Secondhand Smoke Laws and Policies Secondhand Smoke laws and policies prohibiting smoking have been passed to protect non-smoking individuals from secondhand smoke. Workplaces (California Labor Code Section 6404.5): It is against the law to smoke in an enclosed space at a place of employment. Public Buildings (California Government Code Section 7596-7598): Smoking is prohibited inside a public building, which is a building owned and occupied, or leased and occupied, by the state, a county, a city, or a California community college district. Smoking is prohibited in an outdoor area within 20 feet of main exits, entrances, or windows of a public building. Cars (California Health and Safety Code Sections 118947–118949): It is illegal to smoke any cigarette, pipe or cigar in a car with a minor regardless of whether the vehicle is parked or in motion. The fine is $100 per violation. Parks and Playgrounds: Tot Lot Law (California Health and Safety Code Section 104495): No disposals of cigarette butts or smoking of tobacco products within 25 feet of a playground or tot lot sandbox area. Parks are smoke-free in the cities of Fountain Valley, Huntington Beach, Irvine, Laguna Hills, Laguna Woods, Newport Beach, San Clemente, Santa Ana, and Seal Beach. Theme Parks: Disneyland has designated smoking areas. Knott’s Berry Farm has designated smoking areas. Beaches: Smoking is not allowed on city beaches in Huntington Beach, Laguna Beach, Newport Beach, San Clemente, and Seal Beach. As of January 2014, all University of California (UC) campuses, medical centers, and laboratories are 100% smoke and tobaccofree. A “Smoke-Free” campus does not allow inhaling, exhaling, burning, or carrying any lighted or heated cigarette, pipe or device intended for inhalation. A “Tobacco-Free” campus does not allow the use of any tobacco product, including oral tobacco (spit and spitless, smokeless, chew, snuff). 100% Tobacco-Free University in Orange County University of California, Irvine (UCI) 100% Smoke-Free Universities and Colleges in Orange County: California State University Fullerton (CSUF) Fullerton Community College (FCC) Smoking Policies at other Orange County Colleges: Coastline – Smoking is prohibited within 20 feet of a main exit, entrance or operable window of a campus building. Cypress – Smoking is prohibited within 20 feet of a main exit, entrance, or operable window of a campus building. Golden West – Smoking is only allowed in campus parking lots. Irvine Valley – Smoking is prohibited within 25 feet of campus buildings. Orange Coast – Smoking is prohibited within 20 feet of a main exit, entrance, or operable window of a campus building. Types of Cessation Services: Saddleback – Smoking is prohibited within 25 feet of campus buildings. Individual Counseling Seminars 5 Session Classes Santa Ana – Smoking is only allowed in parking lots that are at least 100 feet from the Santa Ana College campus.
