REPORT OF THE EXECUTIVE DIRECTOR OF COMMERCIAL DEVELOPMENT REGULATORY COMMITTEE – 20 JULY 2015 LOCAL GOVERNMENT (MISCELLANEOUS PROVISIONS) ACT 1982 APPLICATION FOR GRANT OF CONSENT TO TRADE IN A DESIGNATED AREA ON THE EAST SIDE OF HAY STREET AT ITS JUNCTION WITH MILLENIUM WAY, SUNDERLAND. Mr Peter Allison 1.0 PURPOSE OF THE REPORT 1.1 To consider an application from Mr. Peter Allison for the grant of consent to trade in a designated area in respect of a site situated on the east side of Hay Street at its junction with Millenium Way, Sunderland. 2.0 DESCRIPTION OF DECISION (RECOMMENDATION) 2.1 The Committee is recommended to consider delegating to the Executive Director of Commercial Development the power to grant Mr. Allison’s consent to trade at the location described at paragraph 1.1 above. 3.0 INTRODUCTION/BACKGROUND 3.1 The site is located in an area that has been designated by the Council as a consent street for street trading purposes under Part III and Schedule 4 of the Local Government (Miscellaneous Provisions) Act 1982. The Council has discretion to grant such consent “if it thinks fit”. 3.2 The application is to trade any day upon which a football game is to be played at the Stadium of Light. The proposed hours of trading commence two hours before kick - off and end two hours after the end of the game. 3.3 The applicant proposes to use the site for the sale of roast sandwiches, roast potatoes, burgers and hotdogs. 4.0 CURRENT POSITION 4.1 Mr. Allison has applied to renew his consent to trade at a location in Hay Street which he has occupied for five years. This current site is situated on the east side of Hay Street 18.7 metres south of its junction with Brooke Street. He intends to continue trading at this site 4.2 The site requested in Mr. Allison’s new application, if granted, would be shared with a unit selling confectionary. As a result of consultation with Network Operations, a site visit was carried out whereby it was confirmed that the site is suitable for both Mr. Allison’s unit and the confectionary unit without impinging upon pedestrian movement. A plan showing this site is attached as Appendix 1. 5.0 REASONS FOR THE DECISION 5.1 Paragraph 7 of Schedule 4 of the Local Government (Miscellaneous Provisions) Act 1982 allows the Council to grant consent if it sees fit to do so.
