Given that the presentation and the image of workers represent a condition of respectability, we believe that a standardization of SME's permanent workers is a factor that guarantees a better functionality. The Decree No. 1/00 of January 7th, approved the Migration and Foreigners Service's special careers regime, which structure represents a hierarchy of categories in which the permanent workers were integrated and which correspond to established positions. The Article 17 of that same Decree establishes the required conditions to the application of the regulation on transition of professional careers into force on the Migration and Foreigners Service. Under the combined provisions of paragraph f) of article 112 and article 113, both from the Constitution Law, the Government determines as follows: Article 1 - The regulation on uniforms and badges of special career personnel of the Migration and Foreigners Service is approved and annexed to this decree and is an integral part of it. Article 2. - Are repealed all provisions contradicting this executive order. Article 3 - Any doubts and omissions arising in the interpretation and application of this diploma shall be resolved by the Council of Ministers. (Object) 1. This regulation establishes rules on uniforms and badges of special career personnel of the Migration and Foreigners Service and prescriptions on their types, qualities, dimensions, colors, models and standards. 2. Uniforms and badges are means and equipments that should be used in an harmonic way, under a hierarchical and paramilitary organization and functioning, depending on the complexity of the tasks, the decision-making power, autonomy and responsibility for the special career personnel of the Migration and Foreigners Service. ARTICLE 2. (Scope of Application) 1. This regulation applies to the special career personnel of the Migration and Foreigners Service that is obliged to its full compliance and any changes whatsoever to the means and equipments, and hierarchical superiors should monitor his compliance, taking required measures to remedy any violation. 2. Is excluded from the application's scope of this regulation the civilian staff providing in the agencies of Migration and Foreigners Service, which is governed by General Regime of Careers. (Definitions) 1. It is understood by uniform the set of composites pieces for clothing, footwear, equipment, accessories and means of communication is use on the Migration and Foreigners Service. 2. It is understood by badge the identification signal, which is intended to represent the types, categories and positions by the SME's personnel in their uniforms. CHAPTER II Uniforms ARTICLE 4. (Types of uniforms) The Migration and Foreigners Service has the following types of uniforms, according to the Annex II of the present regulation: a) dress uniform for members of the extended Consulting Council and for officers; b) regular or daily uniform; c) campaign uniform; d) instruction and work uniform. ARTICLE 5. (Use) Uniforms should be used by the special career regime personal in the occasions described in the following articles. ARTICLE 7. (Dress uniform) 1. The dress uniform should be used in the following occasions: a) in ceremonies chaired by the Minister of the Interior; b) in ceremonies chaired by the Migration and Foreigners Service's Director; c) in historical acts chaired by Provincial Director representing SME, in national and international activities and events. d) in ceremonies of reception and bestowal of honorary degrees; e) in commemorative acts of historical dates; f) other times with appropriate solemnity. 2. The dress uniform's string should be hung on the stripe of the left shoulder and the 2 nd coat button. ARTICLE 8. ARTICLE 9. (Campaign uniform) The campaign uniform should be used in the following occasions: a) on duty while camp activities; b) in parades and marches. ARTICLE 10. (Instruction and work uniform) The instruction and work uniform is used exclusively in schools and units. SECTION II Modifications and Permissions ARTICLE 11. (Modifications) The modification in dimensions, models and forms set, just as the replacement of the uniform's material provided in this regulation, shall be the responsibility of the entity referred in the article 17 of this regulation. ARTICLE 12. (Use of greatcoat) Depending on weather conditions, forces are permitted to use a greatcoat is foreseen in the uniforms plan. (Mandatory) The use of uniform is mandatory when on duty, except in special cases, according to the provisions in paragraph 2 of the article 17. ARTICLE 14. (Prohibitions) 1. It is not permitted to wear uniform in the following cases: a) in the performance of particular activities; b) in theatrical, film and related scenes, with actors or participants in music and cultural companies that don't belong to the SME, unless there is approval from above; c) in retirement or unlimited license situations; d) in other situations that go against all or part of the uniform's plan. 2. In addition to the preceding paragraph, the officers and agents are also prohibited: a) to use visible objects that are not part of the uniform plan under this Regulation; b) to use medals, badges, emblems or insignia not authorized, unless legally what is expected; c) to insert elements of one uniform's type into another; d) to use part of the uniform in combination with elements of the civilian clothing; e) to wear the uniform in activities other than those established in this Regulation, except with an explicit authorization from the Migration and Foreigners Service's Director; f) to walk on public road wearing the uniform without the coverage or wearing it in a nonadequate way; g) to wear a unbuttoned coat, a shirt or a dolmen and untied shoes; h) in compliance with any term of imprisonment imposed by the competent judicial authority; i) in a state of proven mental incapacity. The mandatory referred in article 13 shall not extend to permanent workers of the Supervision Department of the Migration and Foreigners Service, when on duty. SECTION IV Distribution and Use of Uniforms ARTICLE 15. (Quantity and duration of use of uniform) The amounts of uniforms to be distributed for each person, as well as the time of their use, are listed in the Annexe I of this Regulation and is an integral part of it. ARTICLE 16. (Sanction provisions) 1. The person who deteriorates or loses, for malice or negligence, any piece of uniform, whether or not it has reached the maximum duration, should replace it by direct discounts on their salary, irrespective of other sanctions provided for in the legislation. 2. The replacement referred in the previous paragraph is made by the amount corresponding to the time remaining to reach the time limit. (Power to authorize) 1. The Migration and Foreigners Service's Director may authorize the use of one type of uniform for a specific occasion. 2. Incumbent upon the Migration and Foreigners Service's Director authorize the use of civilian clothes, on duty. CHAPTER III Positions and their Classification ARTICLE 18. (Positions) The categories of positions from the forces of Migration and Foreign Service, under Decree No. 1 / 00 of January 7th, are as follows: 1. Class of Head Officers (Superior Technical Career): a) Main Migration Advisor; b) 1st Class Migration Advisor; c) 2nd Class Migration Advisor. 2. Class of Junior Officers (Technical Mid-Career): a) 1st Class Migration Officer; b) 2nd Class Migration Officer; c) 3rd Class Migration Officer; d) 1st Class Migration Sub-Officer; e) 2nd Class Migration Sub-Officer; f) 3rd Class Migration Sub-Officer; 5. Class of Assistants: a) 1st Class Migration Assistant; b) 2nd Class Migration Assistant; c) 3rd Class Migration Assistant; d) 1st Class Migration Auxiliary; e) 2nd Class Migration Auxiliary; f) 3rd Class Migration Auxiliary; ARTICLE 19. (Classification) 1. Permanent workers,whose livestock class is equal to or greater than sub-officer 3rd. class, are classified as officers of the Migration and Foreigners Service. 2. The categories foreseen in the Article 18 are provided based on the requirements of Decree No. 1 / 00 of January 7th, which approves the Migration and Foreigners Service's Career Regime. (Requirements) 1. The assignment of categories of the Migration and Foreigners Service's special regime has as its underpinning principle the stability that allows the exercise of their profession through a progression in degrees, always parallel to the categories, according to the Migration and Foreigners Service's Career Regime, approved by Decree No. 1 / 00 of January 7th. 2. The assignment of careers must be based on the following requirements: a) to gave a good labor, social, moral and patriotic behavior; b) to have great service information, to take part in master classes and technical and professional expertise with good grades; c) to have training and experience, exercise time and merit; d) to have good grades in contests for providing access to senior categories, as well as the ability to exercise the corresponding position; e) to have good prospects of technical development and cultural and professional. ARTICLE 21. (Periodic promotion) 1. The assignment of categories in the Migration and Foreigners Service is made by the periodic and consecutive promotion. 2. For promotion to higher grade is mandatory the observance of time spent in class and in the corresponding category and with an evaluation contest, according to the vacancies, as required under relevant legislation. (Promotion for Distinguished) The promotion for distinguished is is given in recognition of extraordinary merits for achievements made by the Migration and Foreigners Service's permanent workers in the following cases: a) in defense of the country, maintaining order and safety; b) in heroic acts. ARTICLE 23. (Extraordinary promotion) Can ascend to the next higher category, regardless of length of stay in the category they occupy in their class, officers and employees who have successfully performed their functions, represented with merit services or who have obtained good grades of basic, medium or higher migration course. ARTICLE 24. (Admission and form of access) The admission and access to Migration and Foreigners Service's specifics positions comply to the provisions of Article 9, of Decree No. 24/91 of June 29th. ARTICLE 25. (Time spent in each category) To the promotion to the next higher position or category, it is mandatory to comply with the time spent in corresponding class and category, as well as the curricula, as prescribed in subsequent paragraphs: 1. Class of Senior Officers: a) Main Migration Inspector, five years on duty in the 1st Class Migration Inspector category; b) 1st Class Migration Inspector , five years on duty in the 2 nd Class Migration Inspector category; c) 2nd Class Migration Advisor, five years on duty in the Main Migration Specialist category; 3. Intermediate Class of Officers: a) Main Migration Specialist, five years on duty in the 1st Class Migration Specialist category; b) 1st Class Migration Specialist, five years on duty in the 2nd Class Migration Specialist category; c) 2nd Class Migration Specialist, five years on duty in the 1st Class Migration Sub-Inspector category; d) 1st Class Migration Sub-Inspector, five years on duty in the 2nd Class Migration Sub-Inspector category; e) 2nd Class Migration Sub-Inspector, five years on duty in the 3rd Class Migration Sub-Inspector category; f) 3rd Class Migration Sub-Inspector, five years on duty in the 1st Class Migration Officers category; 4. Class of Assistants: a) 1st Class Migration Assistant, five years on duty in the 2nd Class Migration Assistant category; b) 2nd Class Migration Assistant, five years on duty in the 3rd Class Migration Assistant category; c) 3rd Class Migration Assistant, five years on duty in the 1st Class Migration Auxiliary category; d) 1st Class Migration Auxiliary, five years on duty in the 2nd Class Migration Auxiliary category; e) 2nd Class Migration Auxiliary, five years on duty in the 3rd Class Migration Auxiliary category; f) 3rd Class Migration Auxiliary, to be approved in the practical school of migration as an apprentice. ARTICLE 26. (Demotion) 1. The permanent workers of Migration and Foreigners Service may be demoted, when they are punished with inhibiting sanctions or judged and judged and convicted to an effective imprisonment penalty by a definitive decision 2. The Migration and Foreigners Service's workers may be demoted to the next lower category, as a disciplinary measure, given the gravity of the act performed, based on their disciplinary proceedings. 3. One year after the demotion approved and published in a superior order, can the individuals affected by the preceding paragraph, reacquiring the next higher category, if during that period they obtained favorable assessment and there is a vacancy. ARTICLE 27. (Competence) It is incumbent upon the Ministry of the Interior to promote or demote the Migration and Foreigners Service's workers, on the basis of the Migration and Foreigners Service's Director. (Characterization of badges) 1. The Migration and Foreigners Service's worker bear the badges listed in Annex III to this Regulation, obeying the following descriptions: a) Superior technical career categories, in particular the main migration advisor and 2 nd class migration advisor bear badges with 8cm long and 4cm wide, in blue, with 3,2 and 1 logos respectively with 1,3cm diameter, blue and yellow, a gold cornfield and a cord around the edges also gold, as figures 1, 2 and 3 of Annex III; b) Superior technical career categories, in particular the main migration inspector and 2nd class migration inspector bear badges with the same size and color, with 3,2 and 1 logos respectively with 1,3cm diameter, blue and yellow, with two gold bars in each side, as figures 4, 5 and 6 of Annex III; c) Specialized technical career categories, in particular the main migration specialist and 2 nd class migration specialist bear badges with 8cm long and 4cm wide, in blue, with 3,2 and 1 logos respectively with 1,5cm diameter, with one silver bare, as figures 7,8 and 9 of Annex III; d) Specialized technical career categories, in particular the main migration sub-inspector and 3rd class migration sub-inspector bear badges with the same size and color, with 3,2 and 1 logos respectively with 1,5cm diameter, blue and yellow, as figures 10, 11 and 12 of Annex III; e) Technical mid-career of junior officers categories, in particular the 1st class main migration officer and 3nd class migration officer bear badges with 8cm long and 4cm wide, in blue, with 3,2 and 1 logos respectively with 1,3cm diameter, blue and yellow, as figures 13, 14 and 15 of Annex III; f) Technical mid-career of junior officers categories, in particular the 1st class main migration sub-officer and 3rd class migration sub-officer bear badges with the same size and color, with 3,2 and 1 logos respectively with 0,7cm diameter, blue and yellow, as figures 16, 17 and 18 of Annex III; g) Technical auxiliary career categories, in particular the 1st class main migration assistant and 3nd class migration assistant bear badges with 8cm long and 4cm wide, in blue, with 3,2 and 1 silver bares, upright, as figures 19, 20 and 21 of Annex III; Page 18/37 ____________________________________________________________________________________________________________________________________________________________ Rua Amílcar Cabral, LUANDA – ANGOLA Phone Number: +244 931 169 381/380 [email protected] www.sme.ao _____________________________________________________________________________ h) Technical auxiliary career categories, in particular the 1st class main migration auxiliary and 3nd class migration auxiliary bear badges with 8cm long and 4cm wide, in blue, with 3,2 and 1 silver bares, in horizontal position, as figures 22, 23 and 24 of Annex III.
