“Catch-All” Letter Frequently Asked Questions Why did I receive the Catch-All letter? This letter was sent out by New Mexico Department of Health/Developmental Disabilities Support Division DOH/DDSD based on a court-approved settlement to inform individuals/guardians of the steps they needed to take if they felt they experienced a loss or reduction in services and wished to restore these services. Who does the letter apply to? This letter was sent to individuals (and their guardians) who were 18 years or older and enrolled in the DD Waiver Program as of November 1, 2012. Who doesn’t the letter apply to? This letter does not apply to children, Jackson Class members, new allocations after November 1, 2012 and people who are currently participating in the Mi Via Waiver. Can Mi Via Participants who transferred to Mi Via from the DD Waiver program restore perceived lost services? If you are a Mi Via participant who was previously enrolled in the DDW program you can chose to transfer back to the traditional DDW using your previous SIS and NM DW group assignment if it is less than three years old. Your case manager will submit the ISP and budget to the Outside Reviewer or submit to the TPA prior to the operation of the Outside Reviewer. If you have experienced a change in condition you may wish to request a SIS reassessment through the DDSD prior approval process. What does this letter mean for me? If you feel that you lost any services or had services reduced because of your placement in your DD Waiver Group, you can have these previous services restored temporarily through the end of your current Individual Service Plan (ISP) term. What do I need to do? If you feel you lost services or experienced a reduction in services because of your placement in a DDW group, contact your case manager within 30 days of the date of the letter to review this letter and the level of services you were receiving in November, 2012. If you feel you lost or had a reduction in services and wish to have those services restored, you must contact your case manager within 30 days of the date on the letter. Your case manager must notify the DDSD Regional Office no later than August 17, 2015 to confirm your status for these restored services. All budget revisions must be completed and sent to the Medicaid Third Party Assessor by case managers no later than August 31, 2015. Which services will be restored? Any service you feel you may have lost or was reduced because of your placement in a DDW group after November 1, 2012 can be restored. A new Family Living procedure code and budget worksheet has been distributed to case managers in order to restore substitute care services. Regional offices will handle Medical and Behavioral Outlier services on a case-by-case basis. Regional office staff will verify the current DDW services are equivalent to the request for service restoration from November 2012. How long will services be restored? Restored services will remain in effect until either, (a) your next ISP and budget have received final approval or (b) the final resolution of any fair hearing or appeal. When do I need another Supports Intensity Scale ® (SIS) assessment? Your current SIS assessment and NM DDW Group assignment should be used when planning and submitting your budget to the Outside Reviewer at your next ISP and annual ISPs thereafter, until your SIS and NM DDW Group assignment is expired according to the standard three- year cycle.
