2012/156 Fisheries (Set Net Prohibition from Pariokariwa Point to Hawera) Notice 2012 Pursuant to section 11(4)(b)(i) of the Fisheries Act 1996, the Minister for Primary Industries gives the following notice. Contents 1 2 3 4 5 Title Commencement Interpretation Set netting prohibited within 2 nautical miles of mean high-water mark from Pariokariwa Point to Hawera Commercial set netting prohibited between 2 and 7 nautical miles of mean high-water mark from Pariokariwa Point to Hawera unless observer on board vessel Page 1 1 1 2 2 Notice 1 Title This notice is the Fisheries (Set Net Prohibition from Pariokariwa Point to Hawera) Notice 2012. 2 Commencement This notice comes into force on the 28th day after the date of its notification in the Gazette. 3 (1) Interpretation In this notice, set net includes a gill net or any other sort of net that acts by enmeshing, entrapping, or entangling any fish. 1 cl 4 Fisheries (Set Net Prohibition from Pariokariwa Point to Hawera) Notice 2012 2012/156 (2) Terms used in this notice have the same meaning as in the Fisheries Act 1996. 4 Set netting prohibited within 2 nautical miles of mean high-water mark from Pariokariwa Point to Hawera A person must not use a set net for fishing in the waters lying within an area bounded by a line— (a) commencing at a point on the mean high-water mark at Pariokariwa Point (at 38°53.49′S and 174°30.35′E); then (b) proceeding in a north-westerly direction to a point 2 nautical miles offshore (at 38°52.23′S and 174°28.27′E); then (c) proceeding along a line every point of which is 2 nautical miles from the mean high-water mark to a point 2 nautical miles offshore due south of Hawera (at 39°39.13′S and 174°16.50′E); then (d) proceeding due north to a point on the mean high-water mark due south of Hawera (at 39°37.12′S and 174°16.50′E); then (e) proceeding in a generally north-westerly then northeasterly direction along the mean high-water mark to the point of commencement. 5 Commercial set netting prohibited between 2 and 7 nautical miles of mean high-water mark from Pariokariwa Point to Hawera unless observer on board vessel A commercial fisher must not, without an observer on board the vessel, use a set net for fishing in the waters lying within an area bounded by a line— (a) commencing at a point 2 nautical miles offshore from the mean high-water mark at Pariokariwa Point (at 38°52.23′S and 174°28.27′E); then (b) proceeding in a north-westerly direction to a point 7 nautical miles offshore (at 38°49.23′S and 174°23.23′E); then (c) proceeding along a line every point of which is 7 nautical miles from the mean high-water mark to a 2 2012/156 (d) (e) Fisheries (Set Net Prohibition from Pariokariwa Point to Hawera) Notice 2012 Explanatory note point 7 nautical miles offshore due south of Hawera (at 39°44.13′S and 174°16.50′E); then proceeding due north to a point 2 nautical miles offshore due south of Hawera (at 39°39.13′S and 174°16.50′E); then proceeding in a generally north-westerly then northeasterly direction along a line every point of which is 2 nautical miles from the mean high-water mark to the point of commencement. Explanatory note This note is not part of the notice, but is intended to indicate its general effect. This notice, which comes into force on the 28th day after the date of its notification in the Gazette,— • prohibits set netting within 2 nautical miles of the mean highwater mark from Pariokariwa Point to Hawera; and • prohibits commercial set netting between 2 and 7 nautical miles of the mean high-water mark from Pariokariwa Point to Hawera unless there is an observer on board the vessel.
