MEMORANDUM OF UNDERSTaNDING ON CUSTOMS COOPERaTION BETWEEN La COTE D'IVOIRE CUSTOMS AND GHANa CUSTOMS aDMINISTRaTIONS. Pre amble The Customs administrations of GHANA and LA COTE D'IVOIRE • • • • • • Concerned about the increasing abuse of the Transit and Export Regimes of both countries; Mindful of the leakage in revenue and the impact on the economies of both countries; Mindful of the security threats posed by these regimes to both countries; Determined to assist each other through technical and administrative assistance to arrest the problems; ln furtherance of the Memorandum of Understanding signed by both administrations on 10th September 2004; Do hereby agree as follows: Article 1: SCOPE OF AGREEMENT (a) To connect the computer systems of contracting parties for the purpose of exchanging information on Transit and Export transactions and also with the view to combating Customs, fiscal and other forms of international fraud. (b)To facilitate the monitoring and reconciliation of trade data among contracting parties within the framework of this MOU. (c) To create a common customs database on Transit and Export transactions. Article 2: EXCHANGE OF INFORMATION Contracting parties shall exchange information on imports, exports and transi t. Article 3: CENTRALSERVER A Central Server will be installed at the la Cote d'Ivoire Customs to store declarations on Transit and Export from both countries. Article 4: LOCAL FILE TRANSFER PROTO COL (FTP) SERVER (a) Ghana Customs Shall install a Server with FTP protocol at its Headquarters to enable her access the Central Database to download and upload declarations from the Central Server (b)The FTP Server shall have a Public address(internet Protocol Address) ~IP} Article 5: INFRASTRUCTURE OF DATABASE Infrastructure for the Central Database shaH be provided, maintained and managed by La Cote D'Ivoire Customs on behalf of the contracting parties Article 6: ALIX SOFTWARE The software for the management of the Central Database (ALIX)shaH be provided by La Cote D'Ivoire Customs Administration at no cost to the Ghana Customs Administration. Article 7: TECHNICAL ASSISTANCE Technical Assistance for the use of the ALIXsoftware shaH be provided by La Cote D'Ivoire Customs Administration at no cost to Ghana Customs. Article 8: CONFIDENTIALITY AND PROTECTION OF INFORMATION. (a) The software and the Database are for the exclusive use of the contracting parties (b)Information stored in the Central Database or the F"I'PServer shaH only be disclosed to third parties with the written consent of the owner of the data ( c) On request, the owner of the data may authorize its use by other authorities or for other purposes subject to any terms and conditions it may specify. The use of the data for other purposes includes its use in criminal investigations, prosecutions or proceedings. Article 9: OBLIGATION OF CONTRACTING PARTIES (a) Contracting parties shaH ensure that import and transit declarations capture the declaration number issued by the exporting country. (b) Data on the Central Server shaH be updated on a daily basis. Article 10: IMPLEMENTATION The Directors-General of both administrations shaH issue administrative instructions for implementation of this memorandum of understanding. Article II: SETTLEMENT OF DISPUTES Any dispute between the contracting parties concerning interpretation and application of this agreement shaH be settled by negotiation between the '~ L " ~~7 parties. 2 Article 12: DURATI ON AND TERMINATION (a) This agreement is intended to be of unlimited duration but either contracting party may terminate it at any time by notifying the other party. (b) Termination shaH take effect three (3) months after date of notification. Article 13: ENTRY INTO FORCE shaH enter into force on the lSth Day This memorandum of understanding of March 2007. Article 14. LANGUAGE OF AGREEMENT. This agreement shaH be in English and in French and shaH have the same interpretation and meaning.
