European Regulation and Directives

European Regulation and Directives
European regulations for articles and materials that come into contact with foodstuffs are based on the framework
directive EC No. 1935/2004, which sets forth the basic documentary and testing requirements. The directive is
supplemented by other directives (and their amendments) related to material groups, including the following:
• Positive lists of authorised substances
• Special conditions for use of these sunstances
• Basic rules for checking compliance
• Overall migration limit of constituents into or onto foodstuffs
• Specific migration limits of certain constituents into or onto foodstuffs
Furthermore, EC Directive 76/769/EEC, which relates to restrictions on the marketing and use of certain dangerous
substances and preparations and its amendments, are applied to all articles and materials that come in contact with
foodstuffs

The LFGB provides a framework of mandatory
requirements that control commodities, coming into
contact with food.
• § 30 LFGB - Prohibits manufacturing, marketing and
treatment of commodities coming into contact with
food and human skin or mucus membranes and
endanger human health through the transmission of
toxic substances or impurities
• § 31 LFGB - Prohibits marketing of commodities
that come into contact with food and human skin
or mucus membranes and releases substance
into foodstuffs or on their surfaces, except at
physical and Sensorial levels, that are harmless and
technically unavoidable
• § 33 LFGB - Prohibits usage of misleading labeling on
commodities and their packaging
Germany’s Bfr (Bundesinstitut fur Risikobewertung)-(The
federal Institute for Risk Assessment) is regarded as the
leading authority for evaluating plastic materials. Its
recommendations represent the present state of the art
wherever the LFGB is not specific enough.
• For the German market, German hazardous
Chemicals laws are applied. The tests cover all kind
of material; even the product is fabricated with the
most up-dated manufacturing technology. TÜV
Rheinland will perform testing to detect its toxicity.
e. g. Temperature resistance coating (PTFE) on the
cooking pan, and silicone rubber ring for sealing the
water kettle test.
Generally, LFGB § 30, 31 and 33 contain the following
testing clauses:
• General manufacture and materials
• Sensorial examination: the transfer of smell, taste
from product to the food
• Plastic - migration test & extractable heavy metal test
• Silicones – Migration / Volatile organic compounds
• Metal - composition & extractable heavy metal test
• Specific material
• Other- other materials or applications for
specificrequirements
