City of Kingston Report to Council Report Number 17-136 To: Mayor and Members of Council From: Lanie Hurdle, Commissioner, Community Services Resource Staff: Luke Follwell, Director, Recreation & Leisure Services Date of Meeting: May 16, 2017 Subject: Memorial Centre Farmers Market - License Extension Executive Summary: The Farmers’ Market Association of Kingston (FMAK) has been operating the Memorial Centre Market weekly on Sundays for the last five years from May through the end of October, which was established through a license agreement with the City in 2013. Attendance to the market has since averaged approximately 1,500 patrons per week. The FMAK has expressed a desire to extend their current license agreement with the City of Kingston for the operation of an outdoor market at the Kingston Memorial Centre, located at 303 York Street, which is set to expire October 31, 2017. The Memorial Centre Market is a free admission, family-friendly market which showcases 25-35 vendors weekly. The Memorial Centre Farmers’ Market is 100% producer-run, with all products grown and produced in the Kingston foodshed (within about 100 kilometres of the market). Over the last season, staff have worked closely with FMAK and reviewed information related to the market’s operations. Based on the consistent attendance and experience managing the market, staff is recommending an extension of the current license agreement to allow for the market to continue operations at the Memorial Centre site for a period of five years. Recommendation: That Council endorse the license extension from November 1, 2017 until October 31, 2020 with the Farmers’ Market Association of Kingston with a potential extension of two (2) additional years, at market rate based on the Fees and Charges By-Law; and That the Mayor and City Clerk be authorized to execute the license extension in a form satisfactory to the Director of Legal Services. To find a potential operator, staff released Request for Proposal (RFP) Number F31-CSG-RLS-2013-09 which closed on February 27, 2013. Only one (1) submission was received for the RFP and it was from the Farmers Market Association of Kingston (FMAK). With FMAK, all products grown and produced are in the Kingston foodshed which supports the City’s strategic priority relating to Food Security. On March 19, 2013 Council endorsed the following recommendations: “THAT RFP No. F31-CSG-RLS-2013-09 for the Operator for an Outdoor Market at the Kingston Memorial Centre be awarded to the Farmers’ Market Association of Kingston for a total price of $4,646.40, plus applicable taxes, for a 24 week period starting on May 19, 2013, with yearly inflationary adjustments based on the City’s Fees and Charges By-Law; and THAT the Mayor and City Clerk be authorized to enter into a license agreement for a period of three (3) years with a potential extension of two (2) additional years, at market rate based on the Fees and Charges By-Law with the Farmers’ Market Association of Kingston in a form satisfactory to the Director of Legal Services.” The current license agreement will expire on October 31, 2017 and FMAK has expressed a desire to extend their agreement with similar terms. Staff are recommending that Council approve the extension of the license agreement for a similar term of three (3) years with a potential extension of two (2) additional years at rates identified in the Fees and Charges ByLaw. Financial Considerations: The 2016 license fee for the Market totalled $5,139.68. The revenue generated from this license agreement will be allocated to the Memorial Centre operational budget. The license agreement fee will be adjusted on a yearly basis based on the Fees and Charges By-Law.
