥ ﻴﺒﻨﻰ ﻤﺴﺠﺩﹰﺍ(. ﻼ ﺒﺎﻝﻐﹰﺎ ،ﻏﻴﺭ ﻤﺤﺠﻭﺭ ﻋﻠﻴﻪ ،ﻤﺨﺘﺎﺭﹰﺍ ﻏﻴﺭ ﻤﻜﺭﻩ ﻭﻤﺎﻝﻜﹰﺎ ﻝﻠﻌﻴﻥ ﺍﻝﻤﺘﺒﺭﻉ ﺒﻪ . ﻼ ﻝﻠﺘﺒﺭﻉ )ﻋﺎﻗ ﹰ * ﺍﻝﻭﺍﻗﻑ :ﻴﺸﺘﺭﻁ ﺃﻥ ﻴﻜﻭﻥ ﺃﻫ ﹰ * ﺍﻝﻤﻭﻗﻭﻑ ﻋﻠﻴﻪ :ﻫﻲ ﺍﻝﺠﻬﺔ ﺍﻝﺘﻲ ﺘﻨﺘﻔﻊ ﺒﺭﻴﻊ ﺍﻝﻭﻗﻑ . ﻼ( . ﻻ ﻤﻌﻠﻭﻤﹰﺎ ﻤﻠﻜﹰﺎ ﻝﻠﻭﺍﻗﻑ ﻭﻴﺸﺘﺭﻁ ﺩﻭﺍﻡ ﺍﻻﻨﺘﻔﺎﻉ ﺍﻝﻌﻤل ﺍﻝﻭﻗﻔﻲ ﻭﺘﻔﻌﻴل ﺩﻭﺭﻩ ﺍﻻﻗﺘﺼﺎﺩﻱ ،ﻓﺈﻨﻪ ﻴﺘﻌﻴﻥ ﻋﻠﻴﻨﺎ ﺍﻹﺤﺎﻁﺔ ﺒﺸﺭﻭﻁ ﺘﺤﻘﻴﻕ ﺍﻝﻨﻤﺎﺀ ﺍﻻﻗﺘﺼﺎﺩﻱ ﻜﻤﺎ ﺤﺩﺩﻫﺎ ﺍﻻﻗﺘﺼﺎﺩﻴﻭﻥ ،ﻭﺍﻝﺘﻲ ﻋﻠﻰ ﻀﻭﺀﻫﺎ ﻴﺴﺘﺭﺸﺩ ﺍﻝﻭﺍﻗﻔﻭﻥ ﻓﻲ ﻭﻀﻊ ﺸﺭﻭﻁﻬﻡ ﺒﻤﺎ ﻴﺘﻔﻕ ﻭﺃﻫﺩﺍﻑ ﺍﻝﺘﻨﻤﻴﺔ ﺍﻝﻤﻨﺸﻭﺩﺓ ﺍﻤﺘﺜﺎﻻ ﻝﻠﻘﻭل ﺒﺎﻷﻤﻭﺍل ﺍﻝﺘﻲ ﻴﻤﻜﻥ ﺍﻻﻨﺘﻔﺎﻉ ﺒﻬﺎ ﻤﻊ ﺒﻘﺎﺀ ﺃﺼﻠﻬﺎ ،ﻭﻝﺫﻝﻙ ﻓﺎﻷﺸﻴﺎﺀ ﺍﻝﺘﻲ ﻻ ﻴﻤﻜﻥ ﺍﻻﻨﺘﻔﺎﻉ ﺒﻬﺎ ﺇ ﹼ ﻴﺠﻭﺯ ﻭﻗﻔﻬﺎ. ﻋﻠﻰ ﻀﻭﺀ ﺫﻝﻙ ﻓﺈﻥ ﺍﻝﻭﻗﻑ ﻓﻲ ﺤﻘﻴﻘﺘﻪ ﺍﺴﺘﺜﻤﺎﺭ ،ﺤﻴﺙ ﺇﻥ ﺼﺎﺤﺒﻪ ﻴﺭﻴﺩ ﺃﻥ ﻴﻘﻑ ﻤﺎﻝﻪ ﻓﻲ ﺴﺒﻴل ﺃﻥ ﻴﺤﺼﺩ ﻨﺘﺎﺠﻪ ﻴﻭﻡ ﺍﻝﻘﻴﺎﻤﺔ ،ﻭﻤﻥ ﺤﻴﺙ ﺍﻝﺤﻔﺎﻅ ﻋﻠﻰ ﺍﻷﺼل ،ﻭﻴﻜﻭﻥ ﺍﻻﺴﺘﻬﻼﻙ ﻝﻠﻨﺎﺘﺞ ﻭﺍﻝﺜﻤﺭﺓ ﻭﺍﻝﺭﺒﺢ ﻭﺍﻝﺭﻴﻊ ،ﻓﺎﻷﻋﻴﺎﻥ ﺍﻝﻤﻭﻗﻭﻓﺔ ﺇﻤﺎ ﺃﻥ ﺘﻨـﺘﺞ ﻤﻨﻬﺎ ﺍﻝﺜﻤﺎﺭ ﻜﻤﺎ ﻫﻭ ﺍﻝﺤﺎل ﻓﻲ ﻭﻗﻑ ﺍﻷﺸﺠﺎﺭ ﻭﺍﻝﺒﺴﺎﺘﻴﻥ ﺍﻝﻤﺜﻤﺭﺓ ،ﺃﻭ ﺘﻨـﺘﺞ ﻤﻨﻬﺎ ﻤﻨﻔﻌﺔ ﻭﺃﺠﺭﺓ ﻜﻤﺎ ﻫﻭ ﺍﻝﺤﺎل ﺒﺎﻝﻨﺴﺒﺔ ﻝﻸﻋﻴﺎﻥ ﺍﻝﻤﺴﺘﺄﺠﺭﺓ ،ﺃﻭ ﻴﻨـﺘﺞ ﻤﻨﻬﺎ ﺭﺒﺢ ﻭﺭﻴﻊ ﻜﻤﺎ ﻫﻭ ﺍﻝﺤﺎل ﺒﺎﻝﻨﺴﺒﺔ ﻝﻭﻗﻑ ﺍﻝﻨﻘﻭﺩ. ﻼ ﻤﻨﻬﻤﺎ ﻴﺭﺍﺩ ﻻﺴﺘﺒﻘﺎﺀ ﻭﻗﺩ ﺠﺎﺀ ﻓﻲ "ﻓﺘﺢ ﺍﻝﻘﺩﻴﺭ" ﻋﻨﺩ ﺘﻌﻠﻴﻘﻪ ﻋﻠﻰ ﻭﺭﻭﺩ ﻜﺘﺎﺏ ﺍﻝﻭﻗﻑ ﺒﻌﺩ ﺍﻝﺸﺭﻜﺔ" :ﻤﻨﺎﺴﺒﺘﻪ ﺒﺎﻝﺸﺭﻜﺔ ﺃﻥ ﻜ ﹰ ﺍﻷﺼل ﻤﻊ ﺍﻻﻨﺘﻔﺎﻉ ﺒﺎﻝﺯﻴﺎﺩﺓ ﻋﻠﻴﻪ". * ﺍﺴﺘﺜﻤﺎﺭ ﻤﻭﺍﺭﺩ ﺍﻝﻭﻗﻑ : ﻻ ﺸﻙ ﻓﻲ ﺃﻥ ﺍﺴﺘﺜﻤﺎﺭ ﺃﻤﻭﺍل ﺍﻝﻭﻗﻑ ﻴﺅﺩﻱ ﻝﻠﺤﻔﺎﻅ ﻋﻠﻴﻬﺎ ﺤﺘﻰ ﻻ ﺘﺄﻜﻠﻬﺎ ﺍﻝﻨﻔﻘﺎﺕ ﻭﺍﻝﻤﺼﺎﺭﻴﻑ ،ﻭﻴﺴﺎﻫﻡ ﻓﻲ ﺘﺤﻘﻴﻕ ﺃﻫﺩﺍﻑ ﺍﻝﻭﻗﻑ ﺍﻻﺠﺘﻤﺎﻋﻴﺔ ﻭﺍﻻﻗﺘﺼﺎﺩﻴﺔ ﻭﺍﻝﺘﻌﻠﻴﻤﻴﺔ ،ﻭﺍﻝﺘﻨﻤﻭﻴﺔ ،ﻓﻤﺎ ﺃﻜﺜﺭ ﻤﺼﺎﺌﺏ ﻫﺫﻩ ﺍﻷﻤﺔ ﻓﻲ ﻫﺫﺍ ﺍﻝﻌﺼﺭ ،ﻭﻤﺎ ﺃﻜﺜﺭ ﺤﺎﺠﻴﺎﺘﻬﺎ ﺇﻝﻰ ﺍﻷﻤﻭﺍل ﻝﺘﺤﺴﻴﻥ ﺃﺤﻭﺍﻝﻬﺎ ﺍﻻﺠﺘﻤﺎﻋﻴﺔ ﺍﻝﻤﺘﺨﻠﻔﺔ ﻤﻥ ﺨﻼل ﺍﺴﺘﺜﻤﺎﺭ ﺍﻷﻤﻭﺍل ﻋﻥ ﻁﺭﻴﻕ ﺍﻝﺘﺴﻭﻴﻕ ﻭﺍﻝﺘﺼﻨﻴﻊ ﻭﺍﻹﻨﺘﺎﺝ. ﻻ ﻤﻥ ﺨﻼل ﺍﻻﺴﺘﺜﻤﺎﺭﺍﺕ ﺇﻀﺎﻓﺔ ﺇﻝﻰ ﺫﻝﻙ ﻓﺈﻥ ﺍﻝﻭﻗﻑ ﺍﻝﺫﻱ ﻴﺭﺍﺩ ﻝﻪ ﺍﻻﺴﺘﻤﺭﺍﺭ ،ﻭﻤﻥ ﻤﻘﺎﺼﺩﻩ ﺍﻝﺘﺄﺒﻴﺩ ،ﻻ ﻴﻤﻜﻥ ﺃﻥ ﻴﺘﺤﻘﻕ ﺫﻝﻙ ﺇ ﹼ ﻻ ﻓﺎﻝﻤﺼﺎﺭﻴﻑ ﻭﺍﻝﻨﻔﻘﺎﺕ ﻭﺍﻝﺼﻴﺎﻨﺔ ﻗﺩ ﺘﻘﻀﻲ ﻋﻠﻰ ﺃﺼل ﺍﻝﻭﻗﻑ ﺇﻥ ﻝﻡ ﺘﻌﺎﻝﺞ ﻋﻥ ﻁﺭﻴﻕ ﺍﻻﺴﺘﺜﻤﺎﺭ ﺍﻝﻤﺠﺩﻱ ﺍﻝﻨﺎﻓﻊ. ﺍﻝﻨﺎﺠﺤﺔ ،ﻭﺇ ﹼ ﻝﺫﻝﻙ ﻴﻨﺒﻐﻲ ﺃﻥ ﺘﻬﺘﻡ ﺇﺩﺍﺭﺓ ﺍﻝﻭﻗﻑ )ﺃﻭ ﺍﻝﻨﺎﻅﺭ( ﺒﻬﺫﺍ ﺍﻝﺠﺎﻨﺏ ﺍﻫﺘﻤﺎﻤﺎ ﻜﺒﻴﺭﺍ ﻭﺘﺨﺼﺹ ﺠﺯﺀﺍ ﺠﻴﺩﺍ ﻤﻥ ﺭﻴﻊ ﺍﻝﻭﻗﻑ ﻝﻼﺴﺘﺜﻤﺎﺭ ﺇﻀﺎﻓﺔ ﺇﻝﻰ ﺍﺴﺘﺜﻤﺎﺭ ﺒﻘﻴﺔ ﺃﻤﻭﺍﻝﻬﺎ ﺍﻝﺴﺎﺌﻠﺔ. * ﺍﻝﺸﺭﻭﻁ ﺍﻝﻌﺎﻤﺔ ﻻﺴﺘﺜﻤﺎﺭ ﺃﻤﻭﺍل ﺍﻝﻭﻗﻑ: ﺒﻤﺎ ﺃﻥ ﺍﻻﺴﺘﺜﻤﺎﺭ ﻤﻥ ﻁﺒﻴﻌﺘﻪ ﺍﻝﺭﺒﺢ ﻭﺍﻝﺨﺴﺎﺭﺓ ،ﻭﺃﻥ ﻤﻌﻅﻡ ﺍﻻﺴﺘﺜﻤﺎﺭﺍﺕ ﺍﻝﺘﻲ ﺘﻘﻭﻡ ﺒﻬﺎ ﺍﻝﺩﻭﻝﺔ ،ﺃﻭ ﺍﻝﻤﺅﺴﺴﺎﺕ ﺍﻝﺤﻜﻭﻤﻴﺔ ﺇﻥ ﻝﻡ ﺘﻜﻥ ﻓﺎﺸﻠﺔ ﻓﻠﻴﺴﺕ ﻋﻠﻰ ﺍﻝﻤﺴﺘﻭﻯ ﺍﻝﻤﻁﻠﻭﺏ ،ﻭﻻ ﻋﻠﻰ ﻤﺴﺘﻭﻯ ﺍﻻﺴﺘﺜﻤﺎﺭﺍﺕ ﺍﻝﺨﺎﺼﺔ ،ﻭﺒﻤﺎ ﺃﻥ ﺃﻤﻭﺍل ﺍﻝﻭﻗﻑ ﺃﻤﻭﺍل ﺨﻴﺭﻴﺔ ﻋﺎﻤﺔ ﻝﻬﺎ ﺨﺼﻭﺼﻴﺔ ﺭﺃﻴﻨﺎﻫﺎ ﻤﻌﺘﺒﺭﺓ ﻝﺩﻯ ﻓﻘﻬﺎﺌﻨﺎ ﺍﻝﻜﺭﺍﻡ ﺤﻴﺙ ﻝﻡ ﻴﺠﻴﺯﻭﺍ ﺍﻝﺘﺼﺭﻑ ﻓﻴﻬﺎ ﺒﺎﻝﻐﺒﻥ ،ﻭﺒﺄﻗل ﻤﻥ ﺃﺠﺭ ﺍﻝﻤﺜل ..ﻝﺫﻝﻙ ﻜﻠﻪ ﻴﺸﺘﺭﻁ ﻓﻲ ﺍﺴﺘﺜﻤﺎﺭ ﺃﻤﻭﺍل ﺍﻝﻭﻗﻑ ﻤﺎ ﻴﺄﺘﻲ: 6 .1ﺍﻷﺨﺫ ﺒﺎﻝﺤﺫﺭ ﻭﺍﻷﺤﻭﻁ ،ﻭﺍﻝﺒﺤﺙ ﻋﻥ ﻜل ﺍﻝﻀﻤﺎﻨﺎﺕ ﺍﻝﺸﺭﻋﻴﺔ ﺍﻝﻤﺘﺎﺤﺔ ،ﻭﻗﺩ ﺫﻜﺭﻨﺎ ﺃﻥ ﻤﺠﻤﻊ ﺍﻝﻔﻘﻪ ﺍﻝﺩﻭﻝﻲ ﺃﺠﺎﺯ ﻀﻤﺎﻥ ﺍﻝﻁﺭﻑ ﺍﻝﺜﺎﻝﺙ ﻝﺴﻨﺩﺍﺕ ﺍﻻﺴﺘﺜﻤﺎﺭ ،ﻭﻤﻥ ﻫﻨﺎ ﻓﻌﻠﻰ ﺇﺩﺍﺭﺓ ﺍﻝﻭﻗﻑ )ﺃﻭ ﺍﻝﻨﺎﻅﺭ( ﺍﻝﺒﺤﺙ ﻋﻥ ﻤﺜل ﻫﺫﺍ ﺍﻝﻀﻤﺎﻥ ﺒﻘﺩﺭ ﺍﻹﻤﻜﺎﻥ ،ﻭﺇﻥ ﻝﻡ ﺘﺠﺩ ﻓﻌﻠﻴﻬﺎ ﻤﻔﺎﺘﺤﺔ ﺍﻝﺤﻜﻭﻤﺔ ﺒﺫﻝﻙ. .2ﺍﻻﻋﺘﻤﺎﺩ ﻋﻠﻰ ﺍﻝﻁﺭﻕ ﺍﻝﻔﻨﻴﺔ ﻭﺍﻝﻭﺴﺎﺌل ﺍﻝﺤﺩﻴﺜﺔ ﻭﺩﺭﺍﺴﺎﺕ ﺍﻝﺠﺩﻭﻯ ،ﻭﺭﻋﺎﻴﺔ ﺃﻫل ﺍﻹﺨﻼﺹ ﻭﺍﻻﺨﺘﺼﺎﺹ ﻭﺍﻝﺨﺒﺭﺓ ﻓﻲ ﻤﻥ ﻴﻌﻬﺩ ﺇﻝﻴﻬﻡ ﺍﻻﺴﺘﺜﻤﺎﺭ. .3ﺍﻝﺘﺨﻁﻴﻁ ﻭﺍﻝﻤﺘﺎﺒﻌﺔ ﻭﺍﻝﺭﻗﺎﺒﺔ ﺍﻝﺩﺍﺨﻠﻴﺔ ﻋﻠﻰ ﺍﻻﺴﺘﺜﻤﺎﺭﺍﺕ. 4.ﻭﻤﺭﺍﻋﺎﺓ ﻓﻘﻪ ﺍﻷﻭﻝﻭﻴﺎﺕ ﻭﻓﻘﻪ ﻤﺭﺍﺘﺏ ﺍﻝﻤﺨﺎﻁﺭ ﻓﻲ ﺍﻻﺴﺘﺜﻤﺎﺭﺍﺕ ،ﻭﻓﻘﻪ ﺍﻝﺘﻌﺎﻤل ﻤﻊ ﺍﻝﺒﻨﻭﻙ ﻭﺍﻝﺸﺭﻜﺎﺕ ﺍﻻﺴﺘﺜﻤﺎﺭﻴﺔ، ﻻ ﻤﻊ ﺍﻝﺒﻨﻭﻙ ﺍﻹﺴﻼﻤﻴﺔ ﻭﺍﻝﺸﺭﻜﺎﺕ ﺍﻝﻼﺘﻲ ﻴﺘﻭﺍﻓﺭ ﻓﻴﻬﺎ ﺍﻷﻤﻥ ﻭﺍﻷﻤﺎﻥ ﻭﺍﻝﻀﻤﺎﻥ ﺒﻘﺩﺭ ﺍﻹﻤﻜﺎﻥ. ﺒﺤﻴﺙ ﻻ ﺘﺘﻌﺎﻤل ﺇﺩﺍﺭﺓ ﺍﻝﻭﻗﻑ ﺇ ﹼ ﻭﻤﻥ ﻫﺫﺍ ﺍﻝﻤﻨﻁﻠﻕ ﻋﻠﻴﻬﺎ ﺃﻥ ﺘﺘﺠﻪ ﺇﻝﻰ ﺍﻻﺴﺘﺜﻤﺎﺭﺍﺕ ﺍﻝﺘﻲ ﻻ ﺘـﺯﺍل ﺃﻜﺜﺭ ﺃﻤﺎﻨﹰﺎ ﻭﺃﻗل ﺨﻁﺭﹰﺍ ﻭﻫﻲ ﺍﻻﺴﺘﺜﻤﺎﺭﺍﺕ ﺍﻝﻌﻘﺎﺭﻴﺔ . * ﺍﻝﻀﻭﺍﺒﻁ ﺍﻝﺸﺭﻋﻴﺔ ﺍﻝﻌﺎﻤﺔ ﻻﺴﺘﺜﻤﺎﺭ ﺃﻤﻭﺍل ﺍﻝﻭﻗﻑ: ﻴﺤﻜﻡ ﺍﺴﺘﺜﻤﺎﺭ ﺍﻷﻤﻭﺍل ﺍﻝﻭﻗﻔﻴﺔ ﻤﺠﻤﻭﻋﺔ ﻤﻥ ﺍﻝﻀﻭﺍﺒﻁ ﺍﻝﻌﺎﻤﺔ ﺍﻝﻤﺴﺘﻨﺒﻁﺔ ﻤﻥ ﻤﺼﺎﺩﺭ ﺍﻝﺸﺭﻴﻌﺔ ﺍﻹﺴﻼﻤﻴﺔ ،ﻭﺍﻝﺘﻲ ﺘﺘﻠﺨﺹ ﻓﻲ ﺍﻵﺘﻲ: 7 –1ﺃﺴﺎﺱ ﺍﻝﻤﺸﺭﻭﻋﻴﺔ :ﻭﻴﻘﺼﺩ ﺃﻥ ﺘﻜﻭﻥ ﻋﻤﻠﻴﺎﺕ ﺍﺴﺘﺜﻤﺎﺭ ﺃﻤﻭﺍل ﺍﻝﻭﻗﻑ ﻤﻁﺎﺒﻘﺔ ﻷﺤﻜﺎﻡ ﻭﻤﺒﺎﺩﺉ ﺍﻝﺸﺭﻴﻌﺔ ﺍﻹﺴﻼﻤﻴﺔ ﻭﺍﻝﺘﻲ ﺘﻌﺘﺒﺭ ﺍﻝﻤﺭﺠﻌﻴﺔ ﺍﻷﻭﻝﻰ ﻓﻲ ﻫﺫﺍ ﺍﻝﻨﺸﺎﻁ ،ﺤﻴﺙ ﺜﻡ ﺍﻷﻗﺭﺏ ﻓﺎﻷﻗﺭﺏ ﻭﻻ ﻴﺠﻭﺯ ﺘﻭﺠﻴﻬﻬﺎ ﺇﻝﻰ ﺍﻝﺩﻭل ﺍﻷﺠﻨﺒﻴﺔ ﻭﺍﻝﻭﻁﻥ ﺍﻹﺴﻼﻤﻲ ﻓﻲ ﺤﺎﺠﺔ ﺇﻝﻴﻬﺎ. – 5ﺃﺴﺎﺱ ﺘﺤﻘﻴﻕ ﺍﻝﻨﻔﻊ ﺍﻷﻜﺒﺭ ﻝﻠﺠﻬﺎﺕ ﺍﻝﻤﻭﻗﻭﻑ ﻋﻠﻴﻬﻡ ﻭﻻ ﺴﻴﻤﺎ ﺍﻝﻁﺒﻘﺎﺕ ﺍﻝﻔﻘﻴﺭﺓ ﻤﻨﻬﻡ :ﻭﻴﻘﺼﺩ ﺒﻪ ﺃﻥ ﻴﻭﺠﻪ ﺠﺯﺀ ﻤﻥ ﺍﻻﺴﺘﺜﻤﺎﺭﺍﺕ ﻨﺤﻭ ﺍﻝﻤﺸﺭﻭﻋﺎﺕ ﺍﻝﺘﻲ ﺘﺤﻘﻕ ﻨﻔﻌﹰﺎ ﻝﻠﻁﺒﻘﺔ ﺍﻝﻔﻘﻴﺭﺓ ،ﻭﺇﻴﺠﺎﺩ ﻓﺭﺹ ﻋﻤل ﻷﺒﻨﺎﺌﻬﺎ ﺒﻤﺎ ﻴﺤﻘﻕ ﺍﻝﺘﻨﻤﻴﺔ ﺍﻻﺠﺘﻤﺎﻋﻴﺔ ،ﻷﻥ ﺫﻝﻙ ﻤﻥ ﻤﻘﺎﺼﺩ ﺍﻝﻭﻗﻑ ﺍﻝﺨﻴﺭﻴﺔ ﻭﺍﻻﺠﺘﻤﺎﻋﻴﺔ. – 6ﺃﺴﺎﺱ ﺘﺤﻘﻴﻕ ﺍﻝﻌﺎﺌﺩ ﺍﻻﻗﺘﺼﺎﺩﻱ ﺍﻝﻤﺭﻀﻲ ﻝﻴﻨﻔﻕ ﻤﻨﻪ ﻋﻠﻰ ﺍﻝﺠﻬﺎﺕ ﺍﻝﻤﻭﻗﻭﻑ ﻋﻠﻴﻬﺎ :ﻭﻴﻘﺼﺩ ﺒﺫﻝﻙ ﺍﺘﺨﺎﺫ ﺍﻝﻭﺴﺎﺌل ﺍﻝﻤﻤﻜﻨﺔ ﻝﺘﺤﻘﻴﻕ ﻋﺎﺌﺩ ﻤﺠﺯ ﻤﻨﺎﺴﺏ ﻴﻤﻜﻥ ﺍﻹﻨﻔﺎﻕ ﻤﻨﻪ ﻋﻠﻰ ﺍﻝﺠﻬﺎﺕ ﺍﻝﻤﻭﻗﻭﻑ ﻋﻠﻴﻬﺎ ﺃﻭ ﺘﻌﻤﻴﺭ ﻭﺼﻴﺎﻨﺔ ﺍﻷﺼﻭل ﺍﻝﻭﻗﻔﻴﺔ ،ﻓﺎﻝﺘﻭﺍﺯﻥ ﺒﻴﻥ ﺍﻝﺘﻨﻤﻴﺔ ﺍﻻﺠﺘﻤﺎﻋﻴﺔ ﻭﺍﻝﺘﻨﻤﻴﺔ ﺍﻻﻗﺘﺼﺎﺩﻴﺔ ﻀﺭﻭﺭﺓ ﺸﺭﻋﻴﺔ ﻓﻲ ﺍﻝﻤﺅﺴﺴﺎﺕ ﺍﻝﻭﻗﻔﻴﺔ. – 7ﺃﺴﺎﺱ ﺍﻝﻤﺤﺎﻓﻅﺔ ﻋﻠﻰ ﺍﻷﻤﻭﺍل ﻭﺘﻨﻤﻴﺘﻬﺎ :ﻴﻘﺼﺩ ﺒﻪ ﻋﺩﻡ ﺘﻌﺭﻴﺽ ﺍﻷﻤﻭﺍل ﺍﻝﻭﻗﻔﻴﺔ ﻝﺩﺭﺠﺔ ﻋﺎﻝﻴﺔ ﻤﻥ ﺍﻝﻤﺨﺎﻁﺭ ﻭﺍﻝﺤﺼﻭل ﻋﻠﻰ ﺍﻝﻀﻤﺎﻨﺎﺕ ﺍﻝﻼﺯﻤﺔ ﺍﻝﻤﺸﺭﻭﻋﺔ ﻝﻠﺘﻘﻠﻴل ﻤﻥ ﺘﻠﻙ ﺍﻝﻤﺨﺎﻁﺭ ،ﻭﺇﺠﺭﺍﺀ ﺍﻝﺘﻭﺍﺯﻥ ﺒﻴﻥ ﺍﻝﻌﻭﺍﺌﺩ ﻭﺍﻷﻤﺎﻜﻥ ،ﻜﻤﺎ ﻴﺠﺏ ﺘﺠﻨﺏ ﺍﻜﺘﻨﺎﺯ ﺍﻷﻤﻭﺍل ﻷﻥ ﺫﻝﻙ ﻤﺨﺎﻝﻑ ﻷﺤﻜﺎﻡ ﻭﻤﺒﺎﺩﺉ ﺍﻝﺸﺭﻴﻌﺔ ﺍﻹﺴﻼﻤﻴﺔ. – 8ﺃﺴﺎﺱ ﺍﻝﺘﻭﺍﺯﻥ :ﻭﻴﻘﺼﺩ ﺒﺫﻝﻙ ﺘﺤﻘﻴﻕ ﺍﻝﺘﻭﺍﺯﻥ ﻤﻥ ﺤﻴﺙ ﺍﻵﺠﺎل ﻭﺍﻝﺼﻴﻎ ﻭﺍﻷﻨﺸﻁﺔ ﻭﺍﻝﻤﺠﺎﻻﺕ ﻝﺘﻘﻠﻴل ﺍﻝﻤﺨﺎﻁﺭ ﻭﺯﻴﺎﺩﺓ ﺍﻝﻌﻭﺍﺌﺩ ،ﻓﻼ ﻴﺠﻭﺯ ﺍﻝﺘﺭﻜﻴﺯ ﻋﻠﻰ ﻤﻨﻁﻘﺔ ﺃﻭ ﻤﺩﻴﻨﺔ ﻭﺤﺭﻤﺎﻥ ﺃﺨﺭﻯ ،ﺃﻭ ﺍﻝﺘﺭﻜﻴﺯ ﻋﻠﻰ ﺍﻻﺴﺘﺜﻤﺎﺭﺍﺕ ﺍﻝﻘﺼﻴﺭﺓ ﺍﻷﺠل ﻭﺇﻫﻤﺎل ﺍﻝﻤﺘﻭﺴﻁﺔ ﻭﺍﻝﻁﻭﻴﻠﺔ ،ﺃﻭ ﺍﻝﺘﺭﻜﻴﺯ ﻋﻠﻰ ﺼﻴﻐﺔ ﺘﻤﻭﻴﻠﻴﺔ ﺩﻭﻥ ﺍﻝﺼﻴﻎ ﺍﻷﺨﺭﻯ ،ﻭﻴﺤﻘﻕ ﺍﻝﺘﻭﺍﺯﻥ ﻭﺍﻝﺘﻨﻭﻉ ﻝﻠﻤﺅﺴﺴﺎﺕ ﺍﻝﻭﻗﻔﻴﺔ ﺘﻘﻠﻴل ﺍﻝﻤﺨﺎﻁﺭ ﻭﻫﻭ ﺃﻤﺭ ﻤﻁﻠﻭﺏ ﻓﻲ ﻫﺫﺍ ﺍﻝﻤﺠﺎل. – 9ﺘﺠﻨﺏ ﺍﻻﺴﺘﺜﻤﺎﺭ ﻓﻲ ﺩﻭل ﻤﻌﺎﺩﻴﺔ ﻭﻤﺤﺎﺭﺒﺔ ﻝﻺﺴﻼﻡ ﻭﺍﻝﻤﺴﻠﻤﻴﻥ :ﻭﺩﻝﻴل ﺫﻝﻙ ﻤﻥ ﺍﻝﻘﺭﺁﻥ ﺍﻝﻜﺭﻴﻡ ﻗﻭل ﺍﷲ ﺘﺒﺎﺭﻙ ﻭﺘﻌﺎﻝﻰ: ﻙ ﺠ ﹸﻜﻡ ﺃَﻥ ﹶﺘ ﻭﱠﻝﻭ ﻫﻡ ﻭﻤﻥ ﻴ ﹶﺘ ﻭﱠﻝ ﻬﻡ ﹶﻓُﺄﻭﹶﻝ ِﺌ ﻋﻠﹶﻰ ِﺇﺨﹾﺭﺍ ﹺ ﻥ ﻭَﺃﺨﹾ ﺭﺠﻭﻜﹸﻡ ﻤﻥ ﺩﻴﺎ ﹺﺭ ﹸﻜﻡ ﻭﻅﹶﺎ ﻫﺭﻭﺍ ﻥ ﻗﹶﺎ ﹶﺘﻠﹸﻭ ﹸﻜﻡ ﻓﻲ ﺍﻝﺩﻴ ﹺ ﻥ ﺍﱠﻝﺫﻴ ﻋﹺ }ِﺇ ﱠﻨﻤﺎ ﻴﻨﹾﻬﺎ ﹸﻜ ﻡ ﺍﻝﱠﻠ ﻪ ﻥ{ ]ﺍﻝﻤﻤﺘﺤﻨﺔ [9:ﻭﻫﺫﺍ ﺍﻝﺤﻜﻡ ﻴﻨﻁﺒﻕ ﻋﻠﻰ ﺍﻝﺼﻬﺎﻴﻨﺔ ﻭﺃﻤﺭﻴﻜﺎ ،..ﻭﻝﻘﺩ ﺤﺽ ﺍﻝﺭﺴﻭل ﺍﻝﻤﺅﻤﻨﻴﻥ ﺒﺎﻝﺘﻌﺎﻤل ﻤﻊ ﺒﻌﻀﻬﻡ ﻫ ﻡ ﺍﻝﻅﱠﺎِﻝﻤﻭ ﺍﻝﺒﻌﺽ ،ﻓﻘﺩ ﻗﺎل" :ﺍﻝﻤﺅﻤﻥ ﻝﻠﻤﺅﻤﻥ ﻜﺎﻝﺒﻨﻴﺎﻥ ﻴﺸﺩ ﺒﻌﻀﻪ ﺒﻌﻀﹰﺎ" )ﺭﻭﺍﻩ ﺍﻝﺒﺨﺎﺭﻱ ﻭﻤﺴﻠﻡ( ،ﻭﻗﻭﻝﻪ" :ﻻ ﺘﺼﺎﺤﺏ ﺇﻻ ﻤﺴﻠﻤ ﹰﺎ ﻭﻻ ﻴﺄﻜل ﻁﻌﺎﻤﻙ ﺇﻻ ﺘﻘﻲ" )ﺭﻭﺍﻩ ﺃﺒﻭ ﺩﺍﻭﺩ ﻭﺍﻝﺘﺭﻤﺫﻱ(. ﻭﺘﺄﺴﻴﺴﹰﺎ ﻋﻠﻰ ﺫﻝﻙ ﻴﺠﺏ ﻋﻠﻰ ﺍﻝﻘﺎﺌﻤﻴﻥ ﻋﻠﻰ ﺍﺴﺘﺜﻤﺎﺭ ﺃﻤﻭﺍل ﺍﻝﻭﻗﻑ ﻋﺩﻡ ﺍﺴﺘﺜﻤﺎﺭﻫﺎ ﻓﻲ ﺍﻝﺩﻭل ﺍﻝﻤﻌﺎﺩﻴﺔ ﻭﺃﻥ ﺘﻜﻭﻥ ﺃﻭﻝﻭﻴﺔ ﺍﻻﺴﺘﺜﻤﺎﺭ ﻓﻲ ﺍﻝﺩﻭل ﺍﻹﺴﻼﻤﻴﺔ. – 10ﺘﻭﺜﻴﻕ ﺍﻝﻌﻘﻭﺩ :ﻭﻴﻘﺼﺩ ﺒﺫﻝﻙ ﺃﻥ ﻴﻌﻠﻡ ﻜل ﻁﺭﻑ ﻤﻥ ﺃﻁﺭﺍﻑ ﺍﻝﻌﻤﻠﻴﺔ ﺍﻻﺴﺘﺜﻤﺎﺭﻴﺔ ﻤﻘﺩﺍﺭ ﻤﺎ ﺴﻭﻑ ﻴﺤﺼل ﻋﻠﻴﻪ ﻤﻥ ﻋﺎﺌﺩ ﺃﻭ ﻜﺴﺏ ،ﻭﻤﻘﺩﺍﺭ ﻤﺎ ﺴﻭﻑ ﻴﺘﺤﻤل ﻤﻥ ﺨﺴﺎﺭﺓ ﺇﺫﺍ ﺤﺩﺜﺕ ،ﻭﺃﻥ ﻴﻜﺘﺏ ﺫﻝﻙ ﻓﻲ ﻋﻘﻭﺩ ﻤﻭﺜﻘﺔ ﺤﺘﻰ ﻻ ﻴﺤﺩﺙ ﺠﻬﺎﻝﺔ ﺃﻭ ﻏﺭﺭﹰﺍ ﺃﻭ ﻥ ﺁ ﻤﻨﹸﻭﺍﹾ ِﺇﺫﹶﺍ ل} :ﻴﺎ َﺃ ﻴﻬﺎ ﺍﱠﻝﺫﻴ ﻴﺅﺩﻱ ﺇﻝﻰ ﺸﻙ ﻭﺭﻴﺒﺔ ﻭﻨﺯﺍﻉ ...ﻭﻝﻘﺩ ﺘﻨﺎﻭل ﺍﻝﻘﺭﺁﻥ ﺍﻝﻜﺭﻴﻡ ﻫﺫﻩ ﺍﻝﻤﺴﺄﻝﺔ ﻓﻲ ﺁﻴﺔ ﺍﻝﻜﺘﺎﺒﺔ ،ﻓﻴﻘﻭل ﻋ ﺯ ﻭﺠ ﱠ ﻋﱠﻠ ﻤ ﻪ ﺍﻝﱠﻠ ﻪ ﹶﻓﻠﹾ ﻴﻜﹾ ﹸﺘﺏ ﻭﻝﹾ ﻴﻤﻠ ِل ﺍﱠﻝﺫﻱ ﺏ ﹶﻜﻤﺎ ﺏ ﻜﹶﺎ ﺘﺏَ ﺃﻥ ﻴﻜﹾ ﹸﺘ ﺴﻤﻰ ﻓﹶﺎﻜﹾ ﹸﺘﺒﻭ ﻩ ﻭﻝﹾ ﻴﻜﹾﺘﹸﺏ ﺒﻴ ﹶﻨ ﹸﻜﻡ ﻜﹶﺎ ﺘﺏ ﺒﹺﺎﻝﹾ ﻌﺩِ ل ﻭ ﹶﻻ ﻴﺄْ ﺠ ٍل ﻤ ﻥ ِﺇﻝﹶﻰ َﺃ ﹶﺘﺩﺍﻴﻨﺘﹸﻡ ﹺﺒ ﺩﻴ ﹴ ﻀﻌﻴﻔﹰﺎ َﺃﻭ ﹶﻻ ﻴﺴ ﹶﺘﻁﻴ ﻊ ﺃَﻥ ﻴ ﻤ ﱠل ﻫ ﻭ ﹶﻓﻠﹾ ﻴﻤﻠلْ ﺴﻔﻴﻬﺎ َﺃﻭ ﻕ ﺤﱡ ﻋﹶﻠﻴ ﻪ ﺍﻝﹾ ﻥ ﺍﱠﻝﺫﻱ ﺸﻴﺌًﺎ ﻓﹶﺈﻥ ﻜﹶﺎ ﺨﺱ ﻤﻨﹾ ﻪ ﹶ ﻕ ﺍﻝﱠﻠ ﻪ ﺭ ﺒ ﻪ ﻭ ﹶﻻ ﻴﺒ ﹶ ﻕ ﻭﻝﹾ ﻴ ﱠﺘ ﺤﱡ ﻋﹶﻠﻴ ﻪ ﺍﻝﹾ ﻀ ﱠل ﺇْﺤﺩﺍ ﻫﻤﺎ ﺸ ﻬ ﺩﺍ ﺀ ﺃَﻥ ﹶﺘ ﻥ ﺍﻝ ﱡ ﻥ ﻤ ﻀﻭ ﻥ ﻤﻤﻥ ﹶﺘﺭ ﺠلٌ ﻭﺍﻤ ﺭَﺃﺘﹶﺎ ﹺ ﻥ ﹶﻓﺭ ﺠ ﹶﻠﻴ ﹺ ﺸﻬﹺﻴ ﺩﻴﻥﹺ ﻤﻥ ﺭﺠﺎِﻝ ﹸﻜﻡ ﹶﻓﺈِﻥ ﱠﻝﻡ ﻴﻜﹸﻭﻨﹶﺎ ﺭ ﻭِﻝ ﻴ ﻪ ﺒﹺﺎﻝﹾ ﻌﺩِ ل ﻭﺍﺴ ﹶﺘﺸﹾ ﹺﻬﺩﻭﺍﹾ ﹶ ﻁ ﻋﻨ ﺩ ﺍﻝﱠﻠ ﻪ ﺴﹸ ﺠﻠ ﻪ ﹶﺫِﻝ ﹸﻜﻡَ ﺃﻗﹾ ﺼﻐﻴﺭﺍ ﺃَﻭ ﹶﻜﺒﹺﻴﺭﺍ ِﺇﻝﹶﻰ َﺃ ﺸ ﻬﺩﺍ ﺀ ِﺇﺫﹶﺍ ﻤﺎ ﺩﻋﻭﺍﹾ ﻭ ﹶﻻ ﹶﺘﺴَﺄ ﻤﻭﺍﹾ ﺃَﻥ ﹶﺘﻜﹾ ﹸﺘ ﺒﻭ ﻩ ﺏ ﺍﻝ ﱡ ﹶﻓ ﹸﺘ ﹶﺫ ﱢﻜ ﺭ ِﺇﺤﺩﺍ ﻫﻤﺎ ﺍ ُﻷﺨﹾﺭﻯ ﻭ ﹶﻻ ﻴﺄْ ﺠﻨﹶﺎﺡَ ﺃ ﱠﻻ ﹶﺘﻜﹾ ﹸﺘﺒﻭﻫﺎ ﻭَﺃﺸﹾ ﹺﻬ ﺩﻭﺍﹾ ِﺇﺫﹶﺍ ﹶﺘﺒﺎ ﻴﻌ ﹸﺘﻡ ﻋﹶﻠﻴ ﹸﻜﻡ ﺱ ﻀ ﺭ ﹰﺓ ﹸﺘﺩﻴﺭﻭ ﹶﻨﻬﺎ ﺒﻴ ﹶﻨ ﹸﻜﻡ ﹶﻓﹶﻠﻴ ﻥ ﺘﺠﺎ ﺭ ﹰﺓ ﺤﺎ ﺸﻬﺎﺩ ﺓ ﻭَﺃﺩﻨﹶﻰ َﺃ ﱠﻻ ﹶﺘﺭﺘﹶﺎﺒﻭﺍﹾ ِﺇ ﱠﻻ ﺃَﻥ ﹶﺘﻜﹸﻭ ﻭَﺃﻗﹾﻭ ﻡ ﻝِﻠ ﱠ ﻋﻠﻴﻡ] {ﺍﻝﺒﻘﺭﺓ.[282: ﺸﻲ ﺀ ﺸﻬﹺﻴﺩ ﻭﺇِﻥ ﹶﺘﻔﹾ ﻌﻠﹸﻭﺍﹾ ﹶﻓ ِﺈ ﱠﻨ ﻪ ﹸﻓﺴﻭﻕﹲ ﹺﺒ ﹸﻜﻡ ﻭﺍ ﱠﺘﻘﹸﻭﺍﹾ ﺍﻝﱠﻠ ﻪ ﻭ ﻴ ﻌﱢﻠ ﻤ ﹸﻜ ﻡ ﺍﻝﱠﻠ ﻪ ﻭﺍﻝﱠﻠ ﻪ ﹺﺒ ﹸﻜ ﱢل ﹶ ﻭ ﹶﻻ ﻴﻀﺂ ﺭ ﻜﹶﺎ ﺘﺏ ﻭ ﹶﻻ ﹶ ﻭﺘﺄﺴﻴﺴﹰﺎ ﻋﻠﻰ ﺫﻝﻙ ﻴﺠﺏ ﻋﻠﻰ ﺇﺩﺍﺭﺓ ﺍﺴﺘﺜﻤﺎﺭ ﺃﻤﻭﺍل ﺍﻝﻭﻗﻑ ﺇﺒﺭﺍﻡ ﻋﻘﻭﺩ ﺍﻻﺴﺘﺜﻤﺎﺭ ﻭﻤﺭﺍﺠﻌﺘﻬﺎ ﻤﻥ ﺍﻝﻨﺎﺤﻴﺔ ﺍﻝﺸﺭﻋﻴﺔ ﻭﺍﻝﻘﺎﻨﻭﻨﻴﺔ ﻭﺍﻻﺴﺘﺜﻤﺎﺭﻴﺔ ﺒﻤﻌﺎﻭﻨﺔ ﺃﻫل ﺍﻻﺨﺘﺼﺎﺹ ﻭﻓﻲ ﺫﻝﻙ ﻤﺤﺎﻓﻅﺔ ﻋﻠﻰ ﺍﻝﻤﺎل ﻤﻥ ﺍﻻﻋﺘﺩﺍﺀ ﻋﻠﻴﻪ. – 11ﺍﻝﻤﺘﺎﺒﻌﺔ ﻭﺍﻝﻤﺭﺍﻗﺒﺔ ﻭﺘﻘﻭﻴﻡ ﺍﻷﺩﺍﺀ :ﻭﻴﻘﺼﺩ ﺒﺫﻝﻙ ﺃﻥ ﻴﻘﻭﻡ ﺍﻝﻤﺴﺅﻭل ﻋﻥ ﺍﺴﺘﺜﻤﺎﺭ ﺍﻝﻤﺎل ﺴﻭﺍﺀ ﻜﺎﻥ ﻨﺎﻅﺭﹰﺍ ﺃﻭ ﻤﺩﻴﺭﹰﺍ ﺃﻭ ﻤﺅﺴﺴﺔ ﺃﻭ ﻫﻴﺌﺔ ﺃﻭ ﺃﻱ ﺼﻔﺔ ﺃﺨﺭﻯ ﺒﻤﺘﺎﺒﻌﺔ ﻋﻤﻠﻴﺎﺕ ﺍﻻﺴﺘﺜﻤﺎﺭ ﻝﻼﻁﻤﺌﻨﺎﻥ ﻤﻥ ﺃﻨﻬﺎ ﺘﺴﻴﺭ ﻭﻓﻘﹰﺎ ﻝﻠﺨﻁﻁ ﻭﺍﻝﺴﻴﺎﺴﺎﺕ ﻭﺍﻝﺒﺭﺍﻤﺞ ﻻ ﺒﺄﻭل ،ﻭﻫﺫﺍ ﻴﺩﺨل ﻓﻲ ﻨﻁﺎﻕ ﺍﻝﻤﺤﺎﻓﻅﺔ ﻋﻠﻰ ﺍﻻﺴﺘﺜﻤﺎﺭﺍﺕ ﺍﻝﻤﺤﺩﺩﺓ ﻤﺴﺒﻘﺎﹰ ،ﻭﺒﻴﺎﻥ ﺃﻫﻡ ﺍﻻﻨﺤﺭﺍﻓﺎﺕ ،ﻭﺒﻴﺎﻥ ﺃﺴﺒﺎﺒﻬﺎ ﻭﻋﻼﺠﻬﺎ ﺃﻭ ﹰ ﻭﺘﻨﻤﻴﺘﻬﺎ ﺒﺎﻝﺤﻕ.
