I, AGNES M. SCANLON, o f the City o f Norwich, Coi~ntyo f Chenango,
and State o f New York, being o f sound mind and niemory, do make, publish,
and declare this m y Last Will and Testament, in manner following, that is t o say:
FIRSE I will and direct that all my just debts and funeral expenses be paid as
soon as practicable after my death.
SECOND: I direct that my executor pay out of my residuary estate, without
apportionnient, all estate, inlieritance, and like taxes irr~posedby the Government of
the United States, or any State or Territory therec' or by any foreign government, or
political subdivision thereof, in respect of all property required to be included in my
gross estate for estate or like tax purposes by any of such governments, whether the
property passes under this Will or otherwise, without contribution by any recipient of
any such property, provided, however, that no residuary beneficiary shall by reason
o f this provision be denied any exemption or deduction which by law enures to the
benefit of such beneficiary.
THIRD: I give, devise and bequeath to MARIE DYKSTRA, my clothing,
jewelry, personal effects, household goods, furniture, furnishings and automobiles, and
all other tangible personal property not otherwise specifically bequeathed (except cash
on hand) owned by me a t the time of my death. I f my said MARIE DYKSTRA shall
not survive me, I bequeath all of the aforesaid property to MARTHA COUCH.

FOURTH: I give and bequeath to ST. BARTHOLOMEW'S ROMAN
CATHOLIC CHURCH, Norwich, New York, Five Hundred Dollars ($500.00) for
masses in memory of the deceased members of the John 1. Scanlon, Patrick Kilroe,
Ellen Kelly, Michael Haggerty and Morris Hickey families.
FIFTH: I give and bequeath to ST. PAUL'S CEMETERY, Norwich, New York,
Five Hundred Dollars ($500.00). It is my wish that the income only be used for the
upkeep of the ]ohn I.Scanlon family plot. Perpetual care has been provided for.
SIXTH I give and bequeath to ST. VINCENT FERRER CHURCH, Lexington
Avenue a t 66th Street, New York City, New York, One Thousand Dollars
($1,000.00). It is my wish that this sum shall be used for masses in memory of the
deceased members of the John I.Scanlon and Patrick Kilroe families.
SEVENTH: I give and bequeath to ST. VINCENT'S HOSPITAL NURSES
ALUMNAE ASSOCIATION, 158 West 12th Street, New York City, New York, the
sum of Two Thousand Dollars ($2,000.00).

validity of this will or any provision thereof, or shall institute or join in (except as a
party defendant) any proceedi~igto contest the validity of this will or to prevent any
provision thereof from being carried out in accordance with its terms (regardless of
whether or not such proceedings are instituted in good faith and with probable cause),
then all benefits provided for such beneficiary are revoked and such benefits shall pass
to the residuary beneficiaries of this will (other than such beneficiary) in the proportion
that the share of each such residuary beneficiary bears to the aggregate of the effective
shares of the residuary. Each benefit conferred herein is made on the condition
precedent that the beneficiary shall accept and agree to all of the provisions of this will
and the provisions of this Paragraph are an essential part of each and every benefit.
LASTLY, I hereby nomine and appoint NBT BA'NK, N.A., of Norwich, New
York, and LEONARD W. SMITH, ESQ., of Norwich, New York, as Co-Executors of
this my last WILL A N D TESTAMENT, to serve without bond, any law to the contrary
notwithstanding.
