IN THE SUPREME COURT OF BRITISH COLUMBIA TO: THE QUEEN'S HOST EXCELLENT MAJESTY TO WIT: THE HUMBLE PETITION of ALLAN HERBERT HULL of 1311 Beach Avenue, in the City of Vancouver, in the Province of British Columbia, SHEWETH THAT: On April 24th 1952, Corporal 0. Mottishaw a game warden at the City of Nanaimo, in the Province of British Columbia employed by the Game Department of the Province of British Columbia, took possession of a double barrel shotgun Serial Number B7308 manufactured by Gibbs of London and Bristol; the aforementioned shotgun was the property of your suppliant Allan H. Hull and had been stolen from his cottage at Qualicum Beach some time during the period April 5th 1952 and April 24th 1952. Corporal O. Mottishaw seized the shotgun above-mentioned from one Sheppard who was carrying it without a license or permit. On applying to the game office for return of the shotgun, your suppliant was informed that it could not be produced as it had been stolen from the office of the game warden at Nanaimo some time during the week-end of May 3rd 4th 1952. Up to the present date the shotgun has not been recovered. The shotgun was purchased in 1944 for $180.00 and was in first class condition when stolen and your suppliant has been informed by the representative of Gibbs & Co. in Canada that the shotgun cannot be replaced for $300.00. A L. It has been established at a recent trial of Sheppard in the County Court in Nanaimo held on September 12th 1952 that the shotgun seized by Corporal Mottishaw was the shotgun stolen from your suppliant's dwelling at Qualicum Beach and that it was in truth the property of your suppliant Allan H. Hull. It has further been established that the Game Department of the Province of British Columbia are now unable to return the shotgun to the rightful owner, Allan H. Hull. YOUR SUPPLIANT THEREFORE HUMBLY PRAYS that your Majesty will be pleased to do what is right and just in the premises and cause your suppliant to be re-imbursed and compensated for loss so sustained by him as aforesaid.
