CONSTITUTION – ARTICLE IV SECTION 4 – Cabinet SECTION 6 – Executive Departments STATUTE (MISC) 20.05 14.2001 APPOINTMENTS AGENCY FLORIDA STATUTE APPOINTMENT Governor designates, Cabinet approves (simple majority – Governor plus one) Division of Bond Finance 215.64(4) To employ the services of a director of the division to be designated by the Governor with the concurrence of the board. The director may also serve as general counsel of the division and as assistant secretary of the board and in such capacities shall be authorized to perform duties provided by appropriate regulations or resolutions of the board under conditions and limitations included therein. Governor appoints, Cabinet approves (unanimous) Florida Department of Law Enforcement 20.201(1) The head of the department is the Governor and Cabinet. The executive director of the department shall be appointed by the Governor with the approval of three members of the Cabinet and subject to confirmation by the Senate. The executive director shall serve at the pleasure of the Governor and Cabinet. Governor appoints, Cabinet approves (unanimous) Florida Department of Veterans Affairs 20.37(1) The head of the department is the Governor and Cabinet. The executive director of the department shall be appointed by the Governor with the approval of three members of the Cabinet and subject to confirmation by the Senate. The executive director shall serve at the pleasure of the Governor and Cabinet. Governor appoints, Cabinet approves (unanimous) Florida Department of Environmental Protection 20.255(1) The head of the Department of Environmental Protection shall be a secretary, who shall be appointed by the Governor, with the concurrence of three or more members of the Cabinet. The secretary shall be confirmed by the Florida Senate. The secretary shall serve at the pleasure of the Governor. AGENCY FLORIDA STATUTE APPOINTMENT DEP Secretary appoints, Cabinet confirms (simple majority – Governor plus one) Florida Department of Environmental Protection 20.255(3)(g) Division of State Lands, the director of which is to be appointed by the secretary of the department, subject to confirmation by the Governor and Cabinet sitting as the Board of Trustees of the Internal Improvement Trust Fund. Governor & Cabinet jointly appoint (simple majority – Governor plus one) 20.24(1) Florida Department of Highway Safety & Motor Vehicles 20.05(1)(g) The head of the Department of Highway Safety and Motor Vehicles is the Governor and Cabinet. (1) Each head of a department, subject to the allotment of executive power under Article IV of the State Constitution, and except as otherwise provided by law, must: (g) If a department is under the direct supervision of a board, including a board consisting of the Governor and Cabinet, however designated, employ an executive director to serve at its pleasure; Governor & Cabinet jointly appoint (simple majority – Governor plus one) 20.21(1) Florida Department of Revenue 20.05(1)(g) The head of the Department of Revenue is the Governor and Cabinet. (1) Each head of a department, subject to the allotment of executive power under Article IV of the State Constitution, and except as otherwise provided by law, must: (g) If a department is under the direct supervision of a board, including a board consisting of the Governor and Cabinet, however designated, employ an executive director to serve at its pleasure; Governor & Cabinet jointly appoint (simple majority – Governor plus one) Division of Administrative Hearings 120.65(1) The Division of Administrative Hearings within the Department of Management Services shall be headed by a director who shall be appointed by the Administration Commission and confirmed by the Senate. AGENCY FLORIDA STATUTE APPOINTMENT Governor & Cabinet jointly appoint by at least three votes (Governor & CFO must be on prevailing side) Florida Office of Financial Regulation 20.121(3)(d) The head of the office is the Director of the Office of Financial Regulation, who may also be known as the Commissioner of Financial Regulation. The commission shall appoint or remove each director by a majority vote consisting of at least three affirmative votes, with both the Governor and the CFO on the prevailing side. Governor & Cabinet jointly appoint by at least three votes (Governor & CFO must be on prevailing side) Florida Office of Insurance Regulation 20.121(3)(d) The head of the Office of Insurance Regulation is the Director of the Office of Insurance Regulation, who may also be known as the Commissioner of Insurance Regulation. The commission shall appoint or remove each director by a majority vote consisting of at least three affirmative votes, with both the Governor and the CFO on the prevailing side. Governor & Cabinet jointly appoint (simple majority – Governor plus one) Citizens Property Insurance Corporation 627.351(6)(gg) The inspector general shall be appointed by the Financial Services Commission and may only be removed from office by the commission. The inspector general shall be appointed without regard to political affiliation.
