OFFICIAL PROCEEDINGS OF THE BOARD OF COUNTY COMMISSIONERS MCKENZIE COUNTY, NORTH DAKOTA December 6, 2016 The Board of Commissioners of McKenzie County, North Dakota met at the Commissioner’s Room at the McKenzie County Courthouse in Watford City, North Dakota on December 6, 2016. Present: Commissioners Doug Nordby, Vawnita Best, Tom McCabe, Gene Veeder, and Kathy Skarda, Auditor Svihovec, and Deputy Auditor Johnsrud. Auditor Svihovec called the meeting to order at 9:00 a.m. for reorganization of the Board. Moved by Best, seconded by Skarda, to nominate Doug Nordby as Chairman. No other nominations and nominations ceased. Best moves to cast a unanimous ballot for Doug Nordby as Chairman. All voting aye, motion carried. Moved by Nordby, seconded by McCabe, to nominate Vawnita Best as Vice Chairman. No other nominations and nominations ceased. Moved by Veeder, seconded by Nordby, to cast a unanimous ballot for Vawnita Best as Vice Chairman. Chairman Nordby then assumed the chair. Barbara Curren presented the Treasurer’s Report for the period ending November 30, 2016. Skarda requested that the November 1, 2016, minutes include the wording that she had requested meetings to be recorded. Moved by Skarda, seconded by Best, to approve the minutes as amended. All voting aye, motion carried. Best requested that the following six bills be pulled for review and discussion with the Sheriff Department: Basin Safety, Steichers, Graybar, Dealers Electrical, Border State Electric, and Ray Allan Manufacturing. Moved by Best, seconded by Skarda, to approve the bills, except the ones pulled by Best, and to approve the Treasurer’s Report as presented. All voting aye, motion carried. Collin Englehardt, Eide Bailly, presented the 2013-2014 Final Audit Report by conference call. Moved by Best, seconded by Skarda, to accept the 2013-2014 Final Audit Report from Eide Bailly. All voting aye, motion carried. Sam Meuchel questioned the Board on several vouchers from Linda Svihovec and Vawnita Best. PWD Kanwar stated that damage had been done to a septic tank and drain field during construction of the Northern Bypass. Moved by McCabe, seconded by Skarda, 438 to pay $6,000.00 to Doug and Debbie Thompson for repair to their septic tank and drain field that was damaged by the County’s contractor. All voting aye, motion carried. Kanwar stated he is working with the Contractor to split the cost. Veeder recommended that the County prepare an RFP for renovation and management of Hillside Court addressing affordability, management, and renovation of the facility. Moved by Skarda, seconded by Veeder, to accept the Uniform County Permit Program Agreement. All voting aye, motion carried. Moved by Skarda, seconded by McCabe, to approve the liquor license applications as presented. All voting aye, motion carried. Approved liquor licenses are: Wild Bison, Carman Corner, Patriot Fuels, Outsiders, Sweet Crude Travel Center, Tobacco Gardens, WC Eagles Aerie 3543, and Long X Saloon. The February 7, 2016, meeting was rescheduled to February 6, 2016, due to schedule conflicts. Jeff Kindel, City of Arnegard Mayor, reported on the Arnegard Wastewater project. State the project came in $240,724.63 under budget. The County had originally approved paying 14% of their total project cost up to $800,000.00. Paid to date on the project was $559,275.37. Mayor Kindel requested authorization for the remaining funds for a municipal water system. Nordby asked Kindell to put together some additional information on the project and represent it at the December 20, 2016, meeting. Moved by Skarda, seconded by Best, to approve the proposal from RTC for a phone system at the Law Enforcement Center totaling $78,853.35, with a monthly lease of $1,509.56. All voting aye, motion carried. Moved by Best, seconded by Skarda, to approve the proposal from Heggen Equipment for $46,000 for a tool cat and the proposal from Acme Tools for $19,530.00 for a mower and trailer for the Law Enforcement Center. All voting aye, motion carried. Todd Mitzel, ICON Architectural Group, briefed the Board on Construction Management at Risk delivery method versus Design Bid Build, Design Build (not an option for political subdivisions), and Construction Management (2 methods). Moved by Skarda, seconded by Best, to approve utilizing the Construction Manager at Risk delivery method for the County Shop project. All voting aye, motion carried. Facility Manager Nate Carlson requested direction from the Board on an RFP for Architectural services. Moved by Best, seconded by Skarda, to direct Carlson to let an RFP for design services for the County Shop. All voting aye, motion carried. 439 Moved by Veeder, seconded by Skarda, to approve the Thorland Right of Way and Corridor Utility Easement as presented. All voting aye, motion carried. The meeting recessed for lunch at 11:56 a.m. and reconvened at 1:00 p.m. with a public hearing on an abatement. Moved by Skarda, seconded by Veeder, to approve the Cruz Olivarez 3824 abatement application for 2016 mobile home tax moved out in 2015 without a permit. All voting aye, motion carried. Heidi Brenna, ICON Architectural Group, presented an initial design for repurposing the existing jail space. HR Manager Willis presented information on the Extension Office Partnership for Success Grant position, classification B22, benefits and training. Unemployment would be the County’s responsibility and all other costs would be covered by the grant. Moved by Best, seconded by McCabe, to support the grant funded position until the grant funding is exhausted. All voting aye, motion carried. Moved by Best, seconded by Skarda, to continue paying Gary Schwartzenberger’s salary, including benefits, while under suspension and until the matter of his suspension is resolved. All voting aye, motion carried. Moved by Skarda, seconded by Veeder, to terminate administrative leave for Karla Sondrol and to reinstate her to her former lead dispatch position, effective December 12, 2016. All voting aye, motion carried. Moved by Best, seconded by Skarda, to approve the salary adjustments as presented by HR Manager Willis, which include updated adjustments to approved 2017 salaries, totaling approximately $45,000 plus taxes and benefits. All voting aye, motion carried. Acting State’s Attorney Todd Schwarz joined the meeting by conference call to discuss Mike Schmitz’s retroactive pay and hearing date. Moved by Skarda, seconded by Best, to approve paying Mike Schmitz retroactive pay for his disciplinary leave beginning October 16, 2016, until after a disciplinary hearing on January 3, 2017, as Schmitz was commanded by Sheriff Schwartzenberger to report to work after October 16, 2016. All voting aye, motion carried. 440 Moved by Skarda, seconded by Best, to approve a temporary administrative staff position in the State’s Attorney Office to assist with filing while staff member is on leave. All voting aye, motion carried. Moved by McCabe, seconded by Best, to approve temporary employees in the Auditor/Treasurer Office to assist with tax statements and open records requests as needed. Moved by Best, seconded by Skarda, to approve the NDDOT Traffic Safety Contract for Alcohol Enforcement with a contract period of October 1, 2016, to September 30, 2017. All voting aye, motion carried. Moved by Skarda, seconded by Best, to approve the NDDES request for a tracked UTV to the Morton County Sheriff Department to assist with DAPL law enforcement. All voting aye, motion carried. 441 Interim Sheriff Johansen discussed several additional items with the Board including surplus tire disposal, City of Alexander Law Enforcement Agreement, which was tabled to December 20, and the vouchers pulled from the bills earlier in the day by Best. Also discussed was the gun range out at the County Landfill. Svihovec read an email from Scott Luhman stating he will look into the gun range and work on putting together a budget to present to the Board. Commissioner McCabe reported he had been asked to visit the gun range site by the State Electrical Inspector and learned during his visit that Sheriff Schwartzenberger and deputies were performing contract electrical work without a certified electrician on site. Johansen and Planning Director Talbert will look into the project and inspections needed. Moved by Best, seconded by Skarda, to approve payment of the six vouchers from the Sherrif’s Office which were pulled for discussion. All voting aye, motion carried. Auditor/Treasurer Svihovec agreed to reconsider her resignation, which was submitted to the Board on December 4, 2016. Present: Commissioners Doug Nordby, Vawnita Best, Tom McCabe, Gene Veeder, and Kathy Skarda, Auditor Svihovec, Deputy Auditor Johnsrud, and Acting State’s Attorney Schwarz. Chairman Nordby called the meeting to order at 1:00 p.m. Marcia Hellandsaas introduced new NDSU Extension Agent Morgan Meyers to the Board. Meyers updated the Board that two new 4-H clubs had formed and that 4-H projects are underway. RESOLUTION PERMITTING TEMPORARY OBSTRUCTION OF SECTION LINE WHEREAS, a petition to temporarily obstruct a portion of a section line roadway in Township 149 North, Range 96 West of the 5th Principal Meridian has been filed in the office the McKenzie County Auditor, being further described as: A strip of land located within the East half (E1/2) of Section Thirty-Six (36), Township One Hundred Forty-Nine North (T149N), Range Ninety-Six West (96W) of the 442 Fifth Principal Meridian (5th P.M.), McKenzie County, North Dakota. A strip of land Thirty-Three (33) feet wide having Thirty-Three (33) feet lying on the west side of the following described line: Commencing at the Southeast corner of said Section ThirtySix (36) thence N 00°06’04” E a distance of 3521.68 feet to the Point of Beginning; thence continuing N 00°06’04” E, a distance of 622.62 feet to the Point of Terminus, located S 00°06’04” W, a distance of 1117.51 feet from the Northeast corner of said Section Thirty-Six (36). Said obstruction has a total length of 622.62 feet and contains 0.47 acres more or less. WHEREAS, Notice of Hearing was given and duly held by the McKenzie County Board of Commissioners on Tuesday, December 20, 2016 at 1:00 PM CDT in the Commissioners Room of the McKenzie County Courthouse, Watford City, North Dakota, with Commissioners Nordby, Best, McCabe, Veeder, and Skarda present, and WHEREAS, the petitioner and the Commissioners agreed that written permission to temporarily obstruct the section line right of way rather than closing the section line was a more appropriate solution, and WHEREAS, the section line described above does not have an improved road and is not traveled by the public, and WHEREAS, testimony has been received and evidence examined in favor of allowance of the temporary obstruction of said section line as above described, on motion made by Commissioner Veeder, seconded by Commissioner McCabe, and a vote of 5 aye and 0 nay, IT IS RESOLVED by the Board of County Commissioners for McKenzie County, North Dakota, that is in the interest of the public and the parties involved granting the relief agreed to and hereby permitting the section line to be temporarily obstructed as described. Moved by Best, seconded by Skarda, to set a public hearing date for the PetroHunt and Emerald Oil section line closure petitions for January 17, 2017, at 1:00 p.m. All voting aye, motion carried. Moved by Veeder, seconded by Best, to approve the request by the City of Arnegard for $240,724.63 to be used for a water distribution system. All voting aye, motion carried. Veeder and Facility Manager Carlson updated the Board on the Hillside Court RFP asking for management, affordability, renovation, and ownership from vendors. Schwarz will review the RFP before publishing. McCabe reported that light bulbs needed to be replaced in the gathering space and kitchen and asked Carlson to look into it. 443 Nordby reported that he and Best had interviewed candidates for the State’s Attorney vacancy and were down to two candidates: Chas Neff and Todd Schwarz. Veeder, McCabe, and Skarda expressed interest in interviewing the candidates, which are to be set up by HR Manager Willis. Moved by Veeder, seconded by Skarda, to approve Payment Voucher 3, loan advance, from the Bank of North Dakota for the Law Enforcement Center in the amount of $29,295,869.16. All voting aye, motion carried. Moved by Best, seconded by McCabe, to approve the out of state travel for Karolin Jappe to a Homeland Security ICS-EM Training. All voting aye, motion carried. Deputy Auditor Johnsrud reviewed the Accounts Payable, Credit Card, and Travel Reimbursement policies. Commissioner Best asked that the following wording in the Credit Card policy be stricken: “Once an employee is issued a county credit card the employee will not be allowed to use a personal credit card for county purchases, except where the county purchases would exceed the cardholder’s county credit limit.” This sentence will be removed and the policy updated. Daren Langrud and Mark Schneider updated the Board on the 2016 weather modification operations. Nordby reported that Katie Paulson is now certified as an Assessor I and Shantelle Mattern is certified as an Assessor II. Svihovec provided an update to the Board on tax statements where were sent in the mail on December 15. Moved by Skarda, seconded by Best, to approve an additional court security position for 2017. All voting aye, motion carried. Moved by Veeder, seconded by Best, to approve the Agreement for the Sale of Gravel, Rock, Scoria, and Clay with David and Steve Lassey at $2.50 per cubic yard. All voting aye, motion carried. Moved by Skarda, seconded by Veeder, to approve the Eide Bailly proposal for the 2015-2016 audit for $29,000.00 plus expenses. All voting aye, motion carried. Moved by Veeder, seconded by McCabe, to set the salary for Interim Sheriff Matt Johansen to E82, Step 5, with an annual salary of $103,532 effective December 25, 2016. All voting aye, motion carried. Heidi Brenna, ICON Architectural Group, presented the recommendation from the selection committee for the Construction Manager At Risk management services for the Jail Repurpose Project. Brenna reported three companies were interviewed: 444 Construction Engineers Inc., JE Dunn, and Scull Construction. Moved by Best, seconded by Skarda, to enter into contract discussions with Construction Engineers Inc. for Construction Manager at Risk for the Jail Repurpose Project. All voting aye, motion carried. Moved by Best, seconded by Skarda, to approve the US Transport Bill for $931.00 as presented. All voting aye, motion carried. Corporal Travis Bateman presented information on the Evoc/PIT maneuver out of state training in St. Cloud, MN. Fifteen deputies would attend the training, 5 at a time, with a total cost of $18,000.00. Moved by Best, seconded by Skarda, to approve the training as presented. All voting aye, motion carried. The NW Narcotics Task Force presented information on case load and arrests in the last three years. Divide, McKenzie, and Williams Counties participate along with Watford City and Williston. Moved by Best, seconded by Veeder, to extend the current agreement for Arnegard City Jail Services until the new law enforcement facility is open. All voting aye, motion carried. Moved by Skarda, seconded by Veeder, to approve two additional full time administrative clerk positions for the Sheriff’s Office. All voting aye, motion carried. Moved by Skarda, seconded by McCabe, to dispose of 52 excess tires by sealed bid. All voting aye, motion carried. Auditor Svihovec will advertise. Bateman presented information on upgrading radio equipment and towers in order to provide more efficient dispatch and radio service which will be compatible with future 911. Moved by Skarda, seconded by McCabe, to purchase a 2017 Chevy Tahoe from Kupper Chevrolet for $36,863 to replace a wrecked vehicle. Vehicle equipment will be billed separately. All voting aye, motion carried. Bateman presented proposals from three dealerships for 4 Tahoe PPVs, 1 Tahoe SSV, and 1 Chevrolet Silverado. Moved by Best, seconded by Skarda, to approve the 445 2017 Sheriff Office Vehicle purchases from Kupper Chevrolet for six units totaling $226,287.00. All voting aye, motion carried. Justin Johnsrud, WC Park Board President, presented information on programs and finances for the Rough Rider Event Center, as well as user group numbers from 2016. A budget shortfall of $1,090,000 from projected 2016 revenue was requested to assist with startup operation costs. Auditor Svihovec requested that the Board table a decision until end of the year fund balances can be compared to September budget projections. Moved by Veeder, seconded by Skarda, to approve staffing one full time deputy/investigator for the Northwest Narcotics Task Force for 2017. All voting aye, motion carried.
