An Act to apply and extend certain pro­
visions of the Chinese Restriction and
Regulation Act of 1883 to other Coloured
Races, to repeal section 15 of that Act,
and for other purposes incidental to or
consequent upon the before-mentioned

A s s e m b l y of N e w S o u t h W a l e s i n P a r l i a m e n t assembled, a n d b y t h e
a u t h o r i t y of t h e same, as follows :—
1. T h e provisions of t h e Chinese R e s t r i c t i o n a n d R e g u l a t i o n
A c t of 1888, w i t h t h e exception of sections one, t w o , twelve, a n d
n i n e t e e n , shall a p p l y a n d e x t e n d to a n d in respect of all persons
b e l o n g i n g t o a n y coloured race i n h a b i t i n g t h e C o n t i n e n t of Asia or
t h e C o n t i n e n t of Africa, or a n y island a d j a c e n t t h e r e t o , or a n y island
in t h e Pacific Ocean or t h e I n d i a n Ocean, not b e i n g persons d u l y
accredited on a n y special mission to H e r M a j e s t y by t h e G o v e r n m e n t
or r u l e r of a n y c o u n t r y , state, or territory, or t o this Colony u n d e r
t h e a u t h o r i t y of t h e I m p e r i a l G o v e r n m e n t .
I n a p p l y i n g a n d e x t e n d i n g t h e provisions of t h e said A c t as
aforesaid, t h e r e shall Be read i m m e d i a t e l y after t h e w o r d " C h i n e s e , "
w h e r e v e r it occurs in t h e said A c t , t h e words " o r person of a n y
coloured race i n h a b i t i n g t h e C o n t i n e n t of Asia or t h e C o n t i n e n t of
Africa,
Africa, or a n y i s l a n d a d j a c e n t to e i t h e r C o n t i n e n t , or a n y i s l a n d in
t h e Pacific O c e a n or in t h e I n d i a n O c e a n , " or t h e w o r d s " or p e r s o n s
of a n y c o l o u r e d r a c e s i n h a b i t i n g t h e C o n t i n e n t of A s i a o r t h e C o n t i n e n t
of A f r i c a , o r a n y i s l a n d a d j a c e n t t o e i t h e r C o n t i n e n t , o r a n y i s l a n d in t h e
Pacific O c e a n or in t h e I n d i a n O c e a n , " as t h e c o n t e x t m a y r e q u i r e ; a n d
a w i f e w h o s e d e s c e n t b r i n g s h e r w i t h i n t h e m e a n i n g of t h e f o r e g o i n g
d e f i n i t i o n s h a l l b e d e e m e d t o b e of t h e n a t i o n a l i t y of h e r h u s b a n d .
N o t h i n g h e r e i n c o n t a i n e d shall be d e e m e d to i n c l u d e w i t h i n t h e o p e r a ­
t i o n of t h i s A c t a n y p e r s o n e i t h e r w h o l l y o r p a r t i a l l y of E u r o p e a n
descent.
T h e n a t i v e r a c e s of A u s t r a l i a , T a s m a n i a , a n d N e w Z e a l a n d
s h a l l a l s o b e e x e m p t f r o m t h e o p e r a t i o n of t h i s A c t .
2. S e c t i o n f i f t e e n of t h e C h i n e s e R e s t r i c t i o n a n d R e g u l a t i o n
.Vet of 1 8 8 8 is h e r e b y r e p e a l e d , a l s o t h e w o r d s " b y b i r t h a B r i t i s h
s u b j e c t o r " i n s e c t i o n five of t h a t A c t .
3 . I t shall b e lawful for t h e G o v e r n o r - i n - C o u n c i l from t i m e to
t i m e , b y p r o c l a m a t i o n t o lie p u b l i s h e d i n t h e Gazelle, t o e x e m p t f o r a n y
p e r i o d a n y p e r s o n o r c l a s s of p e r s o n s f r o m t h e p r o v i s i o n s of t h i s a n d t h e
Principal Act, and to declare t h a t such provisions shall not at any time
o r f o r a n y s p e c i f i e d p e r i o d a p p l y t o t h e p e r s o n o r c l a s s of p e r s o n s
mentioned in such proclamation.
A n y such proclamation m a y at any
time be revoked by the Governor-in-Council by proclamation to be
published in the
Gazette.
4. This A c t shall n o t apply, nor shall t h e Chinese Restriction
a n d R e g u l a t i o n A c t of 1 S 8 S a p p l y , t o m i n i s t e r s of r e l i g i o n , m i s s i o n a r i e s ,
n a t i v e t e a c h e r s , t o u r i s t s , m e r c h a n t s , m e n of s c i e n c e o r s t u d e n t s , a n d
t h e w i v e s a n d f a m i l i e s of s u c h p e r s o n s , a n d a l s o t h e i r d o m e s t i c
s e r v a n t s , w h o a r e b e a r e r s of c e r t i f i c a t e s of i d e n t i t y s p e c i f y i n g t h e i r
o c c u p a t i o n a n d t h e i r object in c o m i n g i n t o N e w S o u t h W a l e s , or
of o t h e r s i m i l a r d o c u m e n t s i s s u e d b y t h e G o v e r n m e n t w h o s e s u b j e c t s
t h e y are. E v e r y such certificate or other d o c u m e n t shall be in t h e
E n g l i s h l a n g u a g e , a n d shall be e x a m i n e d a n d endorsed b y a British
C o n s u l o r Charge

s u c h r e g u l a t i o n s e n s u r i n g t h e d e p a r t u r e of a l l s u c h officers a n d
m e m b e r s of t h e c r e w w i t h t h e i r s h i p a s t h e G o v e r n o r - i n - C o u n c i l m a y
prescribe.
5. T h i s A c t s h a l l t a k e effect o n a n d a f t e r t h e first d a y of
January, one thousand eight hundred and ninety-seven, and m a y be
cited as t h e " Coloured R a c e s Restriction a n d R e g u l a t i o n A c t , 1 8 9 0 . "
