Guidance Note 3
Buildings that do not need Building Regulations approval
This leaflet provides a summary of some common types of buildings that do not need Building Regulations
approval. If you need any clarification please phone us before you start building work.
Extensions that do not need Building Regulations approval:
An extension at ground level with a floor area of no more than 30 sq. metres, which is either:
1.
A covered yard or covered way;
2.
A carport open on at least two sides;
3.
A verandah or loggia; or
4.
A conservatory or porch.
Note: A conservatory has substantially glazed walls and roof. Please refer to guidance note 4
(Conservatories and Porches) for full details.
Also, for conservatories and porches, glazing within the shaded area in diagram 1 & 2 must:



If broken, break in a way that will not cause injury, or
Resist impact without breaking; or
Be shielded or protected from impact.

Detached buildings that do not need Building Regulations approval:
1. Agricultural buildings- (including buildings used for horticulture, fruit growing, the growing of plants
for seed and fish farming, but not those buildings used for retailing, packing or exhibition), as long as:
a) no part of the building is used as a house or flat;
b) no part of the building is less than one and a half times its height from any part of another building
which contains sleeping accommodation;
c) the building is provided with a fire exit no more than 30 metres from any point within the building.
2. Greenhouses – unless they are used for retailing, packing or exhibiting.
3. Temporary buildings – if it will be used for less than 28 days.
4. Mobile homes – within the meaning of the Mobile Homes Act 1983, but not their drainage.
Detached garages, sheds and outbuildings that do not need Building Regulations
approval:
The building does not need Building Regulations approval providing:
a)
b)

The building is single storey; and
The building does not contain sleeping accommodation; and
The building has a floor area (measured internally) no greater than 30 square metres; and
No part of the building is less than 1 metre from any boundary or the building is built substantially
of non-combustible materials.
or
a) the building is single storey; and
b) has a floor area (measured internally) no greater than 15 square metres; and
c) the building contains no sleeping accommodation
