Member Discipline Member’s name: NAME NOT DISCLOSED Date of Hearing: 5 July 2012 Division: New South Wales Tribunal Disciplinary Tribunal On 5 July 2012 the Disciplinary Tribunal found a Member breached Article 39(a)(ii)E of the Constitution in that on 13 April 2012 the Member had filed for bankruptcy. At the Disciplinary Tribunal Hearing the Member admitted the breach. The Disciplinary Tribunal noted that continued membership of CPA Australia is inconsistent with a Member being bankrupt, at least for the period of bankruptcy. Penalty and Costs The Disciplinary Tribunal imposed the sanction of suspension of Membership for the period of the Member’s bankruptcy. The Tribunal also determined that prior to any application for readmission the Member must pay CPA Australia’s costs of $671. The Disciplinary Tribunal took into account “exceptional circumstances” and determined that the Member’s name not be disclosed, however should the Member appear before a Disciplinary Tribunal in respect of any other matter during the period of bankruptcy, then the Member’s name will be disclosed. 2203412
