‘CPA AUSTRALIA WELLINGTON CAREER EXPO’ COMPETITION TERMS AND CONDITIONS (NEW ZEALAND) 1. Promoter The promoter is CPA Australia (ABN 64 008 452 392) of Level 20, 28 Freshwater Place, Southbank, VIC 3006 (CPA Australia). 2. Competition Dates and Information 2.1 2.2 3.3 An “Accredited Program” means a Bachelor of Commerce (Accounting), Bachelor of Applied Management (Accounting), Bachelor of Accountancy, Master of Professional Account8ing, or Bachelor of Business (Accounting). The ‘CPA Australia Wellington Career Expo’ competition (Competition) is a game of chance. The Competition commences at 7.00am New Zealand Standard Time (NZST) on Tuesday, 30 June 2015 and closes at 11.59pm (NZST) on Friday 31 July 2015 (Competition Period). 4. Selection Process 4.1 The Competition will consist of one prize draw conducted at Level 16 HSBC House, 1 Queen Street, Auckland New Zealand at 10:00am (NZST) on Wednesday, 5 August 2014 (Prize Draw). The draw will be conducted by CPA Australia. Information on how to enter the Competition and information on the Prizes (as defined in clause 5 below) forms part of these terms and conditions of entry as available at http://www.cpaaustralia.com.au/become-acpa/network/career-expo/wellington (Competition Website). By submitting an Entry you acknowledge that you have read, understood and agree to accept and be bound by these terms and conditions of the Competition and any other special terms and conditions appearing on the Competition Website specific to the Competition. Entries not in accordance with these terms and conditions are deemed ineligible. 4.2 Entries will be randomly drawn until there is one winner from each Region (each a ‘Winner’). 4.3 If the Winner cannot be contacted, and cannot confirm acceptance of their Prize within 48 hours of receiving Notice (as per clause 6) from CPA Australia, a re-draw will be conducted at Level 16 HSBC House, 1 Queen Street, Auckland New Zealand at 10:00am (NZST) on Friday, 7 August 2015 (Prize Re-draw). 4.4 An Entrant will only be eligible to win one (1) Prize. 4.5 Entrants are responsible for ensuring that their contact details submitted to CPA Australia are correct. Entrants may forfeit their right to claim a Prize in the event that their contact details are inaccurate or their entries are incomplete. 3. Eligibility 3.1 To be eligible to enter the Competition, “Entrants” must: a) be 18 years of age or over; b) be enrolled in an Approved Institution; c) be enrolled in an Accredited Program at an Approved Institution in New Zealand and as specified in clauses 3.2 and 3.3 (Approved Institution); d) complete a registration form on the Competition Website to attend CPA Australia’s ‘Wellington Career Expo’ at the Intercontinental Wellington , 2 Grey Street, Wellington, 6011 New Zealand on Tuesday 15 September 2015 (Wellington Career Expo), and e) complete a registration form to become a member of CPA Australia network (or, already be a member of CPA Australia network). 3.2 An “Approved Institution” means University of Otago, University of Canterbury, Lincoln University, Christchurch Polytechnic Institute of Technology, Nelson Malborough Institute of Technology, Open Polytechnic, Massey University (Manawatu Campus) and Eastern Institute of Technology. 5. The Prizes 5.1 There will be two (2) Prizes available, one (1) per each Winner. The total value of the Prizes, is approximately NZ $3,000 (inclusive of GST), based on the recommended retail value of each Prize at the time of printing these terms and conditions. CPA Australia accepts no responsibility for any variation in the value of the Prizes. Prizes are not transferable to any person or exchangeable and cannot be taken as cash. 5.2 Prizes are subject to availability. The Prizes on offer are the following and may be changed at the discretion of CPA Australia: a) Economy flight to Wellington b) 1 nights’ accommodation at the Intercontinental Wellington; c) Transfer to and from Winner’s place of residence to nearest airport; d) Transfer from Wellington Airport to Wellington Career Expo. 5.3 The above Prizes were or will be purchased by CPA Australia. The abovementioned businesses and any other businesses from whom Prizes are purchased, are not in any way associated with CPA Australia or the Competition nor do they endorse the Competition. Return flights to Auckland will be from the closest airport to each Winner’s place of residence. 5.4 The above mentioned Prizes do not include food or beverages. 5.5 In the event where there are no valid Entries during the Promotional Period then no Prize will be awarded. 5.6. If a Prize or any part thereof is unavailable, for whatever reason, CPA Australia reserves the right to substitute the Prize for a prize of equal or greater value, subject to statutory regulation. 6. 6.1 Notice Winners will be notified by email, or the Winners’ preferred contact details as specified in their registration details (Notice) within 7 business days of selection. 6.2 The Winner will have their first initial, last name and state of residence published on the CPA Australia website no later than 7 days after the original Prize Draw. 6.3 Once contacted the winning Entrant will receive their Prize by registered mail/courier to their nominated contact address (or as otherwise arranged with CPA Australia). 6.4 If a Winner is unwilling or unable to collect their Prize, or does not confirm with CPA Australia within 20 business days of receiving Notice, that they are willing and able to collect their Prize, the Winner will forfeit their Prize and CPA Australia may offer the Prize to a runner-up Entrant. For the purposes of these terms and conditions, a runnerup Entrant who is awarded a prize by CPA Australia is deemed a ‘Winner’. 7. Use of Entrants’ Advertising 7.1 Each Entrant acknowledges and agrees that CPA Australia may use their name and/or image, in any future marketing campaigns which may involve a television commercial or commercials, creation of other advertising in print or other media (Advertising) and: a) agrees to appear in the Advertising and authorises CPA Australia to make and use audio or visual recordings and/or stills of their image for use in the Advertising; b) name and/or image releases CPA Australia from any obligation to make payment to them for participating in the Advertising or for the use of my name and/or image in the Advertising; d) waives any moral rights whatsoever in respect of the Entrant’s Advertising; e) agrees that they will not use or disclose to any person, any information relating to CPA Australia and the Advertising (Confidential Information), except where they are required to make disclosure under any law or Court Order or where the Confidential Information is proved to be in the public domain, or where they were in possession of the Confidential Information prior to 31 July 2015; and f) declares that they have not engaged in in activities or conduct that would bring harm to their own or CPA Australia’s reputation. 8. Privacy Statement 8.1 The personal information collected by CPA Australia for this Competition (Personal Information) is collected by CPA Australia to conduct the Competition, to process your entry into the Competition and if you are a Winner, we may use your Personal Information to publically identify you as a Winner. 8.2 CPA Australia may disclose your Personal Information to external service providers to whom CPA Australia has contracted out functions such as printers, mailing houses, IT companies, photographers and media and advertising companies, but only for the purpose set out above in clause 8.1 of this Privacy Statement. 8.3 If you do not provide CPA Australia with the Personal Information requested, CPA Australia will be unable to process your entry and which may invalidate your entry into the Competition. 8.4 You have the right to access or correct any personal information we hold about you (subject to any applicable legal exceptions) and can do this by contacting CPA Australia on +61 3 9606 9677. For more information on our Privacy Policy, visit our website. 9. 9.1 General Provisions CPA Australia staff or family are not permitted to enter the Competition. 9.2 CPA Australia reserves the right (subject to the requirements of any applicable law) to cancel the Competition at any time and for any reason whatsoever and will not be liable for any losses, damages or expenses suffered by any Entrants as a result of cancelling the Competition. 9.3 CPA Australia may in its absolute discretion disqualify any Entrant of the Competition who CPA Australia has reason to believe has breached any of the Terms and Conditions, or engaged in any unlawful or other improper conduct calculated to in authorises CPA Australia to use their image howsoever recorded, in the Advertising in any medium in the world (including without limitation, in print or a broadcast, or by transmission or communication to the public, electronically, digitally or by other medium not now existing); c) jeopardise the fair and proper conduct of the Competition. CPA Australia’s legal rights to recover damages or other compensation from such an offender, are reserved. 9.4 CPA Australia is not responsible for any problems or technical malfunction of any telephone network or lines, computer on line systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any website, or any combination thereof, (including but not limited to) any injury or damage to participants or any other person’s computer related to or resulting from participation in this competition. 9.5 Any costs associated with accessing the Competition Website is the Entrant’s responsibility and is dependent on the Internet service provider used. 9.6 If the Prize on offer is cancelled for any reason whatsoever, CPA Australia will not be obliged to provide a substitute Prize and will not (to the maximum extent permitted by applicable law) be liable for any losses, damages or expenses that the Entrant suffers or may suffer whatsoever arising from the cancellation. 9.7 Entrants must not: (a) publish any commentary (including electronically on any social media or the World Wide Web); or (b) make any statement to the media or to any other person with means to publish information, without providing the proposed statement, article or otherwise to CPA Australia for review and without receiving CPA Australia’s prior written consent (which consent may be withheld in CPA Australia’s absolute discretion). 9.8 9.9 9.10 CPA Australia’s decision in relation to any and all aspects of the Competition is final and binding on every person who enters and no correspondence will be entered into. CPA Australia, each of its related bodies corporate, officers, employees and agents shall not be liable for any loss, damage, expense or charge whatsoever which is suffered (including but not limited to direct, indirect or consequential loss) or for any personal injury suffered or sustained in connection with this Competition and/or any Prize/s except for any liability which cannot be excluded by law. CPA Australia makes no representations or warranties as to the quality/suitability of Prizes. To the extent permitted by law, CPA Australia is not liable for any loss suffered or sustained, to person or property and including, but not limited to, consequential (including economic) loss by reason of any act or omission, deliberate or negligent, by CPA Australia, or its agents, in connection with the arrangement for supply, or the supply, of any goods or services by any person to the Prize Winners. This clause does not affect, and is not intended to affect, any rights a consumer might have, which are not able to be excluded under applicable Australian consumer protection laws. 9.11 If for any reason this Competition is not capable of running as planned, including but not limited to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of CPA Australia which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Competition, CPA Australia reserves the right, subject to any written directions given under applicable law, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Competition. CPA Australia reserves all rights to recover damages and/or other compensation as may be deemed appropriate from such an offender. 9.12 The Promoter reserves the right to verify the validity of Entries and to disqualify any Entry which, in the opinion of the Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any Entrant who tampers with the Entry process, who submits an Entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of the Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. The Promoter reserves the right to disqualify a Winner retrospectively if the Promoter becomes aware that the Winner and/or the Winner’s Entry is of a type described in this clause. 9.13 Unless expressly stated in these terms and conditions, all expenses in relation to the Prize (Including installation costs, travel to and from the event/departure point etc) become the responsibility of the Winner. 9.14 CPA Australia and each of its related bodies corporate, officers, employees and agents and the licensees are not liable for any tax implications (including any Fringe Benefits or Personal Income Tax). Independent financial advice should be sought as tax implications may arise as a result of accepting the Prize. 9.15 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders CPA Australia’s ability to proceed with the Competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, CPA Australia may in its absolute discretion cancel the Competition and recommence it from the start on the same conditions, subject to any written directions given under state regulation. 9.16 All Entries become the property of CPA Australia. CPA Australia may use the Entrant’s names, addresses and telephone numbers for future promotional, marketing and publicity purposes in any media worldwide without notice and without any fee being paid unless otherwise notified by the Entrant. Entrants confirm that they allow their details to be used for this purpose. If Entrants no longer consent to their details being used for future marketing purposes, the Entrant should contact CPA Australia on their details set out below. Any request to update, modify or delete the Entrant’s details should be directed to CPA Australia. 9.17 Any questions regarding this promotion, or the terms and conditions, may be directed to [email protected]. 9.18 These terms are construed in accordance with and governed by the laws of the State of Victoria, Australia and all Entrants irrevocably submit to the non-exclusive jurisdiction of the State of Victoria, Australia.
