Teslin Tlingit have decision-m aking st ruct ures based on t he t radit ional
Tlingit clan syst em and are desirous of m aint aining t hese st ruct ures;
t he Part ies w ish t o support and prom ot e t he cont em porary and evolv ing
polit ical inst it ut ions and processes of t he Teslin Tlingit Council;
t he Part ies have negot iat ed t he Teslin Tlingit Council Final A greem ent ,
securing t he right s and benef it s t herein including a com m it m ent t o
negot iat e t he Teslin Tlingit Council Self -Governm ent A greem ent ;
t he Teslin Tlingit Council assert s, subject t o Set t lem ent A greem ent s,
cont inuing aboriginal right s, t it les and int erest s w it h respect t o it s
Set t lem ent Land;
t he Part ies w ish t o achieve cert aint y w it h respect t o t he relat ionship
bet w een t he Teslin Tlingit Council and Governm ent , including jurisdict ion
ov er land and ot her resources w it hin t he Tradit ional Territ ory of t he Teslin
Tlingit Council;
t he Part ies w ish t o provide f or t he ef f ect ive m anagem ent , adm inist rat ion
and exercise of t he right s and benef it s of t he Teslin Tlingit Council and
Teslin Tlingit w hich are secured by t he Teslin Tlingit Council Final

t he Part ies recognize and w ish t o prot ect a w ay of lif e t hat is based on
an econom ic and spirit ual relat ionship bet w een Teslin Tlingit and t he land;

" A ct " includes ordinance;
" Chief " , " Execut ive" , and " Council" have t he sam e m eanings as in

" Cit izen" m eans a cit izen of t he Teslin Tlingit Council as det erm ined
by t he Const it ut ion;
" Const it ut ion" m eans t he const it ut ion of t he Teslin Tlingit Council,
in ef f ect on A ugust 1 0 , 1 9 9 1 , as am ended f rom t im e t o t im e;
" Consult " or " Consult at ion" m eans t o provide,
(a)
t o t he part y t o be consult ed, not ice of a m at t er t o be
decided in suf f icient f orm and det ail t o allow t hat part y
t o prepare it s view s on t he m at t er,
(b)
a reasonable period of t im e in w hich t he part y t o be
consult ed m ay prepare it s view s on t he m at t er, and an
opport unit y t o present such view s t o t he part y obliged
t o consult , and
(c)
f ull and f air considerat ion by t he part y obliged t o

" Council f or Yukon Indians" includes any successor t o t he Council

" Legislat ion" includes A ct s, Regulat ions, orders-in-council and
bylaw s;
" M inist er" m eans t he M inist er or M inist ers of Governm ent charged
by Legislat ion w it h t he responsibilit y, f rom t im e t o t im e, f or t he
exercise of pow ers in relat ion t o t he m at t er in quest ion;
" Non-Set t lem ent Land" m eans all land and w at er in t he Yukon
ot her t han Set t lem ent Land;

adopt ed by t he V illage of Teslin pursuant t o t he M unicipal A ct ,

" Regulat ion" includes a regulat ion or any inst rum ent m ade in t he
execut ion of a pow er or aut horit y conf erred by an A ct , but does
not include law s enact ed by t he Teslin Tlingit Council;
" Self -Governm ent Legislat ion" m eans t he Legislat ion w hich brings
t his A greem ent int o ef f ect ;
" Set t lem ent A greem ent " has t he sam e m eaning as in t he Final
A greem ent ;

2 0 .4 .2 of t he Final A greem ent , creat ed by t he Teslin Tlingit Council
alone or t oget her w it h one or m ore Yukon First Nat ions;
" Set t lem ent Land" m eans t hose lands ident if ied in t he Final
A greem ent as Set t lem ent Land f or t he Teslin Tlingit Council;
" Set t lem ent Legislat ion" has t he sam e m eaning as in t he Final

" Tradit ional Territ ory" m eans t he geographic area w it hin t he Yukon

" Yukon First Nat ions" m eans all of t he Yukon First Nat ions def ined
as a Yukon First Nat ion; and

Yukon First Nat ion Final A greem ent s in accordance w it h crit eria
est ablished in Chapt er 3 of t he Um brella Final A greem ent ;
" Yukon Law of General A pplicat ion" m eans a Law of General
A pplicat ion enact ed pursuant t o t he Yukon A ct , R.S.C. 1 9 8 5 , c. Y2.

PRINCIPLES
2 .1
The Teslin Tlingit Council has t radit ional decision-m aking st ruct ures
and desires t o m aint ain t hese t radit ional st ruct ures int egrat ed w it h
cont em porary f orm s of governm ent .

The Part ies are com m it t ed t o prom ot ing opport unit ies f or t he w ellbeing of Cit izens equal t o t hose of ot her Canadians and t o providing
essent ial public serv ices of reasonable qualit y t o all Cit izens.
GENERAL PROV ISIONS
3 .1
This A greem ent shall not af f ect any aboriginal claim , right , t it le or
int erest of t he Teslin Tlingit Council or of it s Cit izens.
3 .2
This A greem ent shall not af f ect t he ident it y of Cit izens as aboriginal
people of Canada.
3 .3
This A greem ent shall not af f ect t he abilit y of t he aboriginal people
of t he Teslin Tlingit Council t o exercise, or benef it f rom , any
exist ing or f ut ure const it ut ional right s f or aboriginal people t hat
m ay be applicable t o t hem .

Unless ot herw ise provided pursuant t o t his A greem ent or in a law
enact ed by t he Teslin Tlingit Council, t his A greem ent shall not
af f ect t he abilit y of Cit izens t o part icipat e in and benef it f rom
Governm ent program s f or st at us Indians, non-st at us Indians or
nat ive people, as t he case m ay be. Benef it s under such program s
shall be det erm ined by t he general crit eria f or such program s
est ablished f rom t im e t o t im e.

Except f or t he purpose of det erm ining w hich Cit izens are " Indians"
w it hin t he m eaning of t he Indian A ct , R.S.C. 1 9 8 5 , c. I-5 , t he
Indian A ct , R.S.C. 1 9 8 5 , c.I-5 , does not apply t o Cit izens, t he
Teslin Tlingit Council or Set t lem ent Land.

This A greem ent shall not :

Governm ent m ay det erm ine, f rom t im e t o t im e, how and by w hom
any pow er or aut horit y of Governm ent set out in t his A greem ent
shall be exercised, ot her t han t he pow er t o consent t o an
am endm ent pursuant t o 6 .2 .

shall be rat if ied by each of t he Part ies in t he f ollow ing m anner:

Council; and

by t he Teslin Tlingit Council, by t he process set out in
Schedule A of t his A greem ent .
SELF-GOV ERNM ENT LEGISLATION

Prior t o rat if icat ion of t his A greem ent , Governm ent shall negot iat e,
w it h t he Council f or Yukon Indians, guidelines f or draf t ing Self Governm ent Legislat ion t hat shall, am ong ot her t hings, t ake int o
account t he provisions of t his A greem ent .

Governm ent shall Consult t he Council f or Yukon Indians during t he
draf t ing of Self -Governm ent Legislat ion.

Governm ent shall Consult t he af f ect ed Yukon First Nat ions during
t he draf t ing of any subsequent amendm ent s t o Self -Governm ent
Legislat ion.
AM ENDM ENT AND REV IEW
6 .1
This A greem ent m ay only be am ended w it h t he consent of t he
Part ies.
6 .2
Consent t o any am endm ent pursuant t o 6 .1 m ay only be given on
t he part of :

Canada, by t he Governor in Council;
6 .2 .2
t he Yukon, by t he Com m issioner in Execut ive Council;
and
6 .2 .3
t he Teslin Tlingit Council, by t he Execut ive Council.

W here Governm ent has concluded a self -governm ent agreem ent
w it h anot her Yukon First Nat ion w hich includes provisions m ore
f av ourable t han t hose in t his A greem ent , and w here it w ould be
pract ical t o include t hose provisions in t his A greem ent ,
Governm ent , at t he request of t he Teslin Tlingit Council, shall
negot iat e w it h t he Teslin Tlingit Council w it h a view t o am ending
t his A greem ent t o incorporat e provisions no less f avourable t han
t hose in t he ot her self -governm ent agreem ent .

A disput e arising f rom negot iat ions described in 6 .3 m ay be
ref erred by any Part y t o disput e resolut ion pursuant t o 2 6 .3 .0 of
t he Final A greem ent .
6 .4 .1
In any disput e arising pursuant t o 6 .3 an arbit rat or shall
have t he aut horit y set out in 2 6 .7 .3 of t he Final
A greem ent .

The Part ies shall m ake am endm ent s t o t his A greem ent w hich are
required t o give ef f ect t o orders or decisions of an arbit rat or
pursuant t o 6 .4 .

Unless t he Part ies ot herw ise agree, t he Part ies shall review t his
A greem ent w it hin f ive years of t he Ef f ect ive Dat e f or t he purpose
of det erm ining w het her:

incorporat ed
self -gov ernm ent
provisions respect ing any m at t ers considered in t his
A greem ent ;

t his A greem ent has been im plem ent ed in accordance
w it h t he im plem ent at ion plan;

t he negot iat ed t ransf er of program s, responsibilit ies
and resources pursuant t o t his A greem ent has been
successf ul; and

t his A greem ent should be am ended in accordance w it h
6 .1 and 6 .2 t o ref lect t he out com e of t he review .
REM EDIES
7 .1
Neit her Governm ent nor t he Teslin Tlingit Council shall have a claim
or a cause of act ion in t he event any provision of t his A greem ent
or of Self -Governm ent Legislat ion is f ound by a court of com pet ent
jurisdict ion t o be invalid.
7 .2
Neit her Governm ent nor t he Teslin Tlingit Council shall challenge
t he validit y of any provision of t his A greem ent or of Self Governm ent Legislat ion.

If any provision of t his A greem ent is f ound by a court of com pet ent
jurisdict ion t o be invalid, t he Part ies shall make best ef f ort s t o
am end t his A greem ent t o rem edy t he invalidit y or replace t he
invalid provision.

If any provision of Self -Governm ent Legislat ion is f ound by a court
of com pet ent jurisdict ion t o be invalid, Governm ent shall m ake best
ef f ort s t o am end t he Self -Governm ent Legislat ion t o rem edy t he
invalidit y or replace t he invalid provision.
INTERPRETATION AND APPLICATION OF LAW
8 .1
Subject t o 8 .1 .1 , w here t here is any inconsist ency or conf lict
bet w een t he provisions of f ederal Self -Governm ent Legislat ion and
any ot her f ederal Legislat ion, t he f ederal Self -Governm ent
Legislat ion shall prevail t o t he ext ent of t he inconsist ency or
conf lict .

bet w een t he provisions of Yukon Self -Governm ent Legislat ion and
any ot her Yukon Legislat ion, t he Yukon Self -Governm ent

conf lict .

The Teslin Tlingit Council shall not if y Governm ent by M arch 3 1 st

receipt of such not if icat ion, t he Part ies shall prepare a w orkplan
t o address t he Teslin Tlingit Council priorit ies f or negot iat ion. The
w orkplan shall ident if y t im elines and resources available f or
negot iat ions.

The calculat ion of net savings pursuant t o 1 8 .0 shall be m ade
solely at t he t im e t hat t he Teslin Tlingit Council init ially assum es

1 8 .1 t hat is in ef f ect at t he t im e, t hen t he Yukon cont ribut ion

Com m it t ee, in t his process, subject t o review and approval by
Canada. The approved expenses of t he Teslin Tlingit Council and
t he Rat if icat ion Com m it t ee shall be a charge on Canada.

t his A greem ent and t he vest ing of t he Reserves and asset s ref erred
