Friends and Families gathered together on Sunday, February 5th, 2012 to celebrate Super Bowl XLVI. Over 70,000 fans cheered on their favorite Super Bowl team inside Lucas Stadium with an additional 111 Million US viewers watching via television making this Super Bowl the most watched in the history of the United States. An estimated 48 million American fans ordered takeout with 60% of that takeout being pizza. What was your favorite commercial Doritos, Pepsi, or one of the various car ads? My favorite was the one with the grandma using a baby to help steal Doritos from another young grandchild who wouldn’t share with grandma! In 1967 a 30 second Super Bowl commercial cost $37, 500 with popularity growing so has the cost of these infamous commercials. In 2012 a 30 second commercial cost an average of $3.5 million, times have definitely changed! WCGH 28th HOLIDAY REUNION The WCGH 27th reunion was held again at the Café Marquette in the Williams D. Ford Technical Center in Westland on December 6, 2011. About 40 people attended and enjoyed the delicious buffet, the ambiance of the restaurant, and the chance to see former coworkers from the hospital. The crowd was smaller this year even though the weather was good, so we are looking at having a luncheon this year instead of an evening event. At the present time options are being explored and will be announced when a decision is made. 2 ELOISE BOOKS Two books (Eloise and Detroit’s Hospital, Healers and Helpers) containing photos of Eloise, both published by Arcadia, and both by Patricia Ibbotson are available in local bookstores, on-line at www.amazon.com and www.bn.com. The first book Eloise: Poorhouse, Farm, Asylum and Hospital 1839-1984 is also being sold by Jo Johnson as a fundraiser for Friends of Eloise. The cost is $20. It is available in the gift shop at the Westland Historic Village Park on Wayne Road in Westland or by calling Jo Johnson at 734-522-3918. The Eloise book is now in a 10th printing. The hospital book is in a 3rd printing. FRIENDS OF ELOISE Friends of Eloise now has a Facebook page, so if you are on Facebook check it out. Many photos and news articles concerning the history of the Eloise complex and even some of our holiday reunion are on the page. Feel free to add your own photos of leave messages on our page. Over 4,100 of the 7,100 patients buried in the Eloise Cemetery are now on-line on www.findagrave.com. These burial records cover the years 1897-1948 with a gap for the years 1925-1935. I hope you enjoyed the day and spent it with those you love. I couldn’t let this newsletter end with out also letting you know some facts from our offices. The average retiree age is 71.8 but that’s nothing compared to our oldest retiree at 108! The average monthly pension amount for our retirees is $1,832.14. Employee Recognition: Several employees from the Retirement System received awards this year at the County’s Celebration of Excellence. Requirements to be nominated are contributions to Wayne County that go above and beyond the daily requirements of their job. Employees receiving this award have shown sustained performance over a considerable period of time and/or have contributed to a project of major significance to the County. Todd Pickett, Supervisor of Finance Accounting, received an individual award. Our offices also received a team award; this award went to Angela Williams, Nicole Hunter, Rita Williams, Felicia Hollis, Lyn Roberts, Terilla Gee, Ken Motley, Rita Wright, Trudi Gizzi and Andrea Davis. Congratulations and Thank you staff for a job will done Office Closings: Our last newsletter stated that we would be closed two days a month dues to furloughs, this has changed. Due to the new AFSCME contract we will now only be closed once per month, typically the first Monday until further notice. A list of dates the office will be closed is inside. Status Update Regarding the 13th Check Litigation: You may recall that in 2010, the WCERS sued the County and the Wayne County Board of Commissioners, seeking to have the 13th Check ordinance that was enacted on September 30, 2010, to be declared illegal. On September 29, 2011, Judge Sapala ruled in favor of the County declaring the ordinance was legal as written. At the time of our last newsletter, the Judge had not yet ruled on the County’s counter-claim that the WCERS had breached fiduciary duties and committed illegal acts in the management of the 13th Check fund. We can now report that on December 20, 2011, Judge Sapala denied and dismissed these claims by the County. With the entry of the second order, the Wayne County Circuit Court action was completed, enabling WCERS to appeal the first order declaring the ordinance to be legal. The WCERS filed an appeal to the Michigan Court of Appeals on January 6, 2012. The County filed a cross appeal of the second order. What should I do? Answer—Please allow 10 days from the first of the month before reporting a lost check to allow for time delay with the postal service. All checks are dated the first day of the month unless the first is on a Saturday, Sunday, or holiday. Question—My spouse died and he/she was my designated beneficiary to receive my last pension check. Answer—Please make a report of the death by calling (313) 224-5890 or toll free (888) 600-6033. We will request a death certificate; send a new “beneficiary designation form” and process a pension popup (increase of pension monies) if applicable. Question—If I die and have not nominated a last money beneficiary or if my last named beneficiary is also deceased upon my death, what happens with the funds? Answer—In the event of a retiree’s death without a current beneficiary of record to receive last monies due, a person of interest must file to become the Representative of the Estate of the deceased retiree as ordered by Probate Court. There is a cost to file for this request at Probate Court and could be time consuming. It is important to keep all beneficiary information up to date. If you are not sure of your beneficiary, contact this office and a written confirmation will be mailed to your address on file. To protect your privacy, verbal information can not be given over the telephone. Question— I would like to change my Federal tax withholdings, State of Michigan tax withholdings, direct deposit, address, name or last money beneficiary. Answer—If you have internet access you can go to www.wcers.org and select RETIREE FORMS at the top of the page, on the right side there is a list of forms available online. Select the form you need. The suit seeks to require Wayne County to restore the benefits as they existed prior to the change. The individual class representatives are retirees who are receiving health care benefits from the County and who belonged to one of several collective bargaining units. I. PURPOSE OF THIS NOTICE The purpose of this notice is to inform you that at a session of the Wayne County Circuit Court held in Detroit, Wayne County, Michigan on October 5, 2010, it was ordered by the Honorable Wendy M. Baxter that the action entitled Hugh MacDonald et al. v. The County of Wayne , Wayne County Circuit Case No. 09031117-CL, constitutes a Class Action within the contemplation of Rule 3.501 of the Michigan Court Rules of 1985. This notice provides a summary of the lawsuit, describes who is eligible to be included in the Class and the effect of participating in this Class Action, and explains how to request exclusion from the Class. 7 II. DESCRIPTION OF THE LITIGATION Plaintiffs, Hugh MacDonald, Lawrence Verbiest, Gilbert Cox and Michigan AFSCME Wayne County Retiree Sub-Chapter 38 (“Plaintiffs”) brought this lawsuit on behalf of themselves and certain retirees of Wayne County (“County”) on account of the County’s decision to change retiree health care coverage and the cost of prescription drug co-payments. These changes went into effect on or about October 1, 2009. The Defendant, Wayne County, denies any and all wrongdoing or liability to the named Plaintiffs or to the Class, believing it retained the right to modify retiree health care benefits. The Court has made no rulings on the merits of Plaintiffs’ allegations or on Defendants’ denials and defenses, as litigation is still ongoing. Complete copies of the pleadings, orders, and other documents filed in this lawsuit are public records and may be examined and copied at any time during regular office hours at the office of the Clerk of the Court, located at the Coleman A. Young Municipal Center, 2 Woodward Avenue, Detroit, Michigan 48226. III. RELIEF SOUGHT By way of relief of this lawsuit, Plaintiffs seek the issuance of an Order that: IV. A. Requires the County to reinstate the insurance of all those who lost, changed, or reduced their insurance on account of the out-of-pocket expenses; B. Requires the County to reinstate the level of health care and the amount of co-payments that existed prior to the change; C. Requires the County to reimburse retirees who suffered additional payments and continuing such payment for health care during the lives of the class members and those who join the class and their survivors; and D. Requires the County to pay attorney fees and costs. CERTIFICATION OF CLASS October 5, 2010, the Court entered an order certifying the Class and appointing the named Plaintiffs as class representatives. The Plaintiffs’ Class is defined as: 8 Retired employees of Wayne County, who now and immediately prior to retirement, were members of collective bargaining groups, who received health insurance, and who experienced a unilateral change in their benefits in October 2009. This class excluded hearing and vision technicians who Collective Bargaining Agreements gave them the option to subscribe to medical insurance at their own expense. On December 20, 2010, the Court amended the Class to provide for a sub-class defined as: Retired employees of Wayne County, who immediately prior to retirement, were members of collective bargaining groups, who received health insurance, and who retired under collective bargaining agreements referencing the Wayne County Health and Welfare Benefit Plan (effective December 1, 1990), and who experienced a unilateral change in their health insurance benefits on or about October 2009. The sub-class includes surviving spouses and eligible dependents and survivors of its members. You are being notified of this Class Action because records indicate that you satisfy these criteria. To remain a Class Member, you are not required to do anything. VI. YOUR RIGHT TO BE EXCLUDED You have the right to exclude yourself (“opt out”) of the Class. If you do not wish to be a member of the Class, nothing that happens in this proceeding will bind you. To opt out of the Class, you must send a written and signed request to be excluded. At the end of this notice you will find instructions on how to exclude yourself or opt out of the class. VII. FINANCIAL CONSEQUENCES The financial consequences for Class Members are that if the matter is settled for the benefit of Class Members or successfully tried to conclusion in their favor, Class Members’ health care benefits may be reinstated as they existed prior to the October 2009 changes, and Class Members or their survivors may be entitled to compensation for costs incurred as a result of the changes. VIII. NO COUNTER CLAIMS AGAINST THE CLASS No counterclaims have been filed against the Class and there has been no notice to assert any counter claim against the Class. IX. BINDING JUDGMENT The judgment in this Class Action, whether favorable or not, will bind all Class Members who are not excluded from the action. 9 X. RIGHT TO INTERVENE Any member of the Class may seek to intervene personally in this lawsuit. If you wish to do so, you should consult counsel of your own choice to determine the procedure for, and consequence of your intervention as a party in this lawsuit. He knew those grounds like the back of his hand and enjoyed telling stories of his time working there. He celebrated his 100th birthday last June 3rd and spoke fondly of his days working for the County. 12 WAYNE COUNTY EMPLOYEES’ RETIREES CLUB The officers and the members of the Wayne County Employees Retirees Club invite Wayne County Retirees, who are not yet members, to join them. Meetings are held the third Thursday of the month, at 1:30 P.M., in the Kay Beard Building (Eloise), Westland, MI., during the months of January, February, March, April, May, September, October, and December. This IRS notice 1036 can be found at: http://www.irs.gov/pub/irs-pdf/n1036.pdf Retirees are encouraged to review their federal income tax withholding every year; individuals and couples with multiple incomes, people who are having children, getting married, getting divorced, and those who typically wind up with a balance due or large refund at the end of the year may want to consider submitting a new W-4P Form. Publication 919, How Do I Adjust My Tax Withholding?, provides information on making changes to federal income tax withholding.
