A n Act to sanction t h e construction of a line of
railway from T e m o r a to W y a l o n g ; to a m e n d
t h e provisions of t h e Public W o r k s Act, 1900,
so far as t h e y relate to t h e d u t y of t h e
Constructing' A u t h o r i t y to m a k e and main­
tain fences along t h e said line ; to authorise
t h e c o n s t r u c t i o n of t h e said line on public
roads ; and for o t h e r purposes. [21st Novem­

H E R E A S , in a c c o r d a n c e w i t h t h e provisions of t h e P u b l i c
"Works A c t , 1900, t h e L e g i s l a t i v e A s s e m b l y did, b y resolu­
tion, declare t h a t it was e x p e d i e n t to carry o u t a c e r t a i n work, n a m e l y ,
t h e c o n s t r u c t i o n of a line of railway from T e m o r a to W y a l o n g : A n d
w h e r e a s on t h e passing of t h e said resolution a s t a t u t o r y d u t y was b y
t h e said A c t imposed on t h e Secretary for P u b l i c Works to i n t r o d u c e
a Bill i n t o t h e said Assembly to sanction t h e c a r r y i n g o u t of t h e said
work:
B e it therefore e n a c t e d by t h e K i n g ' s M o s t E x c e l l e n t
M a j e s t y , by a n d with the advice a n d c o n s e n t of t h e L e g i s l a t i v e
Council a n d Legislative A s s e m b l y of N e w S o u t h W a l e s in P a r l i a m e n t
assembled, a n d by t h e a u t h o r i t y of t h e same, as follows :—
1. This A c t may be cited as t h e " T e m o r a to W y a l o n g R a i l w a y
Act, 1901."
2. T h e c a r r y i n g out of t h e said w o r k (more p a r t i c u l a r l y
described in t h e Schedule to this A c t ) is h e r e b y s a n c t i o n e d ; a n d t h e
Secretary for P u b l i c W o r k s , or t h e M e m b e r of t h e E x e c u t i v e Council
for t h e t i m e b e i n g p e r f o r m i n g the duties of t h e said Secretary, is
h e r e b y a u t h o r i s e d to u n d e r t a k e a n d c a r r y o u t t h e said w o r k , subject
to t h e provisions of this A c t , a n d for t h a t p u r p o s e shall be, a n d shall
h a v e t h e powers a n d duties of, a C o n s t r u c t i n g A u t h o r i t y within t h e
m e a n i n g of t h e P u b l i c W o r k s Act, 1900.
3. T h e p l a n of t h e said w o r k is t h e p l a n m a r k e d " T e m o r a to
W y a l o n g R a i l w a y " signed by t h e Secretary for P u b l i c W o r k s a n d
c o u n t e r s i g n e d b y t h e Engineer-in-Chief for R a i l w a y Construction, a n d
deposited in t h e p u b l i c office of t h e said Secretary.
4. T h e cost of c a r r y i n g out t h e said work, e s t i m a t e d at one
h u n d r e d a n d t w e n t y - s i x t h o u s a n d e i g h t h u n d r e d a n d ten p o u n d s , m a y
be
be defrayed from s u c h L o a n V o t e s as a r c n o w or m a y hereafter be
a p p l i c a b l e to t h a t purpose, a n d shall n o t u n d e r a n y c i r c u m s t a n c e s
exceed t h e e s t i m a t e d cost b y m o r e t h a n t e n per c e n t u m .
5. N o t w i t h s t a n d i n g t h e provisions of section e i g h t y - f o u r of t h e
P u b l i c W o r k s A c t , 1900, t h e C o n s t r u c t i n g A u t h o r i t y shall n o t be
r e q u i r e d n o r compelled n o r shall it b e t h e d u t y of t h e said A u t h o r i t y
t o m a k e or m a i n t a i n a n y fence a l o n g t h e said line of r a i l w a y for t h e
a c c o m m o d a t i o n of a n y person or for a n y purpose; w h a t s o e v e r ; b u t t h e
said A u t h o r i t y m a y , in its discretion, m a k e a n d m a i n t a i n s u c h fences
in connection with t h e said line of railway as it m a y t h i n k fit.
6. T h e said line of railway m a y be c o n s t r u c t e d on or along or
b y t h e side of a n y p u b l i c road or h i g h w a y .

Railway,
This line is a n e x t e n s i o n of the C o o t a m u n d r a to T e m o r a B r a n c h Railway, and
begins a t two h u n d r e d a n d n i n e t y - o n e miles s i x t y - t h r e e chains fifty-four links from
Sydney, and proceeds n o r t h n o r t h - w e s t e r l y o c c u p y i n g with t h e exception of a b o u t a
mile, n e a r t h r e e h u n d r e d miles, one side of t h e main road t o W y a l o n g , passing t h e
m i n i n g township of T r u n g l y a t t h r e e h u n d r e d a n d five miles, to within a b o u t f o u r and a
half miles of H a r m e d m a n , w h e r e it diverges slightly to the n o r t h , crossing t h e m a i n
road, and passing t h a t t o w n s h i p o n its w e s t e r n s i d e ; it t h e n adjoins t h e w e s t e r n side
of t h e m a i n r o a d t o a b o u t t h r e e h u n d r e d and t h i r t y - o n e miles, h e r e t h e line bends
w e s t w a r d passing s o u t h of W y a l o n g , a n d ends a t t h e s o u t h e r n side of W e s t W y a l o n g at
t h r e e h u n d r e d a n d t h i r t y - t h r e e miles t h i r t y - o n e chains fifty-four links from Sydney ;
being a total distance of forty-one miles forty-eight chains, and subject t o such deviations
and modifications as may be considered desirable by t h e C o n s t r u c t i n g A u t h o r i t y .
