TERMS AND CONDITIONS OF BENEFIT SYSTEMS S.A. NEWSLETTER SERVICE 1. These terms and conditions (hereinafter referred to as the "Terms and Conditions ") govern the rules of provision of a service consisting in sending a Newsletter (hereinafter referred to as the "Service") to interested persons (hereinafter referred to as the "Recipients"). 2. The Service is provided by the Benefit Systems spółka akcyjna, a Polish joint-stock company with its registered office in Warsaw at ul. Plac Europejski 2, 00-844 Warszawa, entered in the Register of Enterprises of the National Court Register kept by the District Court for the capital city of Warsaw in Warsaw, 12th Economic Division of the National Court Register, under KRS number 0000370919, with a share capital of PLN 2,584,942.00, tax identification number (NIP): 8361676510, statistical number (REGON) 750721670 (hereinafter referred to as the "Benefit Systems"). 3. As part of its Service, Benefit Systems sends to the e-mail address provided by the Recipient a message containing information, including commercial information about services, promotions, competitions offered by Benefit Systems and its business partners, as well as other commercial information related to the business activity of Benefit Systems (hereinafter referred to as the "Newsletter"). 4. The use of the Service requires having a device with access to the Internet and electronic mail. 5. The Service is available to all Recipients on the website www.kartamultisport.pl and is free of charge, except for any possible costs payable to third parties for User's access to the Internet or electronic mail to the extent necessary to receive the Newsletter. 6. Each Newsletter includes the following information: 1) information about Benefit Systems, 2) the main body (content) of the Newsletter, 3) information about how to change the e-mail address to which the Newsletter is sent, and information about the possibility of unsubscribing from the Service and how to do it. 7. Benefit Systems intends to prepare and send the Newsletter once a month. Benefit Systems can also send the Newsletter with a different frequency, especially if it is justified due to the amount of materials collected in a given period. 8. Using the Service is possible after registration, which consists in the following steps: 1) providing the name, address of residence (city) and the e-mail address of the Recipient using the form provided on the website referred to in clause 5 of the Terms and Conditions, 2) consenting to receiving the Newsletter in accordance with the Terms and Conditions to the e-mail address provided in paragraph 1 above, 3) confirming the correctness of the e-mail address provided by the Recipient and referred to in paragraph 1 above, by clicking on the link sent in the message generated automatically by the Benefit Systems' website. The link is valid for 24 hours. 9. The correct e-mail address of the Recipient and its verification as provided in clause 8 hereof are necessary for the effective conclusion of the agreement for the provision of services by electronic means within the meaning of the Act on the provision of services by electronic means of 18 July 2002 (Journal of laws of 2016, item 1030, as amended) between the Recipient and Benefit Systems, and concerning Service performance. 10. The controller of the personal data of Service Recipients, in particular their e-mail addresses, is Benefit Systems. Personal data are processed in order to provide the Newsletter service, to the extent necessary to provide it in compliance with these Terms and Conditions. 11. Benefit Systems processes the data in accordance with the Personal Data Protection Act of 29 August 1997 (Journal of Laws of Laws of 2016, item 922, as amended). 12. The Recipient has the right to obtain at any time access to his or her data, to request their correction, supplementation or deletion. 13. The Recipient has the right at any time to obtain information on the purposes and scope of the processing of his or her personal data by Benefit Systems. 14. Complaints about the Service provided by Benefit Systems may be filed by: 1) phone by calling the Benefit Systems helpline available at: + 48 22 242 42 42, open 7 days a week, from 7:00 to 22:00 except bank holidays (the rates of telecommunications operators shall apply), 2) contacting us via e-mail at: [email protected]. 15. The complaint should include: 1) the e-mail address referred to in clause 8(1) hereof, 2) description of the case which is the subject of the complaint, 3) the e-mail address or address for service to which the answer to the complaint should be sent. 16. Benefit Systems may ask the User additional questions to correctly determine the circumstances which are the cause of the complaint. 17. Benefit Systems considers the complaints without undue delay but not later than within fourteen (14) days of the date of receiving full information needed for complaint consideration – taking into account clause 16 above. 18. The agreement for Service provision is concluded for an indefinite period. The Recipient wishing to unsubscribe from the Service provided by Benefit Systems may terminate the agreement at any time by clicking on the active link reading "Unsubscribe" provided in each message containing the Newsletter. 19. Benefit Systems reserves the right to cease providing the Service if it breaches the provisions of these Terms and Conditions, provides unlawful content or otherwise violates generally applicable law. 20. Benefit Systems reserves the right to amend these Terms and Conditions. If any changes are introduced to these Terms and Conditions, Benefit Systems will inform its Recipients about them within 14 days of the date of their introduction by sending the relevant information to the e-mail address referred to in clause 8(1) hereof. Any and all changes to these Terms and Conditions enter into force on the date specified in the message referred to in the preceding sentence, however not sooner than after 7 days of the date of sending the messages about the changes.
