http://www.islamfeqh.com/Lagna/PrintLagnaFatawa.aspx?LagnaFa... ﻋﻨﻮﺍﻥ ﺍﻟﻔﺘﻮﻯ : ﺭﻗﻢ ﺍﻟﻔﺘﻮﻯ: ﻣﻮﻗﻊ اﻟﻔﻘﮫ اﻹﺳﻼﻣﻲ -ﻟﺠﻨﺔ اﻟﻔﺘﻮى -اﻟﻔﺘﻮى ﻣﻌﺎﻣﻠﺔ ﻣﺎﻟﻴﺔ ﺑﺼﻮﺭﺓ ﻋﻜﺲ ﺍﻟﻌﻴﻨﺔ 13ﺍﻟﺘﺎﺭﻳﺦ 13/8/1431 :ﻫـ ﻧﺺ ﺍﻟﻔﺘﻮﻯ : ﺍﳊﻤﺪ ﷲ ﺭﺏ ﺍﻟﻌﺎﳌﲔ ،ﻭﺍﻟﺼﻼﺓ ﻭﺍﻟﺴﻼﻡ ﻋﻠﻰ ﺃﺷﺮﻑ ﺍﳋﻠﻖ ﻭﺳﻴﺪ ﺍﳌﺮﺳﻠﲔ ،ﻧﺒﻴﻨﺎ ﳏﻤﺪ ﻭﻋﻠﻰ ﺁﻟﻪ ﻭﺻﺤﺒﻪ ﺃﲨﻌﲔ ..ﻭﺑﻌﺪ. ﻓﻘﺪ ﺍﻃﻠﻌﺖ ﳉﻨﺔ ﺍﻟﻔﺘﻮﻯ ﲟﻮﻗﻊ ﺍﻟﻔﻘﻪ ﺍﻹﺳﻼﻣﻲ ﻋﻠﻰ ﺍﻟﺴﺆﺍﻝ ﺍﻟﻮﺍﺭﺩ ﺇﻟﻴﻬﺎ ﺑﺮﻗﻢ ) ،(13ﻭﻧﺼﻪ ﺍﻵﰐ: ﻳﻜﻮﻥ ﺑﻌﺾ ﺍﻟﻨﺎﺱ ﰲ ﺣﺎﺟﺔ ﺇﱃ ﻣﺒﻠﻎ ﻣﻦ ﺍﳌﺎﻝ ،ﻓﻴﻘﻮﻡ ﺑﺎﻻﺗﻔﺎﻕ ﻣﻊ ﺃﻣﻪ ﺃﻭ ﺃﺑﻴﻪ ،ﺍﻟﺬﻱ ﳝﺘﻠﻚ ﺃﺭﺿﺎ ،ﻋﻠﻰ ﺃﻥ ﻳﺒﻴﻊ ﻫﺬﻩ ﺍﻷﺭﺽ ﻧﻘﺪﺍ ﻋﻠﻰ ﺍﻟﺒﻨﻚ ،ﰒ ﻳﻘﻮﻡ ﻫﻮ ﺑﺄﺧﺬ ﺫﻟﻚ ﺍﳌﺒﻠﻎ ﻣﻦ ﺃﻣﻪ ﺃﻭ ﺃﺑﻴﻪ، ﰒ ﻳﻘﻮﻡ ﺑﺸﺮﺍﺀ ﻧﻔﺲ ﺍﻷﺭﺽ ﻣﻦ ﺍﻟﺒﻨﻚ ﻣﺮﺍﲝﺔﹰ ،ﻭﻣﻦ ﰒ ﻳﻘﻮﻡ ﺑﺘﺴﻠﻴﻢ ﻫﺬﻩ ﺍﻷﺭﺽ ﻷﺑﻴﻪ ﻣﺮﺓ ﺃﺧﺮﻯ ،ﻓﻤﺎ ﺣﻜﻢ ﻫﺬﺍ ﺍﻟﻌﻤﻞ؟ ﻭﺑﻌﺪ ﺍﻻﻃﻼﻉ ﻭﺍﻟﺪﺭﺍﺳﺔ ﺃﺟﺎﺑﺖ ﺍﻟﻠﺠﻨﺔ ﲟﺎ ﻳﺄﰐ: ﻓﺈﻥ ﺍﻟﺘﻮﺍﻃﺆ ﻋﻠﻰ ﺍﻟﻘﺮﺽﹺ ﺍﻟﺮﺑﻮﻱ ﰲ ﻫﺬﻩ ﺍﳌﻌﺎﻣﻠﺔ ﻇﺎﻫﺮ ﺟﻠﻲ ،ﺳﻮﺍﺀ ﻛﺎﻥ ﺍﻟﺸﺨﺺ ﺍﻟﺜﺎﻟﺚ ﺃﻣﻪ ﺃﻡ ﺃﺑﺎﻩ ﺃﻡ ﺷﺨﺼﺎ ﺃﺟﻨﺒﻴﺎ ،ﻭﺣﻘﻴﻘﺔ ﻫﺬﺍ ﺍﻟﺘﺼﺮﻑ ﺃﻧﻪ ﻋﻜﺲ ﺍﻟﻌﻴﻨﺔ؛ ﻭﺫﻟﻚ ﺃﻧﻪ ﺑﺎﻉ ﻧﻘﺪﺍ ﺑﺄﻗﻞﱠ ﳑﺎ ﺍﺷﺘﺮﻯ ﺑﻪ ﻧﺴﻴﺌﺔ ،ﻓﻬﻮ ﻗﺪ ﺑﺎﻉ ﺍﻷﺭﺽ ﻋﻠﻰ ﺍﻟﺒﻨﻚ ﺑﺜﻤﻦ ﻧﻘﺪﻱ ،ﰒ ﺍﺷﺘﺮﺍﻫﺎ ﻣﻦ ﺍﻟﺒﻨﻚ ﺑﺄﻛﺜﺮ ﻧﺴﻴﺌﺔﹰ ،ﻓﺤﺼﻞ ﰲ ﻳﺪﻩ ﻣﺒﻠﻎﹲ ﻧﻘﺪﻱ ﺃﻗﻞﱡ ﳑﺎ ﺛﺒﺖ ﰲ ﺫﻣﺘﻪ-ﻭﻫﻮ ﺍﳌﻘﺼﻮﺩ ﺃﺻﻼ ﺑﺎﳌﻌﺎﻣﻠﺔ ،ﻭﺍﻷﺭﺽ ﰲ ﺍﳊﻘﻴﻘﺔ ﻟﻴﺴﺖ ﻣﻘﺼﻮﺩﺓ ﻟﻪ ،ﺇﳕﺎ ﻫﻲ ﺍﻟﻮﺳﻴﻠﺔ ﺍﻟﱵ ﺃﺿﻔﺖ ﺷﺮﻋﻴﺔﹰ ﻋﻠﻰ ﺗﻠﻚ ﺍﳌﻌﺎﻣﻠﺔ؛ ﻟﺬﺍ ﻓﺎﻟﺼﺤﻴﺢ ﺃﻥ ﻫﺬﻩ ﺍﳌﻌﺎﻣﻠﺔ ﳏﺮﻣﺔ ،ﻭﻫﻲ ﻧﻔﺲ ﺍﻟﻌﻴﻨﺔ ،ﻭﺇﻥ ﺧﺎﻟﻔﺘﻬﺎ ﰲ ﺑﺪﺍﻳﺘﻬﺎ ،ﺣﻴﺚ ﺑﺪﺃﺕ ﺑﺒﻴﻊ ﺍﻟﻨﻘﺪ ،ﻭﺍﻧﺘﻬﺖ ﺑﺎﳌﺆﺟﻞ ،ﻭﺍﳌﺸﻬﻮﺭ ﰲ ﺍﻟﻌﻴﻨﺔ ﺍﻟﺒﺪﺍﻳﺔ ﺑﺎﳌﺆﺟﻞ ،ﰒ ﺍﻻﻧﺘﻬﺎﺀ ﺑﺎﻟﻨﻘﺪ ،ﻭﻫﻮ ﻻ ﻳﻐﲑ ﻣﻦ ﺍﳊﻜﻢ ﺷﻴﺌﺎ ،ﻣﻊ ﻛﻮﻤﺎ ﻳﺸﺘﺮﻛﺎﻥ ﰲ ﺍﳊﻴﻠﺔ ﻋﻠﻰ ﺍﻟﻘﺮﺽ ﺍﻟﺮﺑﻮﻱ ،ﻭﺇﺩﺧﺎﻝ ﺍﻟﺴﻠﻌﺔ ﺣﻴﻠﺔ ﻟﺘﺤﻠﻴﻞ ﺍﳌﻌﺎﻣﻠﺔ ،ﻭﻗﺪ ﻗﺎﻡ ﺍﻟﺪﻟﻴﻞ ﺍﻟﺸﺮﻋﻲ ﻋﻠﻰ ﲢﺮﱘ ﺍﻟﻌﻴﻨﺔ ،ﻓﻌﻦ ﺍﺑﻦﹺ ﻋﻤﺮ ﺭﺿﻲ ﺍﷲ ﻋﻨﻬﻤﺎ ﻗﹶﺎﻝﹶ :ﺳﻤﻌﺖ ﺭﺳﻮﻝﹶ ﺍﻟﻠﱠﻪ ﺻﻠﱠﻰ ﺍﻟﻠﱠﻪ ﻋﻠﹶﻴﻪ ﻭﺳﻠﱠﻢ ﻳﻘﹸﻮﻝﹸ ) :ﺇﹺﺫﹶﺍ ﺗﺒﺎﻳﻌﺘﻢ ﺑﹺﺎﻟﹾﻌﻴﻨﺔ ،ﻭﺃﹶﺧﺬﹾﺗﻢ ﺃﹶﺫﹾﻧﺎﺏ ﺍﻟﹾﺒﻘﹶﺮﹺ ،ﻭﺭﺿﻴﺘﻢ ﺑﹺﺎﻟﺰﺭﻉﹺ ،ﻭﺗﺮﻛﹾﺘﻢ ﺍﹾﻟﺠﹺﻬﺎﺩ ﺳﻠﱠﻂﹶ ﺍﻟﻠﱠﻪ ﻋﻠﹶﻴﻜﹸﻢ ﺫﹸﻟﺎ ﻟﹶﺎ ﻳﻨﺰﹺﻋﻪ ﺣﺘﻰ ﺗﺮﺟﹺﻌﻮﺍ ﺇﹺﻟﹶﻰ ﺩﻳﻨﹺﻜﹸﻢ.( ﺃﺧﺮﺟﻪ ﺃﲪﺪ ﻭﺃﺑﻮ ﺩﺍﻭﺩ ﺑﺴﻨﺪ ﺻﺤﻴﺢ ،ﻭﻋﻦ ﺃﰊ ﺇﺳﺤﺎﻕ ﺍﻟﺴﺒﻴﻌﻲ ﻋﻦ ﺍﻣﺮﺃﺗﻪ ﺃﺎ ﺩﺧﻠﺖ ﻋﻠﻰ ﻋﺎﺋﺸﺔ ﺭﺿﻲ م 31/07/2010 08:22 ﻣﻦ 1 3 http://www.islamfeqh.com/Lagna/PrintLagnaFatawa.aspx?LagnaFa... ﻣﻮﻗﻊ اﻟﻔﻘﮫ اﻹﺳﻼﻣﻲ -ﻟﺠﻨﺔ اﻟﻔﺘﻮى -اﻟﻔﺘﻮى ﺍﷲ ﻋﻨﻬﺎ ﻓﺪﺧﻠﺖ ﻣﻌﻬﺎ ﺃﻡ ﻭﻟﺪ ﺯﻳﺪ ﺑﻦ ﺃﺭﻗﻢ ﺍﻷﻧﺼﺎﺭﻱ ﻭﺍﻣﺮﺃﺓ ﺃﺧﺮﻯ ،ﻓﻘﺎﻟﺖ ﺃﻡ ﻭﻟﺪ ﺯﻳﺪ ﺑﻦ ﺃﺭﻗﻢ :ﻳﺎ ﺃﻡ ﺍﳌﺆﻣﻨﲔ ،ﺇﱐ ﺑﻌﺖ ﻏﻼﻣﺎ ﻣﻦ ﺯﻳﺪ ﺑﻦ ﺃﺭﻗﻢ ﺑﺜﻤﺎﳕﺎﺋﺔ ﺩﺭﻫﻢ ﻧﺴﻴﺌﺔ ،ﻭﺇﱐ ﺍﺑﺘﻌﺘﻪ ﺑﺴﺘﻤﺎﺋﺔ ﺩﺭﻫﻢ ﻧﻘﺪﺍ ،ﻓﻘﺎﻟﺖ ﳍﺎ ﻋﺎﺋﺸﺔ ﺭﺿﻲ ﺍﷲ ﻋﻨﻬﺎ " :ﺑﺌﺴﻤﺎ ﺍﺷﺘﺮﻳﺖ ،ﻭﺑﺌﺴﻤﺎ ﺷﺮﻳﺖ؛ ﺇﻥ ﺟﻬﺎﺩﻩ ﻣﻊ ﺭﺳﻮﻝ ﺍﷲ ﺻﻠﻰ ﺍﷲ ﻋﻠﻴﻪ ﻭﺳﻠﻢ ﻗﺪ ﺑﻄﻞ ﺇﻻ ﺃﻥ ﻳﺘﻮﺏ" .ﺃﺧﺮﺟﻪ ﺍﻟﺪﺍﺭﻗﻄﲏ ،ﻭﺻﺢ ﻋﻦ ﺃﻧﺲ ﻭﻋﺒﺪ ﺍﻟﻠﹼﻪ ﺑﻦ ﻋﺒﺎﺱ ﺭﺿﻲ ﺍﷲ ﻋﻨﻬﻤﺎ ﺃﻧﻬﻤﺎ ﺳﺌﻼ ﻋﻦ ﺍﻟﻌﻴﻨﺔ؟ ﻓﻘﺎﻻ " :ﺇﻥﹼ ﺍﻟﻠﹼﻪ ﻻ ﻳﺨﺪﻉ ،ﻫﺬﺍ ﳑﺎ ﺣﺮﻡ ﺍﻟﻠﹼﻪ ﻭﺭﺳﻮﻟﻪ ﺻﻠﻰ ﺍﷲ ﻋﻠﻴﻪ ﻭﺳﻠﻢ". ﻗﺎﻝ ﺃﻳﻮﺏ ﺍﻟﺴﺨﺘﻴﺎﱐ ﺭﲪﻪ ﺍﷲ " :ﳜﺎﺩﻋﻮﻥ ﺍﷲ ﻛﻤﺎ ﳜﺎﺩﻋﻮﻥ ﺍﻟﺼﺒﻴﺎﻥ ،ﻟﻮ ﺃﺗﻮﺍ ﺍﻷﻣﺮ ﻋﻠﻰ ﻭﺟﻬﻪ ﻛﺎﻥ ﺃﺳﻬﻞ ". ﻟﺬﺍ ﻓﺎﻟﻮﺍﺟﺐ ﻋﻠﻰ ﺍﳌﺴﻠﻢ ﺃﻥ ﻳﺘﺤﺮﻯ ﺍﳊﻼﻝ ﰲ ﺃﻣﺮ ﺩﻳﻨﻪ ،ﻭﻻ ﻳﺴﻌﻰ ﻻﺳﺘﺤﻼﻝ ﻣﺎ ﺣﺮﻡ ﺍﷲ، ﻣﺘﺤﻴﻼ ﻋﻠﻰ ﺍﷲ ،ﻓﺈﻥ ﻫﺬﺍ ﺷﺄﻥ ﺍﻟﻴﻬﻮﺩ ،ﺍﻟﺬﻱ ﻳﺴﺘﺤﻠﻮﻥ ﳏﺎﺭﻡ ﺍﷲ ﺑﺄﺩﱏ ﺍﳊﻴﻞ. ﺍﳌﻮﺍﻓﻘﻮﻥ: ﺩ.ﺧﺎﻟﺪ ﺑﻦ ﻋﺒﺪ ﺍﷲ ﺍﳌﺰﻳﲏ ﺩ .ﻋﺒﺪ ﺍﻟﺮﲪﻦ ﺑﻦ ﺃﲪﺪ ﺍﳉﺮﻋﻲ ﺩ.ﻧﺎﻳﻒ ﺑﻦ ﻧﺸﻤﻲ ﺍﻟﻌﺠﻤﻲ ﺩ.ﻳﻮﺳﻔﱭ ﻋﺒﺪ ﺍﷲ ﺍﻟﺸﺒﻴﻠﻲ ﺩ.ﻋﺒﺪ ﺍﷲ ﺑﻦ ﳏﻤﺪ ﺍﻟﻄﻴﺎﺭ ،ﻭﻗﺪ ﻭﺍﻓﻖ ﻋﻠﻰ ﻛﻮﺎ ﻣﻦ ﺍﻟﺘﻮﺍﻃﺆ ﺍﶈﺮﻡ. ﺩ .ﳏﻤﺪ ﺑﻦ ﻋﺒﺪ ﺍﻟﻠﻄﻴﻒ ﺍﻟﺒﻨﺎ ،ﻭﻗﺪ ﻭﺍﻓﻖ ﻋﻠﻰ ﻛﻮﺎ ﻣﻦ ﺍﻟﺘﻮﺍﻃﺆ ﺍﶈﺮﻡ. ﺩ .ﻋﻘﻴﻞ ﺑﻦ ﳏﻤﺪ ﺍﳌﻘﻄﺮﻱ ،ﻭﻗﺪ ﻭﺍﻓﻖ ﻋﻠﻰ ﻛﻮﺎ ﻣﻦ ﺍﻟﺘﻮﺍﻃﺆ ﺍﶈﺮﻡ. م 31/07/2010 08:22 ﻣﻦ 2 3 اﻟﻔﺘﻮى- ﻟﺠﻨﺔ اﻟﻔﺘﻮى- ﻣﻮﻗﻊ اﻟﻔﻘﮫ اﻹﺳﻼﻣﻲ http://www.islamfeqh.com/Lagna/PrintLagnaFatawa.aspx?LagnaFa... ﺗﻌﻠﻴﻘﺎﺕ ﺣﻮﻝ ﺍﳌﻮﺿﻮﻉ 3 3 ﻣﻦ 31/07/2010 08:22 م
