Session Laws 2012‐136, §§ 6 and 8; 2013‐154 § 5.(d)
Complaint is a “facial challenge to the constitutionality of the three provisions of the law: Session Laws 2012‐136, §§ 6 and 8; 2013‐154 § 5.(d)…which first narrowed and then repealed the North Carolina Racial Justice Act (RJA).” Plaintiffs claim the lawsuit “asks whether the state and federal constitutions permit the General Assembly to enact repeal provisions expressly designed to revoke grounds for relief which arose and were granted before the repeal went into effect.” Walton, Helen A. v.
