The removal of the original door, door frame, and ironmongery and installation of “UPVC”
replacement door, door frame and ironmongery in the western elevation.
The removal of the original window and installation of two replacement timber windows on the
eastern elevation.
The excavation of part of the garden immediately adjacent to the building, resulting in the exposure
and partial destruction of a brick built cellar structure, jeopardising the structural integrity of the rear
wall on the northern elevation.
The construction of block work walls on new foundations.
Summary of Requirements of the Notice:

Remove the UPVC door, its frame and ironmongery in the western elevation and reinstate the
original or if the original has been destroyed an oak door and frame made to match the existing
original doors in the other elevations.
Remove the replacement timber windows and frames and replace with a single window made to
match both in design and materials the existing original windows on the other elevations.
Completely demolish the new block work walls and permanently remove all blocks and associated
rubble from the land.
Commission a structural survey of the building by a qualified building surveyor or structural engineer
and carryout all remedial structural repairs resulting from exposing the foundations on the northern
elevation of the property.
Backfill the excavated area with chalk, finish with 18inches [46cm] of topsoil and seed with grass to
match the grass existing on the property.

Reinstate the original timber conservatory or if the original has been destroyed an oak timber
conservatory to match the original timber conservatory.
Rebuild the partly destroyed brick built cellar structure using identical mortar and the original bricks
or identical bricks if the originals are no longer on site, reinstate the original cellar manhole cover in
its original position and restore to working order.
Information on any postponement of the date on which the Notices takes effect by reason of section
175(4) of the Act (a) (Appeal to the Secretary of State).

THIS NOTICE is issued by the Council because it appears to them that works
have been executed to a listed building in a manner that would affect the character of
the building as building of special architectural or historic interest, that the works were
not authorised and were in contravention of section 9( 1) of the above Act, at the land
described below. They consider that it is expedient to issue this notice, having regard to
the effect of the works on the character of the building as one of special architectural or
historic interest the provisions of the development plan and to other material planning
considerations. The Annex at the end of the notice and the enclosures to which it refers
contain important additional information.

THE LAND TO WHICH THE NOTICE RELATES
Octagon Cottage, [ also known as Octagon Lodge] Hogs Back, Seale, Farnham, Surrey,
GU1 0 1HE shown edged by a heavy black line on the attached plan and registered at H
M Land Registry under title number SY144892.

THE WORKS WHICH APPEAR TO BE IN CONTRAVENTION OF SECTION
9(1)

The demolition and removal of a timber conservatory previously situated on the

REASONS FOR ISSUING THIS NOTICE
The unauthorised works detract from the character and setting of the building, do not
respect and enhance the original architecture, scale, materials, and other significant
features of the building and where planning permission is required do not conform to
Local Plan policy HE1 (Proposals which affect listed buildings)

WHEN THIS NOTICE TAKES EFFECT
This notice takes effect on 31st of May 2004 unless an appeal is made against it
beforehand.

ANNEX YOUR RIGHT OF APPEAL
You can appeal against this notice, but any appeal must be received, or posted in time
to be received, by the Secretary of State before the date specified in paragraph 7 of the
notice. The enclosed booklet "Enforcement Notice Appeals -A Guide to Procedure" sets
out your rights. You may use the enclosed listed building I conservation area appeal
forms.
(a)
One is for you to send to the Secretary of State if you decide to appeal, together
with a copy of this enforcement notice.
(b)
The second copy of the appeal form and the notice should be sent to the Council.
(c)
The third copy is for your own records.
WHAT HAPPENS IF YOU DO NOT APPEAL
If you do not appeal against this listed building enforcement notice, it will take effect on
the date specified in paragraph 7 of the notice and you must then ensure that the
required steps for complying with it, for which you may be held responsible, are taken
within the period specified in paragraph 6 of the notice. Failure to comply with an
enforcement notice which has taken effect can result in prosecution and/or remedial
action by the Council.
