COMMERCIAL AUTO
INTRODUCTION
The ISO Business Auto policy will be used to provide Commercial Auto coverage. We will generally write this
coverage only when we provide the customer’s Commercial Property and Liability insurance and there is no hauling
for hire exposure. The Commercial Auto program is designed to provide coverage for eligible Commercial Auto
insureds whose radius of use is within 200 miles of the place of garaging and whose regular operation is within the
six states (Iowa, Minnesota, Nebraska, North Dakota, Oklahoma and South Dakota) where North Star writes auto
policies.
APPLICATION PROCEDURE
The Business Auto ACORD application shall be used to apply for coverage for vehicles of the Commercial type.
When an application is prepared it shall be sent to our office the same day if coverage is to begin immediately. The
policy term begins at 12:01 A.M. at the address of the insured on the effective date; however, coverage will not
begin prior to the time the application is prepared. If coverage is bound, do not hold the application pending receipt
of additional information from the applicant. The application should be submitted with a notation indicating that
additional information will follow.
Applications should be completed in detail. All applications must be signed by the applicant and the agent. List all
drivers, including family members that will drive company vehicles, and employees who drive their own vehicles on
company business. This includes all full-time and part-time operators. An updated drivers list will be requested
periodically. When the policy covers private passenger type vehicles titled in the name of the business, and used
for personal use, the names and dates of birth for all household members, including children not of driving age must
be furnished on the application.
When an application is received and coverage is bound, a policy will be issued. If it is determined that the company
underwriting requirements are not met, the policy will be mailed and a cancellation notice issued with a pro rata
earned premium charged. Flat cancellations are not permitted.
If an agent wants to determine if an applicant is acceptable, he may submit a signed application, indicating
COVERAGE NOT BOUND, and we will conduct our underwriting review. It is important to furnish complete
information on the questionability of the applicant with the application. Upon completion of our review, we will advise
if the applicant is acceptable. The application will be retained in our office.
PREMIUM PROCEDURES
A. New Business
Premium payments must accompany all applications. The premiums can be prepaid (full policy amount
submitted with the application), or installment billed. Refer to the BILLING INFORMATION Section of the
manual for specific billing information. If the installment option is selected, the minimum down payment must
be submitted with the application.
B. Renewals
For policies not on the monthly billing option, a renewal billing notice will be sent 15 days prior to the renewal
effective date. The notice will indicate the total amount due and will also show the amount due for the installment
option.
C. Endorsements
If installments are remaining, the endorsement premium will be spread to future installment billings. If no
installments are remaining, a bill will be sent immediately.
Return premiums are made payable to the insured and sent to the insured.

D. Down Payment Requirements
A minimum down payment of two months must be attached to all new applications.
E. All installment and renewal payments should be sent with the remittance portion of the billing notice to:

F. Renewal premiums must be in our office on or before the due date indicated. If the agent receives the money
after the renewal date, he may bind coverage at the time he receives the money by preparing a new application.
Do not date the application back to the renewal date. It must be dated on or after the date the renewal premium
is received. The agent can bind coverage only by preparing a new application showing the date and time of day
payment is received, and promptly submitting it with the required down payment to our office. Show the prior
policy number of the application.
G. If the insured makes a change on the policy in the renewal period, it is important that the renewal premium
payment be received in our office to keep the policy from lapsing. The debit or credit endorsement will be
processed accordingly. It is important to timely pay the amount billed to keep the policy from lapsing.
H. Nonpayment
A second billing notice will not be issued. If payment is not received by the date due, the following notices will
be processed:
1. Renewals
A lapse notice will be sent one day after the renewal date.
2. Installments and Endorsements
A cancellation carry date will be established and a Final Premium/Cancellation Notice will be issued 23
days prior to the carry date.

Bad Check Charge
Checks returned by the bank for insufficient funds or similar reasons will result in an NSF check charge.
COVERED AUTO DESIGNATION SYMBOLS
ISO’s Covered Auto Designation Symbols are used to indicate the autos that are covered autos in the policy. The
available coverage symbols are as follows:
5 = OWNED AUTOS SUBJECT TO NO-FAULT – Only those autos the insured owns that are required to
have No-Fault benefits in the state where they are licensed or principally garaged. This includes those
autos the insured acquires ownership of after the policy begins provided they are required to have NoFault benefits in the state where they are licensed or principally garaged.
6 = OWNED AUTOS SUBJECT TO A COMPULSORY UNINSURED MOTORIST LAW – Only those autos
the insured owns that because of the law in the state where they are licensed or principally garaged are
required to have and cannot reject Uninsured Motorists Coverage. This includes those autos the insured
acquires ownership of after the policy begins provided they are subject to the same state uninsured
motorists requirement.
7 = SPECIFICALLY DESCRIBED AUTOS – Only those autos described in Item Three of the Declarations
for which a premium charge is shown (and for Liability Coverage any trailers the insured does not own
while attached to any power unit described in Item Three).

COVERED AUTO DESIGNATION SYMBOLS Continued
8 = HIRED AUTOS ONLY – Only those autos the insured leases, hires, rents, or borrows. This does not
include any auto the insured leases, hires, rents, or borrows from any of the insured’s employees,
partners, members or members of their households.
9 = NONOWNED AUTOS ONLY – Only those autos the insured does not own, lease, hire, rent, or borrow
that are used in connection with the insured’s business. This includes autos owned by the insured’s
employees, partners, members or members of their households but only while used in the insured’s
business or personal affairs.

MOBILE EQUIPMENT SUBJECT TO COMPULSORY OR FINANCIAL RESPONSIBILITY OR OTHER
MOTOR VEHICLE INSURANCE LAWS – Only those autos that are land vehicles and that would qualify
under the definition of mobile equipment under the policy if they were not subject to a compulsory or
financial responsibility law or other motor vehicle insurance law where they are licensed or principally
garaged.
POLICY TERM
A. Policies will be written for a term of 1 year.
B. Policies will be renewed by renewal certificates. When renewal certificates are used, they must conform in every
respect to current rules, rates and forms at the time of renewal.
C. Policyholders will initially receive copies of all policy forms. Upon renewal they will receive only a Declarations,
new identification card(s), and forms that are new or revised. Policyholders may receive all policy forms upon
request.
D. Several rates in this manual are based on rates established in the Personal Auto program. Where indicated,
those rates should be multiplied by the following policy term factor:

ROUNDING PROCEDURE
The premium for each exposure shall be rounded to the nearest whole dollar, separately for each coverage provided
by the policy.
A premium involving $0.50 or more shall be rounded to the next higher whole dollar.
This procedure shall apply to all interim premium adjustments, including endorsements or cancellations.
ADDITIONAL AND RETURN PREMIUM CHANGES
A. All changes requiring premium adjustments shall be computed pro rata.
B. North Star will waive additional premium of $5 or less. This waiver applies only to that portion of the premium
due on the effective date of the policy change.
C. North Star will waive return premium of $5 or less if the insured requests the following:
1. Cancellation of any coverage or exposure;
2. Reduction of limits of liability; or
3. Increase in deductible.
Except that return premium shall be returned at the request of the insured.

CANCELLATION/NONRENEWAL
A. Company
The company has the option to cancel or nonrenew the policy in accordance with State Statutes and Policy
Conditions by giving the required advance written notice. The unearned premium will be returned so as to be
received by the insured by the cancellation effective date.
B. Insured’s Request
The policy may be cancelled by the Named Insured by:
1. Surrendering the policy with the latest copy of the declarations page to the company or any of its authorized
agents; or
2. Mailing to the company written, signed notice stating on what date the cancellation shall be effective.
3. The unearned premium will be returned within 30 days after the cancellation request is received by the
company.
Backdating of the effective date is not permitted.
C. Pro Rata Cancellation
All policies cancelled by the company or at the Named Insureds request shall be cancelled on a pro rata basis.
RATING TERRITORIES AND FACTORS
A. The Territory Definitions pages contain the definition and code for each rating territory.
1. Each territory includes a specific area for rating purposes. The following provisions apply:
a. Any city, town, borough or village not mentioned within a defined territory, but falling within its
boundaries, shall take the rate for that territory.
b. If a city, town, borough or village extends into more than one territory, the rates for the higher rated
territory apply to the entire city, town, borough or village.
c. If a street or other public way serves as a dividing line between two territories, except when the public
way serves as a boundary line of any political subdivision such as a state, county, city, town, etc., the rates
applicable to the lower rated of the two territories shall apply to autos principally garaged on either side of the street.
2. The Territory Definitions pages also contain a List of Important Cities and Towns indicating the territories
to which they are assigned. Refer to a map to determine the rating territory for a town not listed.

PREMIUM DEVELOPMENT – TRUCKS, TRACTORS & TRAILERS
A. This rule applies to all trucks, tractors and trailers which regularly operate within a 200-mile radius from the
street address of principal garaging. Refer to the Personal Auto Manual for rating private passenger type autos
used for business and for individually owned cars, pickups and vans not used in business. Do not bind coverage
on semi-tractors and trailers. They are eligible only when North Star provides insurance on the insured’s other
farm vehicles or private passenger autos.
B. Determination Of Classification Rating Factor And Class Code
Determine the classification rating factor and class code as follows:
1. Determine the primary rating factor based on size class, business use class and radius class.
2. Determine the secondary rating factor based on whether the risk is classified as fleet or non-fleet and driver
record points. The secondary factor does not apply to Trailers, Semi-Trailers or Service/Utility Trailers.
3. Determine the combined rating factor by adding the secondary rating factor to or subtracting it from the
primary rating factor.
C. Territory Determination
Determine the applicable territory from the Territory Definitions based on the street address of principal
garaging.
D. Premium Computation
1. Base Premium
a. Liability Coverages (Bodily Injury Liability and Property Damage Liability)
(1) The trucks, tractors and trailers base premiums are:
(a) 25,000/50,000 Bodily Injury = $98.00
(b) 25,000 Property Damage = $80.00
b. Physical Damage Coverages (Comprehensive and Collision)

CLASSIFICATIONS
Classify trucks, tractors and trailers for liability and physical damage coverages as follows:
A. Primary Classifications
1. Vehicle Weight
Gross vehicle weight (GVW) and gross combination weight (GCW) mean:
a. Gross Vehicle Weight
The maximum loaded weight for which a single auto is designed, as specified by the manufacturer.
b. Gross Combination Weight
The maximum loaded weight for a combination truck-tractor and semi-trailer or trailer for which the
truck-tractor is designed, as specified by the manufacturer.
2. Size Class
a. Light Trucks
Trucks that have a gross vehicle weight (GVW) of 10,000 pounds or less. This includes all pickup
trucks.
b. Medium Trucks
Trucks that have a gross vehicle weight (GVW) of 10,001-20,000 pounds.
c. Heavy Trucks
Trucks that have a gross vehicle weight (GVW) of 20,001-45,000 pounds.
d. Extra-Heavy Trucks
Trucks that have a gross vehicle weight (GVW) of over 45,000 pounds.
e. Semi-Tractors
A semi-tractor is a motorized auto without body for carrying commodities or materials, equipped with
fifth wheel coupling device for semi-trailers. An extra-heavy semi-tractor has a gross combination
weight (GCW) over 45,000 pounds.
f.
Semi-trailers
A semi-trailer is a trailer equipped with a fifth wheel coupling device for use with a truck-tractor, with
load capacity over 2,000 pounds. This includes bogies used to convert containers into semi-trailers.
g. Trailers
Any trailer with a load capacity over 2,000 pounds, other than a semi-trailer.
h. Service Or Utility Trailer
Any trailer or semi-trailer with a load capacity of 2,000 pounds or less.
3. Business Use Class
If a truck, tractor or trailer has more than one use, use the highest rated classification unless 80% of the
use is in a lower rated activity. In that case, use the lower rated classification.
a. Service Use
Autos used for transporting the insured’s personnel, tools, equipment and incidental supplies to or from
a job location. This classification is confined to autos principally parked at job locations for the majority
of the working day or used to transport supervisory personnel between job locations.
b. Retail Use
Autos used to pick up property from or deliver property to individual households.

c. Commercial Use
Autos used for transporting property other than those autos defined as service or retail.
d. Farm Use
Autos used for farming or ranching.
e. Beet/Potato/Specialty Use
Autos used for hauling beets or potatoes or other specialty property types.
4. Radius Class
Determine radius on a straight line from the street address of principal garaging.
a. Local (Up to 50 miles)
The auto is not regularly operated beyond a radius of 50 miles from the street address where such auto
is principally garaged.
b. Intermediate (51 to 200 miles)
The auto is operated beyond a radius of 50 miles but not regularly beyond a radius of 200 miles from
the street address where such auto is principally garaged.
c. Long Distance (Over 200 miles)
The auto is operated regularly beyond a 200-mile radius from the street address where such auto is
principally garaged. Vehicles in this classification are ineligible.
B. Secondary Classifications
Refer to Safe Driver Insurance Plan and Fleet Discount sections of this manual.
PRIVATE PASSENGER TYPES
A. Private passenger rating from the Personal Auto Manual applies. The underwriting requirements for these
vehicles will be similar to the requirements for Personal Auto coverage. Private passenger vehicles titled in an
individual’s name should be submitted on the ACORD Personal Auto Application and written on the Personal
Auto Policy.
B. Multiply the rate developed in A. by the policy term factor for each coverage type.
FARM VEHICLES
A. Private passenger type autos, pickups and vans owned by an individual, husband and wife (or equivalent)
resident in the same household, or a family farm partnership or corporation and not used in any occupation
other than farming or ranching are eligible. Refer to the Personal Auto Manual for rating.
B. Multiply the rate developed in A. by the policy term factor for each coverage type.
ROADSIDE ASISTANCE COVERAGE
A. Coverage may be provided for roadside assistance and trip interruption costs resulting from the disablement of
a private passenger type vehicle as designated in the declarations
This coverage is available to private passenger autos, recreational trailers, and motor homes only. Refer to
Personal Auto Manual for rating.
B. Multiply the rate developed in A. by the policy term factor.
ANTIQUE AUTOS
CA 99 28
A. For private passenger type automobiles, refer to the Personal Auto Manual for rules and rating. Use Stated
Amount Insurance Endorsement CA 99 28 instead of PP 03 23.
B. Multiply the rate developed in A. by the policy term factor for each coverage type.

FUNERAL DIRECTORS
CA 20 18
A. Eligibility
1. This rule applies to autos owned or used by a funeral director.
2. The policy must exclude coverage for bodily injury or property damage which results from providing or
failing to provide any professional service. Use Professional Services Not Covered Endorsement
CA 20 18.
B. Premium Computation
1. Limousines - (Class Code 7910000)
a. For liability and personal injury protection coverages, multiply the trucks, tractors or trailers base
premiums by 0.60.
b. For physical damage, multiply the trucks, trailers and semi-trailers base premiums by 0.55 for
Comprehensive Coverage and by 0.50 for Collision Coverage.
2. Hearses And Flower Cars - (Class Code 7920000)
a. For liability and personal injury protection coverages, multiply the trucks, tractors or trailers base
premiums by 0.55.
b. For physical damage, multiply the trucks, trailers and semi-trailers base premiums by 0.50 for
Comprehensive Coverage and by 0.45 for Collision Coverage.
3. Combination Hearses and Ambulances are ineligible.
4. Autos Used For Other Purposes – refer to Home Office Commercial Auto Underwriter.
MOBILE HOMES
CA 99 28
A. Motor homes and pickup trucks used only to transport camper bodies should be rated according to the Personal
Auto Manual. Use Stated Amount Insurance Endorsement CA 99 28.
B. Multiply the rate developed in A. by the policy term factor for each coverage type.
MOBILE EQUIPMENT
There are a few options available to insure mobile equipment. In order to avoid gaps in insurance coverage with
respect to mobile equipment, listed below are insurance options depending on the insured’s needs.
A. Insuring Mobile Equipment Using Inland Marine
Generally, mobile equipment may be insured according to our Inland Marine Manual under the following
circumstances:
1. The mobile equipment is not self-propelled or is self-propelled and is not subject to state compulsory or
financial responsibility laws;
2. Liability for the transportation of the mobile equipment is covered under the Business Auto Coverage Form
CA 00 01; and
3. Liability for the operation of the mobile equipment is covered under the insured’s Commercial General
Liability policy.
Use the rates, rules and forms according to our Inland Marine Manual.

MOBILE EQUIPMENT Continued
B. Insuring Mobile Equipment Using Commercial Auto
1. Business Auto Coverage Form CA 00 01
Mobile equipment may need to be insured under the Business Auto Coverage Form CA 00 01 if the mobile
equipment is subject to state compulsory or financial responsibility laws.
a. Liability and Basic No Fault Coverages
Refer to Home Office Underwriter for eligibility and rating.
b. Physical Damage Coverages
The premium for such mobile equipment is determined on a stated amount basis.
2. Mobile Equipment Endorsement CA 20 15
a. Application
Mobile equipment may be insured using the Mobile Equipment Endorsement CA 20 15 under the
following circumstances:
(1) The mobile equipment is not subject to state compulsory or financial responsibility laws;
(2) The mobile equipment is not covered under the Business Auto Coverage Form CA 00 01; and
(3) Liability for the operation of the mobile equipment is not covered under the insured’s Commercial
General Liability policy.
b. Premium Determination
(1) Liability and Basic No Fault Coverages
Refer to Home Office Underwriter for eligibility and rating.
(2) Physical Damage Coverages
The premium for such mobile equipment is determined on a stated amount basis.
DRIVE OTHER CAR COVERAGE
CA 99 10
A. Provides coverage to specifically named individuals (and their spouses) who do not own an auto but require
coverage while they are using a non-owned private passenger type auto for their own personal use.
B. Drive other car coverage may not be necessary if the individual insures a private passenger automobile on a
Personal Auto Policy. Endorse a policy covering an individually owned auto that is used in the business with
the appropriate Named Individual Insured Endorsement.
C. The limits and deductibles for this coverage must follow the policy limits and deductibles.
D. Premium Development - (Code 9020000)
1. Base Rates

b. For less than 6 months:

1. Cost of hire means the total amount incurred by the insured for the leasing and hiring of autos that the

b. Services performed by motor carriers of property or passengers.

AUDIO, VISUAL AND DATA ELECTRONIC EQUIPMENT – ADDED LIMITS

A. For vehicles written on an actual cash value basis, a $1,000 sub-limit for physical damage coverage is provided
to all electronic equipment that reproduces, receives or transmits audio, visual or data signals which, at the time
of loss, is:
1. Permanently installed in or upon the covered auto in a housing, opening or other location that is not normally
used by the auto manufacturer for the installation of such equipment;
2. Removable from a permanently installed housing unit or is an integral part of that equipment; or
3. An integral part of such equipment.
Such equipment does not include equipment designed or used for detection or location of radar. Coverage is
not available for radar detection equipment.
This $1,000 limit may be increased. Form CA 99 60 is not applicable to vehicles written on a stated amount
basis, as the sub-limit does not apply to such vehicles.

FINANCIAL RESPONSIBILITY LAWS – CERTIFICATION
A. Financial Responsibility Filings required by the various states normally will not be made by North Star since,
in most cases, a person requiring such a filing will not be eligible for coverage.
B. The state requires the filing of a Financial Responsibility Certificate (SR-22) when the auto insurance policy
serves as the required evidence of financial responsibility following conviction on traffic code violations or upon
failure to satisfy judgment arising out of a motor vehicle accident.
C. Certificates can be issued only by the North Star Home Office, and then only if complete information concerning
the reason for the filing is submitted by the agent. The request for the certificate must clearly identify the person
for whom the company will be making the filing. A Financial Responsibility Certificate will not be issued unless
all autos owned by the applicant are insured by North Star.
D. One (SDIP) Safe Driving Record Point shall be applied if a filing is made.
INCREASED LIABILITY LIMITS
Liability Coverages will be written on a split limit basis. The State Minimum Requirement for Bodily Injury Liability is
25,000/50,000. The State Minimum Requirement for Property Damage Liability is 25,000. For higher limits, multiply

SUSPENSION
CA 02 40
A. This rule does not apply to the following types of risks:
1. Risks for which a certificate has been filed in accordance with a financial responsibility law.
2. Risks subject to the requirements of any state or federal authority regulating motor carriers of passengers
or property.
3. Any other risks subject to compulsory insurance laws.
B. Insurance may be suspended only for liability, uninsured/underinsured motorists and collision coverages and
for periods of at least 30 days. Use Suspension Of Insurance Endorsement CA 02 40.
C. Suspension becomes effective on the date requested by the insured or the date the company or any of its
authorized representatives receives the request.
D. For autos subject to No-fault, Liability and Personal Injury Protection coverages may be suspended at the option
of the named insured if the named insured notifies the insurer that the owned auto will not be operated on public
roads or highways during the period of not less than 30 consecutive days. At the option of the named insured,
no-fault coverages may be suspended for owned autos only, in which case return half the pro rata premium.
E. Prorate the return premium for the period of suspension.
F. If the insured requests, reinstate the policy. Reinstatement must become effective on the day the company or
any of its authorized agents receives the insured’s request.
G. If the insurance for all owned autos has been suspended, other coverages may continue where there is a
separate premium such as non-ownership liability, hired autos on a cost of hire basis and drive other car
coverage.
AUTO LOAN/LEASE GAP COVERAGE
CA 20 71
A. This rule applies to autos that are loaned or leased for a period of six months or longer and which have been
provided Physical Damage Coverage.
B. A policy providing Physical Damage Coverage may be extended to provide coverage for the difference between
the outstanding indebtedness on a loan/lease agreement on a vehicle and the actual cash value of the vehicle.
Use Auto Loan/Lease GAP Coverage Endorsement CA 20 71.
C. The premium for Auto/Loan Lease GAP Coverage is computed by multiplying the Physical Damage Coverage
premiums by a factor of 0.07.
RENTAL VEHICLE COVERAGE - PRIVATE PASSENGER AUTOS CA 01 73
A. Rental Vehicle Coverage for private passenger autos may be provided on all automobile policies covering at
least one private passenger auto. Use North Dakota Changes - Rental Vehicle Coverage - Private Passenger
Autos Endorsement CA 01 73. This endorsement covers all of the insured's contractual obligations for damage
and loss of use to a rented private passenger auto that is:
1. Not rented for longer than 30 continuous days;
2. Not used for transporting persons or property for hire; and
3. Rented or leased without a driver.
For the purposes of this coverage, “private passenger auto” means a motor vehicle of the private passenger,
pickup truck or van type, not used for business purposes, other than farming or ranching.
B. Premium Development
1. The Rental Vehicle Liability Coverage Limit is $25,000.
2. The charge for Rental Vehicle Liability Coverage is $26.
3. The premium is considered fully earned when written.

SPECIAL OR CUSTOMIZED EQUIPMENT COVERAGE
CA 99 28
Comprehensive and collision coverage for Special or Customized Equipment may be purchased on a stated amount
basis for special or customized equipment on a pickup, van or other vehicle insured for physical damage coverage.
We will consider the following as normal standard equipment on a pickup or van which will not require an additional
premium: Pickup topper with list price new up to $1,000; fog lights; running boards; clearance lights; visor; bug
deflector; bed liner; and built in tool boxes with an aggregate list price new for all tool boxes of $500 or less.
Other special equipment such as, but not limited to, the following will need to be insured as special equipment and
rated for using the following rates. Load lifting tail gate; topper over $1,000 list price new; tool boxes with an
aggregate of all boxes over $500 on the vehicle; or other equipment.

be 100% of the Actual Cash Value.

SAFE DRIVER INSURANCE PLAN (SDIP)
A. Definitions
1. Driving Record Points
a. Convictions
Points shall be assigned for convictions during the experience period for motor vehicle violations of the
applicant or any operator as follows:
(1) One-half point for conviction of any moving traffic violation by any driver under the age of 30 that
is not assigned under one of the following paragraphs. (This is limited to the first two convictions
during the experience period.)
(2) One point is assigned for the conviction of any other moving traffic violation resulting in:
(a) suspension or revocation of an operator’s license; or
(b) the filing of evidence of financial responsibility under any Financial Responsibility Law required
as of the effective date of this policy.
(c) the third and successive convictions not qualifying under paragraphs (1) and (4) of this section
by a driver under age 30.
(3) Two points are assigned for:
(a) the accumulation of points under a State Point System or a series of convictions requiring the
filing of evidence of Financial Responsibility under any Financial Responsibility Law as of the
effective date of this policy; or
(b) conviction of reckless driving.
(4) Three points are assigned for conviction of:
(a) driving while intoxicated or under the influence of drugs; or
(b) failure to stop and report when involved in an accident; or
(c) homicide or assault arising out of the operation of a motor vehicle; or
(d) driving while license is suspended or revoked; or
(e) driving a motor vehicle in a reckless manner where an injury to person results.
b. Accidents
Points shall be assigned for each accident that occurred during the experience period, involving the
insured or operator of the vehicle, who is 50% or more at fault.
(1) One-half point is assigned for each auto accident that results in total amount paid under Bodily
Injury, Property Damage, PIP and Collision of less than $2,000 for occurrences prior to 05-01-2017
or less than $2,500 for occurrences on or after 05-01-2017.
(2) One point is assigned for each auto accident that results in:
(a) total amount paid under Bodily Injury, Property Damage, PIP and Collision of $2,000 or more
for occurrences prior to 05-01-2017 or $2,500 or more for occurrences on or after 05-01-2017;
or
(b) a loss experienced under the Comprehensive Coverage portion of the policy under the
following conditions:
(i) A vehicle falling through the ice of any body of water; or
(ii) An at fault accident in which the loss would normally be paid under Collision Coverage, but
glass breakage is paid under the Comprehensive Coverage.
(3) One point is assigned if, during the experience period there were two or more accidents each of
which resulted in payment but have not been assigned a point under (2) above.
(4) Chargeable losses resulting from the operation of a farm truck, motor home, artisan vehicle or an
antique auto are subject to the provisions of the Safe Driver Insurance Plan.

(5) Exceptions
(a) Accidents involving personally owned private passenger autos not insured under this plan.
(b) No points are assigned for accidents incurred by an operator demonstrated to be a named
insured or a principal operator of an auto insured under a separate policy in this Company. In
this situation the points will be assigned to the policy on which the operator is a named insured
or principal operator.
(c) No points are assigned for accidents occurring under the following circumstances:
(i)
auto lawfully parked (if the parked vehicle rolls from the parked position then any such
accident is charged to the operator who parked the auto); or
(ii)
the applicant, owner or other resident operator was reimbursed by, or on behalf of, a
person who is responsible for the accident or has judgment against such person; or
(iii) auto is struck in the rear by another vehicle and the applicant or other resident operator
was not convicted of a moving traffic violation in connection with this accident; or
(iv) operator of the other auto involved in the accident was convicted of a moving traffic
violation and the applicant or operator was not convicted of a moving traffic violation in
connection with the accident; or
(v)
auto operated by the applicant or any resident operator is struck by a “hit-and-run” vehicle,
if the accident is reported to the proper authority within 24 hours by the applicant or
operator; or
(vi) accidents involving damage by contact with animals or fowl; or
(vii) accidents involving Physical Damage, limited to and caused by flying gravel, missiles, or
falling objects; or
(viii) accidents occurring when using auto in response to an emergency if the operator of the
auto at the time of accident was a paid or volunteer member of any Police or Fire
Department, First Aid Squad, or any law enforcement agency. This exception does not
include an accident occurring after the auto ceases to be used in response to such
emergency; or
(ix) accidents which involve only a property damage liability claim paid for damage to or loss
of use of a rented vehicle pursuant to North Dakota Century Code Section 26.1-40-17.1.
This exception does not apply if the insurer which paid the claim is not entitled to recover
damages from the party at fault.
c. One point is assigned if during the experience period, there was one-half point assigned under
convictions and one-half point assigned under accidents.
d. Refund Of Surcharged Premium
If a point has been assigned for an accident and it is later determined that the accident falls under one
of the exceptions in this rule, North Star shall refund to the insured the increased portion of the premium
generated by the accident.
2. Experience Period
The experience period shall be the three years immediately preceding the date of application or renewal.
Acceptability will be based on all prior years with greater emphasis being placed on the most recent three
years.

B. Applying Points
1. Single Car Risk
Points attributable to each driver shall be compiled separately and the total of all drivers shall determine
the surcharge for that vehicle.
2. Two Car Risk
Points attributable to each driver shall be compiled separately and the total of all drivers shall determine
the surcharge for each auto.
3. Three Or More Car Risk
Any points developed under SDIP are assigned to the two autos with the highest “Total Base Premiums”.
The remaining autos are rated using 0 points.
“Total Base Premium” is the sum of the base premium for Bodily Injury and Property Damage Liability; NoFault; Comprehensive; and Collision Coverages that apply to the auto.
C. Combining Accidents And Convictions
If a conviction and a chargeable accident result from the same occurrence, only the conviction or accident
developing the higher number of points shall be counted and the resulting rating points shall be used in
determining the surcharge.
D. Administration Of SDIP
1. New Business
a. Initial information necessary to assign the proper Driving Record Points shall be obtained from an
application signed personally by the applicant.
b. The signature of the applicant on all applications received from an agent shall be certified by such
agent.
2. Renewal Business
Information necessary to assign proper renewal Driving Record Points shall be determined from any one
or combination of the following:
a. Company’s own records; or
b. Motor Vehicle records; or
c. An application signed by the applicant and producer.
DISCOUNTS
A. Fleet Discount (Multi-Car Discount)
1. Application
a. Classify as fleet the autos of any risk that has two or more self-propelled autos of any type that are
under one ownership. Do not include autos owned by allied or subsidiary interests unless the insured
holds a majority financial interest.
b. Do not include mobile equipment insured on a general liability policy in determining if the risk is a fleet.
c. Do not include trailers in determining if the risk is a fleet.
d. Classify the autos of any other risk as non-fleet.
e. Do not change the fleet or non-fleet classification because of mid-term changes in the number of owned
autos except at the request of the insured. The policy must be cancelled and rewritten in accordance
with the Additional And Return Premium Changes section. The coverage part must be cancelled and
rewritten in accordance with the Cancellation/Nonrenewal section.

2. Rating
The fleet discount will apply on commercially classified motor vehicles. Refer to the Secondary
Classifications And Rating Factor Table.
B. Commercial Companion Policy Discount
A 10% Commercial Companion Policy Discount shall be applied to commercially classified vehicles if the
insured has one or more of the following North Star policies that have a total combined annual premium of $500
or more:

C. Anti-Theft Discount
A 5% discount on Comprehensive Coverage will be provided on private passenger vehicles equipped with an
authorized factory installed or authorized dealer installed anti-theft protection device.
For purposes of this rule, “authorized anti-theft protection device” means a device provided by the manufacturer
of a vehicle as original equipment or installed in a vehicle by the manufacturer of the vehicle or an authorized
dealer of that manufacturer. The device does one or more of the following when activated unless the vehicle is
entered and started by means of a lock system:
1. sound an alarm;
2. cause the horn to sound;
3. cause the vehicle lights to flash; or
4. cause the vehicle to be rendered inoperable.
The device must be self-activating upon the locking of the passenger doors of the vehicle.
This rule applies only to policies insuring individual insureds as named insureds and any relative of the named
insured who is a resident of the same household, covering private passenger vehicles owned by that insured
and that are not rented to others or used as public livery conveyances and includes utility vehicles (defined as
any four wheel vehicle, other than a private passenger vehicle which has a pick-up, van or panel type body).
The rule does not apply to policies covering garages, automobile sales agencies, repair shops, service stations
or public parking operations.
D. Accident Prevention Course Discount (Applies To Private Passenger Type Vehicles Only)
1. A 5% Motor Vehicle Accident Prevention Course Discount shall be applied to the premiums for Bodily Injury
and Property Damage Liability, Personal Injury Protection and Collision coverages provided the principal
operator of the motor vehicle has a completion certificate certifying that he or she has successfully
completed an accident prevention course approved by the superintendent of the state highway patrol.
To be eligible for this discount, a principal operator who was age 55 or older when he or she completed the
course must have a completion certificate dated within the most recent 36 months. A principal operator who
was under age 55 when he or she completed the course must have a completion certificate dated within
the most recent 24 months.
2. This Discount shall apply:
a. To new and renewal policies with inception dates within the following periods:
(1) within the 36 month period following the course completion date if the principal operator was age
55 or older when he or she completed the course.
(2) within the 24 month period following the course completion date if the principal operator was under
age 55 when he or she completed the course.
b. only to the motor vehicle principally operated by the insured with the course completion certificate.

c. only once to each such motor vehicle regardless of the number of operators with course completion
certificates.
d. only to private passenger autos and to vehicles consider private passenger autos according to the
Personal Auto Manual.
3. The discount does not apply if the operator who completed this Course:
a. is eligible for a Driver Training Classification according to the Personal Auto Manual; or
b. has been assigned one or more points under the Safe Driver Insurance Plan as a result of accidents
or convictions.
E. Passive Restraint Discount
The following discounts apply to No Fault Coverage ONLY. To qualify, the commercially classified auto must
be equipped with a factory installed automatic occupant restraint conforming to the federal crash protection
requirements, and meeting the criteria of either Paragraph 1. or 2. below:
1. 20% discount will be provided when the restraint is installed in the driver-side-only position.
2. 30% discount will be provided when the restraints are installed in both front outboard seat positions.
INDIVIDUAL RISK PREMIUM MODIFICATION PLAN
A. The following modifications may be applied to recognize special characteristics of risk that are not fully reflected
in the rates.
B. This plan must be applied uniformly in a non-discriminatory manner for all eligible classes of risk.
C. When a risk is rated below average (debited), an insured or applicant, upon request, will be advised of its factors
which resulted in the adverse rating.
D. Individual underwriting files must contain the specific criteria and document the particular circumstances of the
risk that support each debit or credit. This documentation must exist in the individually rated risk file to enable
the Commissioner to verify compliance with the appropriate regulations.
E. This plan must be used to acknowledge variances in risk characteristics and not merely to gain competitive
advantage or for any other purpose.
F. Once the provisions of this plan have been applied to a risk and credit or debit established, no changes in the
established credit or debit can be made without appropriate justification and documentation.
G. The total amount of credit or debit developed using the following table may not exceed 25%. The credit or debit
developed is applied after all other rating procedures. The IRPM’s require approval of the Home Office
Commercial Auto Underwriter and will not apply to Private Passenger vehicles.

INSURANCE SCORE
A. A rating factor from the table below will be applied to all coverages based on the insurance score of the named
insured. The insurance score, using the Standard Auto Model from LexisNexis, is developed from credit-related
information including: types of accounts, balances, dates opened, and account activity, plus public records
items such as judgments and liens and inquiries initiated by the insured.

B. Application of the Insurance Score
1. The insurance score will be applied to all new business and to existing policies at renewal.
2. A statement to indicate an insurance score has been used will be shown on the policy Declaration when an
insurance score is used.
3. The insurance score used, including No Score, will apply for a minimum of 12 months except in cases
where corrections have been made for errors in the insured’s credit history file with the national credit
bureaus. A higher score obtained in this process will be applied back to the beginning of the current policy
term.
4. The insurance score will be ordered every 3 years, unless an insured requests it at the time of a renewal.
However, we do not need to obtain the updated insurance score more frequently than once in a 12-month
period.
5. A No Score will continue to apply to a policy except in cases where an insurance score is obtained from a
national credit bureau. If an insurance score is returned, it will apply.
6. In order to comply with statute, a Neutral score from LexisNexis’ Standard Auto Model indicates that the
insured’s credit report has been influenced negatively by an extenuating life circumstance such as
catastrophic injury or illness, temporary loss of employment or the death of an immediate family member.
7. If the insurance score drops at the 3-year review, the amount of increase to the insurance score factor is
limited to 0.08 per one year period.
TRUSTS

A. Coverage may be provided to vehicles listed on the declarations if title to the vehicle(s) has been transferred to
a trust. Use Trust Endorsement CF-2091.
Coverage is subject to the following requirements:
1. The grantor of the trust must be a named insured shown in the Declarations.
2. All vehicles insured under the policy must be owned by the trust.
3. The trust will be shown as an additional insured in the Declarations.
B. Endorsement
Coverage will be extended without charge to the trustees of the trust as shown on the Trust Endorsement CF2091.
