JUDGES' PENSIONS AND EQUITY (AMENDMENT)
ACT.
Act No. 52, 1964.
A n Act to make further provisions with respect to
pensions for the widows of deceased judges and
deceased retired judges and for the Master in
Equity and the widow of a Master in Equity;
to amend the Judges' Pensions Act, 1953, and the
Equity Act, 1901, as amended, in certain respects;
and for purposes connected therewith. [Assented

P a r l i a m e n t assembled, a n d b y the a u t h o r i t y of the s a m e , a s
follows: —

T h e J u d g e s ' P e n s i o n s A c t , 1 9 5 3 , is a m e n d e d —
( a ) b y inserting i n section six after t h e w o r d " s a l a r y "
t h e following n e w p a r a g r a p h : —
N o t w i t h s t a n d i n g t h e foregoing t h e a n n u a l p e n s i o n
payable to any person who, immediately before the
c o m m e n c e m e n t of t h e J u d g e s ' P e n s i o n s a n d E q u i t y
( A m e n d m e n t ) A c t , 1 9 6 4 , w a s n o t in r e c e i p t of a
p e n s i o n u n d e r this section b u t b e c o m e s entitled
thereto
t h e r e t o after s u c h c o m m e n c e m e n t , shall, w h e r e t h e
j u d g e in respect of w h o m s u c h p e r s o n b e c o m e s s o
entitled served in a n y judicial office for m o r e t h a n
five y e a r s , b e at t h e r a t e of one-fifth of his salary a n d
at t h e a d d i t i o n a l r a t e of o n e p e r c e n t u m of his
salary for e a c h c o m p l e t e y e a r of his service as a
j u d g e i n t h a t judicial office in excess of five y e a r s ,
b u t so t h a t t h e r a t e of s u c h p e n s i o n shall n o t e x c e e d
t h i r t y p e r c e n t u m of his salary.
(b)

Commission";
( d ) b y inserting a t t h e e n d of section eleven t h e follow­
ing new subsection: —
( 3 ) N o t w i t h s t a n d i n g t h e foregoing provisions of
this section t h e a m e n d m e n t s m a d e t o sections six
a n d seven of this A c t b y t h e J u d g e s ' P e n s i o n s
a n d E q u i t y ( A m e n d m e n t ) A c t , 1 9 6 4 , shall n o t
a p p l y t o a n d in r e l a t i o n t o p e r s o n s w h o b e f o r e
the
t h e c o m m e n c e m e n t of s u c h A c t b e c a m e entitled t o
a p e n s i o n p u r s u a n t t o t h o s e sections as e n a c t e d
before s u c h c o m m e n c e m e n t .
3. T h e Equity Act,
A c t s , is a m e n d e d —
1 9 0 1 , as a m e n d e d b y
subsequent
( a ) b y o m i t t i n g from p a r a g r a p h ( b ) of subsection o n e
of section 7 1 A t h e w o r d s " o n p e r m a n e n t disability
o r infirmity o r " ;
( b ) b y o m i t t i n g from t h e s a m e p a r a g r a p h t h e w o r d s
" t w e n t y o n e - h u n d r e d t h s " a n d b y inserting i n lieu
thereof t h e w o r d s "twenty-five p e r c e n t u m " ;
( c ) b y o m i t t i n g from t h e s a m e p a r a g r a p h t h e w o r d s
" t h r e e o n e - h u n d r e d t h s " a n d b y inserting i n lieu
thereof t h e w o r d s " t h r e e a n d one-half p e r c e n t u m " ;
( d ) b y o m i t t i n g from t h e s a m e p a r a g r a p h t h e w o r d
"one-half" a n d b y inserting in lieu thereof t h e w o r d s
"sixty p e r c e n t u m " ;
( e ) b y o m i t t i n g from t h e s a m e p a r a g r a p h t h e w o r d s —
" I n this p a r a g r a p h ' s a l a r y ' m e a n s t h e a g g r e g a t e
of t h e salaries p a i d to t h e M a s t e r in E q u i t y as
M a s t e r in E q u i t y a n d as M a s t e r i n L u n a c y . " ;

b y inserting n e x t after t h e s a m e subsection
following n e w subsections : —
the
(1A) A M a s t e r in E q u i t y w h o h a s a t t a i n e d the
a g e of sixty years a n d h a s served as s u c h for n o t
less t h a n ten y e a r s m a y retire voluntarily from his
office, a n d o n so retiring shall b e entitled t o a n
a n n u a l p e n s i o n in all respects as if h e h a d a t t a i n e d
t h e age of seventy y e a r s a n d h a d r e t i r e d from t h a t
office i n a c c o r d a n c e w i t h l a w .
( 1 B ) W h e r e a M a s t e r in E q u i t y retires from his
office, a n d t h e D i r e c t o r - G e n e r a l of P u b l i c H e a l t h
certifies t h a t his r e t i r e m e n t is b y r e a s o n of per­
m a n e n t disability o r i n f i r m i t y —
( a ) h e shall, if his r e t i r e m e n t o c c u r s after h e
h a s served as M a s t e r in E q u i t y for n o t less
t h a n five y e a r s , b e entitled, o n retiring, t o
an
a n a n n u a l p e n s i o n in all respects as if h e
h a d a t t a i n e d t h e age of seventy y e a r s a n d
h a d retired from t h a t office in a c c o r d a n c e
with l a w ;
( b ) h e shall, in a n y o t h e r case, b e entitled, o n
retiring, to a n a n n u a l p e n s i o n at the r a t e of
twenty-five p e r c e n t u m of his salary.
( l c ) ( a ) W h e r e a M a s t e r in E q u i t y dies b e f o r e
his r e t i r e m e n t his w i d o w shall b e entitled t o a n
a n n u a l p e n s i o n at the r a t e of t w e n t y p e r c e n t u m
of his salary a n d w h e r e h e h a s served in s u c h office
for m o r e t h a n five y e a r s at t h e a d d i t i o n a l r a t e of
o n e p e r c e n t u m of his salary for e a c h c o m p l e t e y e a r
of his service after the e x p i r a t i o n of t h e said five
years t o t h e t i m e of his d e a t h , b u t so t h a t t h e r a t e
of s u c h p e n s i o n shall n o t e x c e e d thirty p e r c e n t u m
of s u c h salary.
( b ) U p o n t h e d e a t h of a r e t i r e d M a s t e r
in E q u i t y w h o w a s , i m m e d i a t e l y before his d e a t h
in r e c e i p t of a p e n s i o n u n d e r this section, his w i d o w
shall b e entitled t o a n a n n u a l p e n s i o n , if h e r m a r ­
r i a g e t o t h e M a s t e r in E q u i t y t o o k p l a c e b e f o r e
his r e t i r e m e n t , a t t h e r a t e of t w e n t y p e r c e n t u m of
his salary at the t i m e of his r e t i r e m e n t a n d w h e r e
h e h a s served in s u c h office for m o r e t h a n five
y e a r s a t t h e a d d i t i o n a l r a t e of o n e p e r c e n t u m of
his salary a t the t i m e of his r e t i r e m e n t for e a c h
c o m p l e t e y e a r of his service after t h e e x p i r a t i o n
of t h e said five y e a r s to t h e d a t e of his r e t i r e m e n t ,
b u t so t h a t t h e r a t e of s u c h p e n s i o n shall n o t e x c e e d
thirty p e r c e n t u m of his salary a t t h e t i m e of h i s
retirement.
( c ) If t h e w i d o w re-marries, h e r p e n s i o n
u n d e r this subsection shall t h e r e u p o n cease a n d
determine.
( g ) b y o m i t t i n g from subsection four of the s a m e sec­
tion t h e w o r d s " M a s t e r in L u n a c y " w h e r e v e r
o c c u r r i n g a n d by inserting in lieu thereof the w o r d s
" M a s t e r in the P r o t e c t i v e J u r i s d i c t i o n of t h e
Supreme Court";
(h)
(h) by inserting at the end of the same section the
following new subsection : —
(5) In this section "salary" means the salary
paid to the Master in Equity by virtue of his office
as Master in Equity and Master in the Protective
Jurisdiction of the Supreme Court.
