There was no one in attendance either in support of or in opposition to the request. The Community Planning Department made the following written comments: The subject lands are designated “General Commercial” by OPA No.350, as amended by OPA No 513. The applicant has submitted a variance application to permit the construction of an outdoor patio serving a free standing eating establishment. The applicant is requesting that the patio area not be included in the parking requirement calculation. The By-law requires that the patio area be included in the parking requirement calculation. The patio use is permitted by the By-law. Norwood Plaza Inc. has requested the Building Standards Department for an interpretation of By-law 1-88 in relation to uses and the amount (percentage) of eating establishment, which could be permitted on the site. Building Standard Department is reviewing this issue to formula their response. The response may effect how the parking requirement and the number of spaces are calculated for this development. The outcome of this interpretation could affect the Community Planning Department assessment and opinion of this proposed variance request. Further to this issue, the Community Planning Department has been informed that the applicant has submitted Variance Application A152/04 requesting to permit 23.83% of the shopping centre to be occupied by Eating Establishments. This is directly related the issue that the Building Standards Department has been requested to interpret. Further, with the submission Variance Application A152/04, it is recommended that Variance Application A114/04 be adjourned and be considered together with Variance Application A152/04 in a comprehensive manner.
