Late Rent Policies - Louisiana Housing Council

Late Rent Policies:
1.
LEESVILLE HOUSING AUTHORITY - late fee is $10.00 which occurs on any payments made after the 10 day of the month.
2.
EAST BATON ROUGE PARISH RENT due on the 1st, late on 6th business day. No cash and no partial payments (exceptions may
be approved) on 6th business day a $25.00 late fee is charged and a late notice-notice to vacate is served. 14 days from date notice
served, may file for eviction for non-payment
3.
VINTON HOUSING AUTHORITY - $30.00 plus $2.00 per day until paid or eviction procedures after 14 days.
4.
WINNFIELD HOUSING AUTHORITY – Rent is due on or before the 1st day of the month. Rent is considered late at 8am on the
6th day of the month. A $25.00 late fee will be assessed to all unpaid rent on the 6 th day of the month. Two Eviction Notices will be
sent to the tenant on this day (one will be hand delivered and the other one will be sent by first class mail). Rent and late fees are then
due in full within 14 days of the eviction notice. At this time all unpaid rent will be filed in city court for eviction proceedings.
Tenant will be responsible for the cost of court fees incurred by the housing authority. The cost of these fees are $150.00 (This
amount is subject to change). At this time, no rent payments will be accepted by the housing authority.
5.
BREAUX BRIDGE HOUSING AUTHORITY - Rent is due and collectable on the first day of each month and is delinquent if not
paid by the close of business on the tenth day of each month. Charges for other than rent shall be due and collectable the fifteenth day
following written notification of the charge. Such charges shall be considered delinquent on the tenth working day of the month
following the due date. A list of standard charges is posted in the management office and is made a part of this lease by reference.
Failure to pay charges for other than rent when due shall be considered a serious violation of the terms and conditions of this lease. A
late payment charge of $5.00 per day will be assessed to the tenant whose payment is not received by 4:00 p.m. on the 10th day of the
month, and a $5.00 charge thereafter, for each additional day the rent remains unpaid until the 15 th day of the month. A $10.00 per
day charge will be assessed to the tenant whose payment is not received by 4:00 p.m. on the 15th day of the month and a $10.00 charge
thereafter for each additional day the rent remains unpaid during the month it is due. The PHA reserves the privilege of waiving any or
all late charges. If, for any reason, payment will be delayed beyond the 10th day of the month, tenant should immediately contact the
office and explain the circumstances. If there is good reason for an extension of time to pay the delinquent rent, approved by the
Executive Director, the Authority may enter into an agreement with the tenant. Such agreement will be in writing and signed by both
parties. The agreement will specify the due dates and dollar amounts of periodic payments to be made toward settlement of the past
due balance. If an extension of time to pay the delinquent rent is approved, a maximum late charge of $10.00 will apply. Unless
approved by the Executive Director, or for cases of extreme emergency, an extension for late payment of rent will be granted only
once per calendar year.
6.
JENNINGS HOUSING AUTHORITY - Rent and surcharges are due on or before the 1st day of each month and are delinquent after
the tenth (10th) calendar day of the month. All payments received after 4:30 P.M. shall be dated the next work day. No partial
payments will be accepted. The Jennings Housing Authority accepts money orders only (certified cashiers checks may be substituted)
for all rental and surcharge payments. The Housing Authority will not accept cash or any type of check (personal or otherwise) for
any payment amount that the resident may owe. The Jennings Housing Authority will assess a late charge of $5.00 per day, beginning
on the 11th calendar day, to all residents, except those residents who have received a waiver before the delinquency date. Request for
waiver of late charges must be made in writing at the Jennings Housing Authority office on or before the 10th calendar day of the
month. No waiver of late charges will be granted after the 10th calendar day of the month. A waiver of late charges will be allowed
only once within a calendar year period. Payments tendered by residents after the delinquency date and before expiration of the 14
day eviction period will be accepted by management provided all rent and other charges then due, including late charges and City
Marshall's charges for delivering the eviction, are paid in full. No payments will be accepted after expiration of the 14 day eviction
period unless resident yields possession of the dwelling unit. Rent and late fees will be assessed up until the day the resident yields
possession of the dwelling unit. Approved waiver of late charges will become void if resident has not paid all rent and charges due
before expiration of the 14 day eviction period, and late charges will be assessed from the 11th calendar day of the month until resident
yields possession of the dwelling unit. No amount shall be considered too small to issue an eviction notice. Immediately after the
expiration of the lease termination notice, legal proceedings will be instituted for possession of the dwelling unit and resident will be
responsible for legal costs in addition to delinquent rent, surcharges, and late fees. Retroactive Rent Charges will be due and payable
within 7 days of written notice unless arrangements are made prior to this day to make installment payments. Normally retroactive
rent installment payments must be computed not to exceed a three (3) month pay off. If the amounts are large and the resident will not
be able to pay off the retro rent charge within three (3) months a repayment schedule may be established allowing a longer period,
provided the resident agrees to pay the principal. Vacated residents will have seven (7) days from the date of the statement of Refund
of Security Deposit and Unearned Rent to pay the account or make arrangements for payment. Vacated accounts will be pursued
through the local or district courts after the expiration of this time period.
7.
INDEPENDENCE HOUSING AUTHORITY – does not have a policy per say, but the Board voted back in 2008 to charge 5.00 per
day after the 5th of the month for late rent.
8.
DONALDSONVILLE HOUSING AUTHORITY - . Late charges $10 on the sixth day of the month (including weekends and
holidays) an additional $1 each day thereafter.
9.
IOWA HOUSING AUTHORITY – All monthly rent and surcharges will be paid by the resident to the Housing Authority in the
Management Office located at 603 North Park Drive, Iowa, LA on Monday – Friday during office hours as posted in the Housing
Authority Management Office, on the first day of each calendar month in accordance with the terms of the written lease between the
Resident and the Housing Authority. A Resident will be given a ten day grace period to pay the monthly rent and surcharges for the
calendar month. Rent and surcharges received during the grace period will be deemed timely paid. A $10.00 per day surcharge will
be accessed on the 11th day and $5.00 each day the rent and surcharges are not paid following the grace period. A resident that has not
made payment of rent and/or surcharges for the calendar month by 12:00 PM on the 25 th of that month will be issued an eviction
notice for non-payment of rent and/or surcharges under the provision of the Dwelling Lease Contract with the resident and the housing
authority. The following rules will govern the payment by check of rent and surcharges for the calendar month.
Personal checks will be accepted by the Housing Authority as payment of rent and surcharges for the named Resident in the
written lease agreement and only when drawn on the personal checking account of said named resident.
Personal checks as described above will be accepted by the Housing Authority only in the exact amount of the rent and
surcharges due for the calendar month to the Housing Authority.
No personal third party checks will be accepted by the Housing Authority unless the third party check has been issued by:
1. The Federal government or one of its agencies in payment of grant to the named Resident in the written lease
agreement and /or spouse and/or family member or members listed on the written lease agreement.
2. The State government or one of its agencies in payment of grant to the named Resident in the written lease
agreement and /or spouse and/or family member or members listed on the written lease agreement.
Any resident who pays the monthly rent and surcharges for the calendar month by personal check to the Housing Authority
within the sixth-working day period which is returned to the Housing Authority by the bank on which it is drawn marked “No
Account”, “Account Closed”, or “Insufficient Funds”, will be treated as if the monthly rent and surcharges were not timely
paid.
Immediately after the expiration of the lease termination notice, management will issue a demand notice. No payment will be
accepted after the demand notice is issued except from residents who have an approved request for late payment or complete rent
counseling. Retroactive Rent Charges will be due and payable within seven (7) days of written notice unless arrangements are made
prior to this day to make installment payments. Normally retroactive rent installment payments must be computed not to exceed a
three (3) month pay off. If the amounts are large and the resident will not be able to pay off the retro rent charges within three (3)
months a repayment schedule may be established allowing a longer period, provided the resident agrees to pay the principal. Vacated
residents will have seven (7) days from the date of the statement of Refund of Security Deposit and Unearned Rent to pay the account
or make arrangements for payment. Accounts will be referred to the Housing Authority attorney for further collection action to be
taken after the expiration of this time period.
10. OIL CITY HOUSING AUTHORITY - This is to notify you that by order of Resolution 779 of the Oil City Housing Authority
employees of Caddo Parish School Board will be expected to pay their rent no later than the 10 th of the month according to the Rent
Collection Policy. Late charges will apply as stated in the Rent Collection Policy after the 10th of the month.
11. SOUTHWEST ACADIA CONSOLIDATED HOUSING AUTHORITY – All monthly rent and surcharges will be paid by the
resident to the Housing Authority in the Management office located at 312 Acadia St., Estherwood, LA on Monday, Wednesdays and
Fridays and/or at the Rent Collection Office, 408 Fourth St. in Mermentau, Louisiana on Tuesdays and Thursdays, except legal
holidays during office hours as posted in the Housing Authority Management Office, on the first day of each calendar month in
accordance with the terms of the written lease between the Resident and the Housing Authority. A Resident will be given a sixworking day grace period to pay the monthly rent and surcharges for the calendar month. (Weekends and holidays are not counted as
working days). Rent and surcharges received during the grace period will be deemed timely paid. A $5.00 per day surcharge will be
access for each day the rent and surcharges are not paid following the grace period. A resident that has not made payment of rent
and/or surcharges for the calendar month by 4PM on the 14 th of the month will be issued an eviction notice for non-payment of rent
and/or surcharges under the provision of the Dwelling Lease Contract with the Resident and the Housing Authority. The following
rules will govern the payment by check of rent and surcharges for the calendar month.
Personal checks will be accepted by the Housing Authority as payment of rent and surcharges for the named Resident in the

12. GRANT PARISH HOUSING AUTHORITY – Late payment of rent is a flat rate of twenty-five dollars ($25.00). Rent is due by the
5th of each month. Late notice will be sent out on the 6th of the month and a charge of twenty-five ($25.00) shall be added on the 6th of
the month. If resident fails to make the rent payment by 12PM noon, the 10 th day of the month, a written notice to vacate will be
issued to the Resident for non-payment of rental agreement. Eviction notices will be sent on the 10 th of the month.
13. BOGALUSA HOUSING AUTHORITY – The tenant rent is due and payable at the BHA-designated location on the 1st of every
month. All rents should be paid at the central office. Reasonable accommodations for this requirement will be made for persons with
disabilities. Payment will be by money order. No cash payment will be accepted. If BHA does not receive payment by the close of
the 10th day of the month, a delinquent rent notice will be sent, and the resident will be assessed late fees. If the resident is
experiencing a hardship in the payment of the rent, the resident must provide written notification before the 10th day of the month and
the notification must include an explanation of the circumstances that will delay the tenant’s payment, and indicate the date on which
full payment will be made. Tenant must pay “retroactive rent”. Retroactive rent is rent owed by Tenant, when tenant fails to provide
adequate documentation, fails to report changes in income or family composition with BHA’s time limit, or misrepresents income or
family circumstances to BHA. Tenant must pay all retroactive rent in the same month it is posted to Tenant’s rent account, unless an
exception stated in the ACOP applies or BHA agrees to a payment plan. Tenant’s failure to pay retroactive rent on time is considered
to be “non-payment of rent” and BHA then has the right to terminate lease and obtain possession of the premises using all available
legal remedies. If the tenant fails to make payment by the close of the 10 th day of the month, and BHA has not agreed to accept
payment at a later date, a Notice to Vacate will be issued to the tenant with a 14-day notice period for failure to pay rent, demanding
payment in full or the surrender of the premises. If the tenant fails to make payment by the close of the 10 th day of the month, a late
fee of $10.00 will be charged. If BHA has not agreed to accept payment at a later date, a Notice to Vacate will be issued for failure to
pay rent. Schedule.
14. RUSTON HOUSING AUTHORITY - Rent and other charges are due and payable on the first day of the month. All rents should be
paid at 615 N. Farmerville Street. Reasonable accommodations for this requirement will be made for persons with disabilities. As a
safety measure, no cash shall be accepted as a rent payment. If the rent is not paid by the fifth of the month, a Notice to Vacate will be
issued to the tenant. In addition, a $10 late charge plus $1 per day after the fifth of the month will be assessed to the tenant. If the rent
is not paid by the tenth of the month the housing authority will file for eviction. At that time an administration fee equal to court costs
assessed to the housing authority will be assessed to the tenant. If rent is paid by a personal check and the check is returned for
insufficient funds, this shall be considered a non-payment of rent and will incur the late charge plus an additional charge of $15 for
processing costs. After one returned check, tenant will be required to pay with a money order. We do allow a tenant to pay all of the
rent, late fees, and administrative fee (court cost) prior to appearing in court.
15. CITY OF NATCHITOCHES HOUSING AUTHORITY – Rent is due on or before the first (1st) day of each month and is
delinquent after the fifth (5th) working day of the month. All payments received after 3:30 PM shall be dated the next work day, but
for delinquent purposes they will have the actual payment date noted on the receipt. Maintenance charges and all other charges are
due on the fifteenth (15) day after notification of the charges. Maintenance charges and other charges, not otherwise mentioned in this
policy, appearing on rental accounts are due the fifteenth (15 th) day following written notification of the charge. All payments
received shall be applies to the oldest debt first, unless some charges are currently contested under a written grievance. No amount
shall be considered to small to issue an eviction warrant. Management reserves the right to waive late charges or to accept payments
after the delinquency date as determined on a case-by-case basis. The Housing Authority may assess a late charge to all residents,
except those residents who have received a waiver, on the delinquency date. Payments tendered by residents after the delinquency
date and prior to a demand notice will be accepted by management, provided all rent and other charges then due are paid in full. No
partial payments will be accepted after the delinquency date. No payments will be accepted after the expiration of the eviction notice,
unless the resident has made a written request for late payment and delay of court action. Such a request has been determined and
approved for only those reasons which are genuine emergencies as determined by the Housing Authority management, or upon
completion of rent counseling. A resident will be allowed to tender rent and other charges then due in full after termination of the
dwelling lease only once within a twelve (12) month period, and then only after completion of rent counseling. Failure to make
payments when due and before expiration of the dwelling lease termination, shall result in an issuance of a dispossessory warrant upon
expiration of all legal notices. Immediately after the expiration of the lease termination notice, management will issue a demand
notice. No payments will be accepted after the demand notice is issued except for residents who have an approved request for late
payment or complete a rent counseling in the Rental Payments after the Delinquency Date, Section D of this policy, provided rent
counseling is completed prior to the issuance of a dispossessory warrant. Retroactive Rent Charges will be due and payable within
seven (7) days of written notice unless other arrangements are made prior to this day to make installment payments. Normally
retroactive rent installment payments must be computed not to exceed a three (3) month pay off. If the amounts are large and the
resident will not be able to pay off the retro rent charge within three (3) months, a repayment schedule may be established allowing a
longer period, provided the resident agrees to pay the principal plus 12% interest. Vacated residents will have ten (10) days from the
date of the notice of balance due to pay the account or make arrangements for payment. Accounts will be reported to the Credit
Bureau and collection action will be taken after the expiration of this time period. If a resident has a dispossessory warrant for nonpayment of rent issued against them a second time within a twelve month period, tender of rent will not be accepted and resident will
be required to vacate the premises. This action does not relive the amount owed. The resident will be required to pay any balance
owing plus cost.
16. BASILE HOUSING AUTHORITY – Rent and other charges are due and collectable on the first day (1 st) of each month and is
delinquent if not paid by the close of business on the fifth (5th) working day of each month unless otherwise specified herein. A list of
standard charges is posed in the management office and is made a part of this lease by reference. Failure to pay charges for other than
rent when due shall be considered a serious violation of the terms and conditions of this lease. A late payment charge of $10.00 may
be assessed to the tenant after the 5th working day of the month, and thereafter, a finance late payment of $1.00 will be due after an
additional ten (10) days for each day the rent remains unpaid during the month it is due. The PHA reserves the privilege of waiving
any or all finance charges.
17. LAFOURCHE PARISH HOUSING AUTHORITY – Rent is due on the 1st day of each month and must be received (not
postmarked) in the Authority office by the 10 th day of each month. A late charge of $15.00 is then added to delinquent accounts and
eviction notices sent. Resident will only be allowed to be late on their rent three (3) times in a calendar year. No late payments will
be accepted beyond the third (3rd) late payment. The fourth (4th) time rent is not received in the office on the 10 th day of the month,
will result in termination of the resident least. The family will have 14 days to vacate the premises. No exceptions will be allowed
under any circumstances.
18. VERNON PARISH HOUSING AUTHORITY – Tenant rent and other charges are due and must be paid on the first day of each
month. All rents should be paid at the PHA Office. Reasonable accommodations will be made for persons with disabilities. Cash,
Check or Money Orders will be accepted as rent payments. A notice to vacate will be sent to any tenant whose rent is not paid by the
tenth (10th) of the month. A $10.00 late charge will also be charged to the tenant. Any personal check used to pay rent that is returned
due to insufficient funds, will be considered non-payment of rent and late charges will be applied. In addition, a charge of $15.00 to
be charged for NSF processing fees.
19. CHURCH POINT HOUSING AUTHORITY - Rents are due on the first day of each month and must be paid by the fifth working
day of each month. Each tenant will be allowed to have two (2) late payments per calendar year. The procedure for late payments
shall be:
1. The tenant must come into the office within the first five working days of the month and request in writing, permission to
extend the date for paying rent.
2. The request must be approved by the office staff.
3. Under no circumstances will time be extended beyond the 16th day of the month.
4. A five ($5.00) per day late payment will be charged for any unapproved late payment of rent. The late payment charge must
be paid at the same time as rent. Rent will not be accepted without the full amount of rent and late charges.
The housing authority will issue a notice to vacate to any tenant who has failed to comply with this rent policy.
20. DELCAMBRE HOUSING AUTHORITY - Dwelling rent is due and payable on the 1st day of each month and becomes
delinquent on the 5th day. A one-time Late Fee, of $25.00, will be assessed, if rent/other charges are not paid by the 10 th of
the month. If tenant has made no effort to obtain an extension, a delinquent notice will be mailed or delivered in a sealed
envelope to his dwelling unit. If rent/other charges are not paid by the 15th of the month, tenant will be sent an eviction
notice for non-compliance of the Lease. They will be given 14 days to move out. Once eviction procedures are started no
payments will be accepted. No Amount shall be considered too small to issue an eviction notice. Management reserves the
right to waive late fees or to accept payments after the delinquency date as determined on a case by case basis. Each tenant
shall be allowed to have (2) two late payments per calendar year. The Authority will accept personal checks for the exact
amount. If a check is returned with non-sufficient funds, a $25.00 NSF fee will be charged and the tenant will then have to
pay his rent by money order, only, NO CASH. Payments can be made after office hours by using the mail slot; the payments
must be made by Check or Money Order, only.
21. LAKE ARTHUR HOUSING AUTHORITY - late fee is $5.00 which occurs on any payments made after the 10 day of the month.
22. BUNKIE HOUSING AUTHORITY – Rent will be due & payable in advance, without notice, at 712 Keller St., Bunkie, LA 71322,
on the first (1st) calendar day of each month. Beginning January 1st, 2005, all rent collected shall be paid with money orders, cashier’s
check or personal check ONLY. A charge of $50.00 will be assessed for checks returned for insufficient funds or account closed. If a
tenant has a check returned for insufficient funds or account closed, ALL future payments must be made by money order or cashiers
check ONLY. All tenants must pay rent no later than the 10 th of each month, unless, the 10th falls on a week end or holiday & it must
be paid by 3:00 PM on this day. If a tenant fails to make payment on the 10 th of each month (unless stated in section 5) a Notice of
Eviction will be issued to the tenant OR on the 11 th of the month OR the next business day if the 10th or 11th falls on a weekend or
holiday. A $25.00 flat late fee will be charged to the tenant if the rent is not paid by the 10th of each month (unless stated in section
5).
