Motion:____ Action: Notes: Second____ Roll Call: Ayes:___________ Nays:__________ Tabled To:____________ STAFF REPORT Subject: County Contract #11-241B (Lance Gulch Road ROW), Amendment #4 Date: September 24, 2013 ISSUE: Consider approving contract amendment No. 4 with Omni Means LTD of Redding in the amount of $24,223, for additional Land Surveying services for Lance Gulch Road (East Connector) and authorizing the Chair to sign the Amendment. BACKGROUND: Omni Means was originally selected to perform Right of Way surveying services on the East Connector Project. The original scope of work included 15 parcels for which 15 acquisition and right of way descriptions and three temporary construction easement descriptions were required. Amendment #1 and #3 increased the cost of the contract to provide additional services as the County Surveyor. Amendment #2 increased the number of legal descriptions and Plat Maps for the Lance Gulch Road project from 15 to 27. DISCUSSION: When the County increased the scope of work through Amendment #2, staff was aware that there would be additional acquisitions needed for drainage improvements and other issues that might come up during project design. The extent and location of the changes were unknown at the time, so they could not be added to the agreement. The following additional survey work is needed to date: Three drainage easement descriptions to accommodate changes to the drainage design. Four utility easement descriptions and plats for utility relocations. Two acquisition parcel descriptions and plats for the transfer of land between County and CHP / DMV. Staking the limits of tree removal so that the California Conservation Corps can remove trees prior to bird nesting season. One ALTA survey of a specific parcel to satisfy requirements of the Bank of America. Additional funds were allocated to be used toward the Jail Relocation project which is not associated with the Lance Gulch Road project. All work for the Jail Relocation project would be indicated separately on invoices and billed to Miscellaneous Public Works. These additional services increase the contract amount by $24,223, bringing the overall contract expenditure to $114,135. ALTERNATIVES: 1) Approve Amendment 4 and authorize the Chair to sign the amendment. An additional $6,809 would be required from the General Fund (Jail). All other costs to be funded through State STIP. 2) Approve Amendment 4 with changes and authorize the Chair to sign the modified amendment. Engineers and Planners (Contractor) to provide Land Surveying and Right of Way Engineering for Lance Gulch Road in Weaverville (formerly known as the East Connector) ; and WHEREAS, the project requires additional services, and the parties mutually agree to add these additional services to the scope of services, for an additional cost; and WHEREAS, the Contract provides for additional services and amendments; NOW, THEREFORE, the parties hereto agree to the following: 1. This amendment is effective September 10, 2013. 2. Section I. Of the Contract entitled “Scope of Services” is amended by adding the following: “and the services described in Exhibit “A” of Amendment No. 4 of this agreement.” 3. Section V. of the Contract entitled “Maximum Cost to County” is amended from a maximum sum of $89,912 to a maximum sum of $114,135. 4. This proposal provides for the preparation of the following easement documents: 1) Utility easement for overhead poles across County owned parcels, APN 024-200-36 and APN 024-200-10. This will require minor research, boundary surveying and boundary resolution. 2) Utility easement for overhead poles across Previte parcel, APN 024-370-06. This will require minor research, boundary surveying and boundary resolution concurrent with the surveying required for the County owned parcels in 1) above. 3) Two acquisition parcel descriptions and plats for transfer of properties relating to the CHP and Toney parcels. One utility easement parcel legal description and plat. All boundary surveying is complete in this area. 4) Four easements associated with the “M” line and “EC” line of the Lance Gulch Road project. These easements will be for a sanitary sewer line and drainage facilities, respectively. All boundary surveying is complete in these areas. FEE: Not to Exceed $6,112.00 Task 2 - Tree Removal Staking Stake the line five feet beyond the slope limits as shown on the most current design drawings of the Lance Gulch project. The stakes will be set at all angle points and intervisible points on line, in all areas requiring tree removal. Stake the limit of tree removal on the County owned parcels adjacent to and South of the County yard. These limits include all the area South of the yard excluding the riparian zone along East Weaver Creek and the area of willow trees in the Southwest portion of the parcels. FEE: Not to Exceed $8,836.00 Task 3 – APN 024-430-53 Survey Prepare a legal description and plat of the remainder of APN 024-430-53, exclusive of that portion to be acquired by the County for the Lance Gulch Road project. Perform a boundary survey of the subject parcel as required by Bank of America, the existing lender. This survey will require minor research, boundary surveying, topographic surveying and boundary resolution; three out of the four corners have been located as part of the Lance Gulch Road project. We will utilize the plat prepared for the description of the remainder parcel to depict the boundary survey and will prepare a Corner Record based on the information shown on 21 M&S 100. FEE: Not to Exceed $2,466.00 Task 4 – Airport / Detention Lot Line Adjustment Perform research to confirm the actual configuration of existing legal parcels covering APN 024-200-10, 18, 33 and 36. Assist in the preparation of submittals required in a lot line adjustment application. Prepare legal descriptions and plats to complete the process of reconfiguring the lots. Up to four parcels will be adjusted to provide for more orderly management of the airport, detention, transit and landfill parcels. A boundary survey will be performed to resolve the locations of all affected parcels. The newly adjusted parcels will be monumented and a Record of Survey filed per state law.
