Cumberland-Franklin Joint Municipal Authority (February 13, 2014) Chairman Steve Oldt called the regular meeting of the Cumberland-Franklin Joint Municipal Authority to order in the office of CFJMA at 6:00 p.m. He asked for a moment of silence and the pledge to the flag followed. Those present were: George Bauserman Attorney Jim Robinson Jerome Kater Charles Heckman Dwain Koser Tom Ginnick Lisa Suders Steve Oldt The minutes from January 9, 2014 meeting were motioned for approval by Mr. Bauserman, and seconded by Mr. Heckman. Motion carried. There were no Public Comments. There was no Correspondence. Mr. Kater motioned the approval of the January 9, 2014 Treasure’s Report and Mr. Bauserman supplied the second. Motion carried. Under the Solicitor’s Report, Attorney Robinson presented the following: 1. He has not received a return phone call from Salzmann’s office in relation to the Fourth Amendment to the Joint Agreement between the Cumberland-Franklin Joint Municipal Authority & Borough of Shippensburg. 2. He has not received a return phone call from Forrest Myers in relation to the Water Services Collection Act agreement that needed to be signed by the Shippensburg Borough Authority president. He reinsured the board that, by law the Borough must carry out our requests for water shut-off to our delinquent customers. 3. Southampton Franklin Township will not follow through with the condemning of properties in their township in which CFJMA enforced the Water Service Collections Act. Therefore he is working on putting something together for Dwain outlining why Municipalities should be condemning properties without water and that CFJMA doesn’t have the authority to do so. Under Manager’s Report, Dwain presented the following: 1. He, Lisa & Steve met with F & M Trust in January. Dave Zimmerman from F & M Trust asked questions and had reviewed minutes and past audits pertaining to CFJMA’s financial stability. Steve questioned Mr. Zimmerman about the protection, known as Act 72, of the required amount of $2 million in the Operating Account. Mr. Zimmerman said he would check in to it and get back to us. 2. He presented the board with a situation with property owners Ben Jacoby (94 Airport Road) & Jacqueline Jacoby (96 Airport Road- Ben’s mother). Ben has placed a modular home at 94 Airport Road and needs to connect to the sewer. CFJMA rules require that all structures are required to have separate laterals. However, the location of where Ben needs to connect his lateral to do not allow room for the boring machine to be set up and it’s also on a bad turn in the road and a large electric service line run in the way. Ben is requesting to be granted permission to set a manhole over the sewer lateral of 96 Airport Road (property has been connected for years) which is now on his land after the subdivision of his lot from his mother’s lot and run his lateral into the manhole along with Her’s, and both properties will use the 4” lateral already connected to the sewer main. There must be an agreement between the property owners and an easement for the portion of the lateral belonging to 96 Airport Road that runs on the property of 94 Airport Road. Southampton Cumberland Township presented a letter to CFJMA agreeing with this matter. Mr. Kater made a motion to approve the request from Ben Jacoby and Mr. Heckman seconded it. Mr. Oldt, Mr. Kater & Mr. Heckman voted aye. Mr. Ginnick & Mr. Bauserman abstained. Motion carried. 3. He brought up to the board that in 2005 Gary Meals 1122 Mainsville Road was notified to connect to CFJMA sewer because of septic tank overflow issues. Mr. Meals had been overlooked originally to be connected to sewer. At that time the sewer fee was $1500.00. Mr. Meals had been charged a $750.00 permit fee and permitted to make payments. Someone called into the office to report that at 1128 Mainsville Road (property in front of Mr. Meals) there was an apartment above a garage that is connected to the lateral of the said property. Dwain met with Henry Henson, owner of 1128 & 1128A (Apt) Mainsville Road to inform him that a permit fee is due and owing to CFJMA. Mr. Henson said he remembered that Mr. Meals was charged $750.00 for a permit and allowed to make payments and he was requesting the same. Dwain informed Mr. Henson that the present permit fee is $4,500. Dwain figures he has been connected since sometime in 2008 and at that time the permit fees was $3,500. Mr. Kater motioned to charge Mr. Henson $3,500 for the permit, with a 1-year payment plan. Mr. Ginnick seconded the motion. Motion carried. There was no Old Business. Under New Business, Mr. Oldt asked Dwain to invite the new Borough Manager, Lance Hoover, to our next meeting. Mr. Ginnick said he had a meeting planned with Mr. Hoover and would pass the invite along. Motion to adjourn the meeting at 6:33 p.m. was made by Mr. Heckman and seconded by Mr. Bauserman.
