ORDINANCE NO. 12- 13 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TREASURE ISLAND, FLORIDA, LAND DEVELOPMENT REGULATIONS AMENDING CHAPTER 68, LAND USE, ARTICLE VII, SUPPLEMENTARY LOT AND USE REGULATIONS, DIVISION 2, LOT REGULATIONS, SECTION 68- 466 LIGHTING; PROVIDING FOR SEVERABILITY, CONFLICT, CODIFICATION, AND AN EFFECTIVE DATE. WHEREAS, the City of Treasure Island Planning and Zoning Board, sitting as the Local Planning Agency wishes to update the technical codes identified in the City' s Land Development Regulations as those pertaining to lighting within the community; and WHEREAS, the Local Planning Agency utilized a Lighting Subcommittee of their members to review the existing Ordinance language, conduct field work and take lighting readings at specific locations within the community; review ordinances from other communities, and to contact Progress Energy to obtain input on current lighting standards; and WHEREAS, after a series of Lighting Subcommittee meetings and continual informational updates from the Lighting Subcommittee to the Local Planning Agency; the Local Planning Agency reviewed the proposed changes to the Section 68-466 of the Land Development Regulations of the City; and WHEREAS, the Planning and Zoning Board, sitting as the Local Planning Agency, wishes to the passage of the proposed amendments to Section 68- 466, Lighting of the Land recommend Development Regulations and further finds that such amendments are consistent with the adopted Comprehensive Plan and related elements of the City of Treasure Island, Florida; and WHEREAS, the City Commission concurs with the findings and recommendations of the Planning and Zoning Board, sitting as the Local Planning Agency regarding the proposed amendments to Section 68-466, Lighting. NOW, THEREFORE, THE CITY COMMISSION OF THE CITY OF TREASURE ISLAND, FLORIDA DOES ORDAIN: SECTION 1: Chapter 68, Land Use, Article Lot Regulations, Section 68- 466 " Lighting", 2, VII, Supplementary Lot and Use Regulations, Division of the City of Treasure Island Land Development Regulations, is hereby amended to read as follows: Section 68- 466. Lighting. This section is intended to ensure that all new development and existing developments construct lighting that does not adversely impact neighboring properties. All outside lighting, except street lighting), lamps, bulbs, lights, dock lighting, and security lighting producing artificial light from all single- family, multifamily, retail, office, tourist trade, and other structures which shine or reflect or maintain outdoor light onto or into neighboring properties or residences so as to annoy or disturb the persons inhabiting such neighboring residences is hereby declared to be a nuisance and is unlawful and prohibited. 1) All exterior lighting shall be installed in such a manner and shielded that the cone of light Page 1 of 3 Residential Single Family. In all other respects, the provisions of Chapter 68 of the Land Development Regulations of the City of Treasure Island, Florida not hereby amended or modified shall remain in full force and effect. SECTION 3. SEVERABILITY. It is declared to be the intent of the City Commission that, if any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portions thereof. SECTION 4. CONFLICT. This action supersedes all codes and ordinances of the City or parts of, in conflict with this ordinance, to the extent of the conflict. SECTION 5. CODIFICATION. Section 1 of this ordinance shall be codified in the Land Development Regulations for the City of Treasure Island, Florida.
