to rationalize the consultancy and other medical services fees for making them affordable for
the common man in the federal capitel and for matters connected therewith or incidental thercto.
It is enacted hereby as follows:-
1.
Short title and compencement.- (1) Ihis Act may be called the Medical Consultancy and
Other Services (Rationalization of Fees) Act, 2016
(2) lt extends to the federal capital.
(3) It shallcame into force at onece:

tlefinltions.- ln this Act, unless the conteK otherwie requires,-
(a) "comminee" means the Medical Consultancy and other Services Rationalization of
Fees
Committee constituted under section 3;
(b) "Diagnostic Laboratov' means a place owned or run by a person or a troup of persons or
by a private or corporate hospital where patholoticaltests or investitations are conducted
on the advice of a bonafide medical

ractitioner or consultant;
(c) "Medical consultanc] and other services" includes,-
(i)
Consultancy by qualified medlcal practitione6 in all tind
includint altemative branches, whether in privata clinics
(ii)
(ii0
of medicines/surtery
or in the private or
corpordte hospitals;
All such pathological tests as a.e prescribed by the qualifted Doctors whether in a
private clinic or in a private and/or corporate hospital; and
All such scanning or ima8inS services, namely, x-ray, ultra sound, MRl, or CT saan,
whether in a private clinic or in a private/corporate hospital.
(d) "Medical Piactitione/' means a person legatl/ qualified and duly registered by the PMDC
and engaged in the business of consuhancy and providin8 advice to patients whether as a
private practitioneror in a private corF,oGte/hospital; and
(e) "Presfiibed" means prescribed

3.
Constitution of the Medicil Consultancy and Other se.vices R.tlonalization of Feet
Committee.- (1) The Federal Government shall, by notification in the Officlal Gazette, constitute a
Corhmitee to be known.s the Medical Consultancy and Other Services Rationalization of Fees
Committee to determlne the fees of a medical practitioner and prices of patho lotica I tests, scanninS and
imaging.
(2)
The Committe€ 5hall consist of-
(i)
The Minister of l{ationirl Health Services, o. any other Minister appointed by the federal
government, chairman;

Chalrpersons
of the llational Assembly and Senate Standing Committees on National
Health SeIvices;
(iii)
Three representatives
of
rhajor hospitals/laboratory includint government
run
hospitals/laboratory;
ofthe non-governmental ortanizations in the health sector;
(iv)
Three repaesentative!;
(v)
Three .epresentative ; of hediaal practitbners; and
(vi)
Secretary, Ministry

Menbers under clauies (iii), (iv) and (v} shall be appointed by the federal tovemment in

the efficient functionint ofthe Comrnittee.
5.
Functbns otthe Comnittc.i.- (1) The Comminee rhalldetermine the cor,sultancy fees to be charged by the medkal practitioneB from
patients either in thet private clinics or in a private hospital/corporate hospital after

examine complaints ofthe violations ofthis Act.
(2)
The Committee stall meet once in three month;
(3)
The Cammittae shall review th€ aforesaid fee5 after every 1 year

Penalty,- (1) Whoever ,:ontravenes the provisions of this Act shall be punished with flne which
may extend uP to five lakh rupees.

8.
Annual and spccltl r€porB of thc Confiitt€e.- (1) The Committee shall prepare an annual
report at the end ofthe financial year and may at any time prepare sp€cial reports on any matter which
in its opinion

The federal Bovernment shallcause the annual repon and the special reports to be

before the Majlis-e-Shoord (Parliament) $,ithin thirty dayt from the date of their receipl alongwth a
memorandum indicating the action taken or proposed to be taken on the recommendations ofthe
Committee and reasons for non-implementation of the recommendations, if any.
(3)
The report shall b€ placed on the website of the concemed Ministry immediately after
it5laying before the Majllsr-Shoora (Parliament)for information of Benera

blic.
9.
Pow.r to mak. rul6.- (1) The federdlgovemment may, by notification i0 the Ofticial6azette,
make rules for carrying out the purposes ofthisAct.
