ACTS, 1965. — CHAP. 548. 323 in a conspicuous place in the city hall the names and residences of the candidates for nomination who have duly qualified as candidates for nomination, as they are to appear on the official ballots to be used at the preliminary election, and shall cause the ballots which shall contain said names, on which the names of candidates for nomination to an office of which they are the elected incumbents shall be placed first in alphabetical order with the names of other candidates following in like order, and no others, with a designation of residence, and of the office and term of service; to be printed, and the ballots so printed shall be official and no others shall be used at the preliminary election. Blank spaces shall be left at the end of each list of candidates for nomination for the different offices equal to the number to be nominated therefor, in which the voter may insert the name of any person not printed on the ballot for whom he desires to vote for nomination for such office. There shall be printed on such ballots such directions as will aid the voter, as, for example: "vote for one", "vote for two", and the like, and the ballots shall be headed as follows: — OFFICIAL PRELIMINARY BALLOT. Candidates for nomination for the offices of ( ) in the city of at a preliminary election to be held on the day of in the year nineteen hundred and (The heading shall be varied in accordance with the offices for which nominations are to be made.) SECTION 2. This act shall take effect upon its acceptance by the city of Springfield. Approved June 14, 1965. Chap. 548. A N ACT AUTHORIZING THE TOWN OP MARBLEHEAD TO ACQUIRE AND ADMINISTER THE PROPERTY OF A CEMETERY LOCATED THEREIN, KNOWN AS HARBOR VIEW CEMETERY. Be it enacted, etc., as follows: SECTION 1. Notwithstanding any general or special law to the contrary, the town of Marblehead is hereby authorized to take by eminent domain or acquire by purchase, gift or otherwise, title to certain land in said town used as a private cemetery and known as the Harbor View Cemetery, bounded and described as follows: — Northeasterly and northwesterly by land now or formerly of Looney; southeasterly by land now or formerly of Wyman; and southwesterly by Cemetery Road and land now or formerly of said Looney; and thereafter to hold and maintain said land, for cemetery purposes, subject to all rights heretofore existing in any burial lots located within said cemetery, and upon the acquisition of said land, said cemetery shall be and become a public burial ground, place or cemetery. SECTION 2. In so far as authorized by a decree of a court of competent jurisdiction and in compliance with the terms and conditions of such decree, said town may receive all funds or other property held in trust for the perpetual care of the lots in said cemetery and for other purposes, and also any property devised or bequeathed to said cemetery under the will of any person living at the time of said acquisition or under the will of any deceased person not then probated. Interest and dividends accruing on funds deposited, or funds deposited, in trust with any savings 324 ACTS, 1965. — CHAPS. 549, 550. bank as authorized by law, or with any other banking institution, for the benefit of said cemetery, or any burial lot therein, may, after the acquisition by the town, be paid by such bank or institution to the treasurer of said town; and upon such payment said treasurer shall use the same for the purpose of said trusts. SECTION 3. All property and property rights acquired by said town, under authority of this act, shall be held and managed by said town in the same manner in which cities and towns are authorized by law to hold and manage property for cemetery purposes; provided, that all rights which any persons have acquired in said cemetery or any lots therein shall remain in force to the same extent as if this act had not been passed and such acquisition had not occurred. Any records of said cemetery received by the town shall be delivered to the clerk of said town and he may certify copies thereof. SECTION 4. This act shall take effect upon its acceptance by the town of Marblehead. Approved June 14, 1965. Chap. 549. A N ACT PROVIDING A MANDATORY JAIL SENTENCE FOR THE SECOND CONVICTION OF CERTAIN OFFENCES INVOLVING THE USE OF A TELEPHONE FOR GAMING PURPOSES. Be it enacted, etc., as follows: SECTION 1. Chapter 271 of the General Laws is hereby amended by striking out section 10, as amended by section 1 of chapter 390 of the acts of 1957, and inserting in place thereof the following section: — Section 10. Whoever, within five years after being convicted of any offence mentioned in sections seven, eight, nine, seventeen and seventeen A, commits the like offence, or any other of the offences therein mentioned, shall, in addition to the fine therein provided, be punished by imprisonment for not less than three months nor more than one year, and the sentence imposing such fine and such imprisonment shall not be suspended. SECTION 2. The provisions of section ten of chapter two hundred and seventy-one of the General Laws, as amended by section one of this act, shall apply to second convictions for offences mentioned therein which are committed subsequent to the effective date hereof; and the provisions of said section ten of said chapter two hundred and seventyone as in effect immediately prior to said effective date shall continue to apply to second convictions for such offences as were committed prior to said effective date. Approved June 14, 1965. Chap. 550. A N ACT PROVIDING FOR TWO ADDITIONAL COURT OFFICERS FOR THE FOURTH DISTRICT COURT OF EASTERN MIDDLESEX. Be it enacted, etc., as follows: Chapter 218 of the General Laws is hereby amended by striking out section 62, as most recently amended by chapter 699 of the acts of 1964, and inserting in place thereof the following section: — Section 62. In the municipal court of the city of Boston the court officers appointed shall not exceed ten for criminar business, one of whom shall be designated by the chief justice as chief court officer of said court for criminal
