UNeedABabysitter.com - Terms of Use – Parent/Guardian
Parties
This agreement is between you and Fundamental Consulting. Ltd., operating as UNeedABabysitter.com, henceforth referred to as UNAB.
The following are the terms to which you agree;
Parent/Guardian Family Contract
UNAB provides a platform that enables parents to find babysitters who are available on selected dates, it does not provide
babysitting services, but offers this platform for families and babysitters to connect, and to remit payment to babysitters. By
accepting this agreement, you will not contact babysitters, previously found through the UNAB platform, directly for bookings,
but may do so if there is a minor change to the start time of a confirmed booking.
Requests for Babysitting
UNAB offers you a platform that enables you to submit requests for babysitting services. Your request for babysitting will be
sent to your UNAB- connected babysitters who may then accept your request.
UNAB Payments and Fees
You agree to pay the babysitter through the UNAB platform, within 12 hours of completion of each confirmed booking or cancellation. You agree to pay babysitters through sourced through UNAB’s platform only through the payment system provided
by UNAB, and not directly to the babysitter, save and except for any cash tips you may wish to provide to the sitter directly. You
further agree to pay $15/hr for the sitter and the UNAB service fee of $5 per confirmed booking.
Cancellation of Requests and Cancellation Fees
A cancellation fee of $20 shall be charged for cancelling an accepted request for Babysitting that is booked and confirmed for a
time less than 12 hours in the future.
Babysitter Screening
UNAB does not guarantee that the babysitters who respond to your requests for babysitting will be deemed suitable to you for
your children, or that the information the babysitters provide through UNAB’s platform is accurate. You shall be solely responsible for approving babysitters.
Warranties and Representations
You warrant and represent that you have never been convicted of a criminal offense related to children. You warrant and represent that you shall not use this service for any other purpose other than to source, communicate with and pay for babysitters
that have been hired and entrusted by you, to look after the children for which they were hired.
Limitations of Liability
UANB shall not be liable, under any theory of tort, negligence, contract law, etc. for more than 3 times the total value of referrals accepted by you in the two years preceding notice of any claim. Although UNAB shall take reasonable steps to safeguard
your personal information, UNAB shall not be responsible for any losses that occur in the event of breach of the UNAB platform
or unauthorized disclosure by UNAB employees, contractors or sub-contractors.
Indemnity
You agree to identify UNAB against any suit brought by any users of the UNAB platform, babysitters, other parents/guardians/
trustees/relations of your children/ wards, or, an insurer of your home/residence.
Termination
This agreement may be terminated by UNAB at any time, and you may terminate this agreement upon 48 hours notice, without
refund of any monies paid. Termination of this agreement by either party does not imply termination of the Contractual Obligation to use the UNAB booking system, and no portion of the yearly membership fee shall be refunded.
Choice of Law and Forum
Any disputes shall be resolved under Ontario Law, in the courts of Toronto, Ontario, Canada.
Survival
The ‘Limitations of Liability’, ‘Indemnity’ and ‘Choice of Law and Forum’ clauses shall survive termination of this agreement.

Entire Agreement
This agreement is the entire agreement between the parties and supersedes any other understanding between the parties.
