Also present: Council President Michael Killeen: Council members Lynda Appel, Ken Brady and Mark Getsay; Engineering Director Bob Kelly, Rick Benos from Arcus Group and Dean Mueller. The meeting convened at 6:35 p.m. I. Discuss request of Dean Mueller to allow a temporary water and sewer connection to a proposed private automobile/clubhouse building at the end of Hilliard Boulevard located in Avon. Mr. Kelly spoke as to using a 6-inch gravity connection tie into Westlake. This has been done in other instances according to Mr. Kelly. There is nothing abnormal and no problems here. We already have access rights and assurity in place that this would all be done at no cost to the city and the customer would be responsible for properly plugging off when use is over. Mr. Kelly said this creates no capacity issues to our system and had no concerns or issues. There is a county line ditch and driveway access from Westlake to the site. We do normal maintenance to this county ditch area. Mr. Mueller spoke that this site would be for a 37.000 square foot building to store his collectible cars. The site is located on Avon and Westlake property with the majority of the land in Avon. Mr. Mueller states he will pay all expenses and is committed to give the land to Westlake/Avon for an eventual park site. Mr. Getsay wanted to make sure the driveway off Hilliard Boulevard was maintained and make sure we had easement access and if there was any service concerns. Mr. Brady wanted to know if it was Cleveland water or Avon water. It is Cleveland water. Mr. Killeen said this is similar to what was done in the 50"s and 60?s. What is the advantage for Westlake? Mr. Killeen required a 1-foot deed to assure Westlake's interest. Mr. Mueller had no objection and agreed to deed a strip of land to Westlake. Mr. O'Donnell stated this was being done now and used the example of Rue 254 restaurant and Avon Oaks Country Club. Mr. Sullivan wanted to ensure Mr. Mueller was required to pay all costs and meet any EPA requirements. Mr. Nunnari asked about a timeline, and there was not a timeline to get off the Westlake system. This could happen years down the road. 440.617.4089 A motion was made by Mr. O'Donnell, seconded by Mr. Sullivan, to have the law department draft legislation to allow temporary water and sewer connection to the property proposed by Dean Mueller at the end of Hilliard Boulevard (old Johnson land) in Avon with the condition of a 1-foot reserve strip between the public right-of-way and ^% ' Hilliard Boulevard and the review and approval ofthe agreement between the applicant and Avon and Westlake legal counsel.
