The Council of the City of Wakefield Waste Management PFI Project
This document provides a list of redactions to the Project Agreement, which have
been made by the Council in accordance with the Environmental Information
Regulations 2004.
The Council has had regard to the exceptions contained in Regulation 12(5) and
considers that the following exceptions are potentially applicable:
(a) Regulation 12(5)(e) as the disclosure could adversely affect the confidentiality of
the commercial or industrial information where such confidentiality is provided by
law to protect a legitimate economic interest; and
(b) Regulation 12(5)(f) as the disclosure could adversely affect the interests of the
person who provided the information where the information was given voluntarily
and where the supplier of the information was under no legal obligation to supply it to
the Council and it was supplied in circumstances which do not entitle the Council to
disclose it.
Having established that the above exceptions may be applicable the Council has gone
on to consider the public interest test in accordance with Regulation 12(1) and has
concluded that in respect of the following redactions the public interest in maintaining
the exception outweighs the public interest in disclosing the information.
Where appropriate a timescale for the future disclosure of the redacted information is
specified. Where no such timescale is specified the information is to remain redacted
for the duration of the Contract (25 years) unless that information is brought into the
public domain by another means.
