EXECUTIVESUMMARY
CurrentU.S.lawallowsforthevettingandexclusionofIslamicsupremacistsfrom
entryintotheUnitedStates,ornaturalizationascitizens.ThePresidenthaswide
latitudeinexcludingwould-beimmigrants.Therearealsoinplacestatutory
restrictionsbasedonbothviolentactsandunconstitutionalactivitiestoremoveor
supplantourlawsandgovernment.Thisdocumentassessestheapplicabilityof
thoserestrictionstototalitarian/Sharia-supremacistMuslims,aswellassuggestions
forimprovingthem.TherelevantsectionsareintheImmigrationandNationality
Act(U.S.CodeTitle8).

MAKING SHARIA-SUPREMACISM A BAR TO IMMIGRATION
AND NATURALIZATION
TheUnitedStatescannotlongsurviveifitinvitesintoitsmidstnon-citizenswhoare
fundamentallyopposedtoourConstitution,thegovernmentitestablishedandthe
freedomsitguarantees.Previousgenerationsunderstoodthisrealityandcodified
intolawgroundsforexcludingNazis,Communistsandothersbentonestablishinga
totalitariansysteminplaceofourrepresentativedemocracyfromenteringthis
countryandbecomingnaturalizedcitizens.ThecurrentthreatposedbytheGlobal
JihadMovementanditsanimatingdoctrine,Sharia,canandshouldbeaddressedby
thesesamerestrictions.
TwotypesofactivitybySharia-supremaciststhatshouldprecludeentrytotheU.S.
areviolence,commonlyknownasterrorism,andsubversiveactsaimedat
underminingandultimatelyoverthrowingoursystemofgovernment.Terrorist
activityisgroundsforexclusionbasedpurelyonitsviolentnature.
Pre-violentSharia-supremacistspreparedtoengageinsubversionshouldalsobe
bannedbasedonthegoalthesegroupsandindividualsalsohaveofsupplantingthe
U.S.ConstitutionandsystemofgovernmentwiththetotalitarianIslamiccodecalled
Sharia.Manysucheffortsarebaseduponalongterm,incrementalstrategyfor
stealthilyinsinuatingShariagloballyand,therefore,eachsteponitsowncaneasily
bemistakenlyperceivedasunobjectionable.
CurrentstatutesdoallowSharia-supremaciststobevettedandbannedfromentry,
butshouldbeamendedtocodifytheprohibitionfromentryofthesenon-citizens
whodonot,andcannot,faithfullysupportthebasictenetsoftheU.S.Constitution.
BurdenofProof
Itiscriticallyimportanttobearinmindthatimmigrationisnotacriminaljustice
issueandpotentialimmigrantsdonothavethesamerightsascitizens.Theburden
mustbefullyplaceduponapotentialimmigranttoshowthatheisnotathreat,not
ongovernmenttoproveheisone.Inanyindividualcase,theexecutivebranchhas
discretiontokeepanalienout,andthisexerciseofdiscretionshouldnotbe
reviewablebythecourtsbecause:
(a)aliensdonothavejudiciallyenforceablerights;
(b)theConstitutionmakespoliticalbranchessupremeinmattersofnational
securityandimmigrationenforcement;

(c)theConstitutionassumesthatimmigrationenforcementisapoliticalratherthan
alegalissueinthesensethatthecheckongovernmentpolicyistheballotbox,not
lawsuitsbroughtbyaliens;
(d)anylegitimateFirstAmendmentinterestofAmericanstoheardissentfrom,and
associatewithaliens,ismorethanadequatelysatisfiedbymoderncommunications
technology,withouttheneedforthealientobephysicallypresentintheU.S.;and
(e)aslongasthereisnocategoricalbanonMuslimsinplace,anyconceivabledue
processrequirement(assumingonlyforargument’ssakethatthereissucha
requirement)ismorethansatisfiedbyanindividualizedvettingprocessinwhich
thealienisgiventheopportunitytoprovethathe/sheisnotathreat.
Decisionsbyexecutiveagenciestoexcludesharia-adherentindividualsshouldbe
unreviewable.Decisionsbythemtoadmitindividualswhomaybeobscuringtheir
adherencetoShariashould,however,bereviewablebyotheragenciesandcourts.
Regardlessofanyotherauthority,thePresidentmaybansharia-adherent
individualsbasedonexecutiveauthoritygrantedin8U.S.Code§1182-
Inadmissiblealienssection(f):
(f)SuspensionofentryorimpositionofrestrictionsbyPresident
WheneverthePresidentfindsthattheentryofanyaliensorofanyclassof
aliensintotheUnitedStateswouldbedetrimentaltotheinterestsofthe
UnitedStates,hemaybyproclamation,andforsuchperiodasheshalldeem
necessary,suspendtheentryofallaliensoranyclassofaliensasimmigrants
ornonimmigrants,orimposeontheentryofaliensanyrestrictionshemay
deemtobeappropriate.
ThepastsixPresidents,includingthecurrentone,haveallusedthisauthoritytoban
certainclassesofpeoplefromentry.Giventheimmediateandongoingthreatposed
bySharia,allavailablemeanstostopentrybyindividualswiththegoalof
underminingtheU.S.Constitutionshouldbeused.
ShariaAdherenceistheKey
Adividinglinecanandshouldbedrawnthatdoesnotautomaticallyexcludeall
MuslimsfromentryintotheUnitedStates.Wehavenumerousallieswhowouldlose
theirabilitytotravelhereandtherearemanyMuslimswhodonotposeathreatand
havedonenothingtodeserveabanonentry.Theproperdifferentiatoris their
adherenceand/orattachmenttothetotalitarianShariadoctrine.
ShariaisderivedfromIslam’sreligioustextsandexplicitlyrequiresadherentsto
supporttheestablishmentofasocietybaseduponitstotalitariancode.Whilethis
politico-military-legalsystemhasapatinaofreligiosity(includingprayers,abelief
inasupremebeing,ritualpractices,communityworship,etc.),itisstillproperly

definedasatotalitarianideology.AdherencetoShariarequiressupportforand
activeworktoachievethedestructionorsubordinationofboththeU.S.Constitution
andthenationalexistenceoftheUnitedStatesofAmerica.
ShariaincludesadoctrineofconquestknownasJihad,whichisacentralfeatureof
itslawsandrequirements.JihadandShariaareinextricablylinked,withSharia
formulatingandcommandingJihad,andwithJihadbeingwagedforthepurposeof
imposingandinstitutingSharia.AdherencetoShariaisadherencetothelegal,
political,andmilitarydoctrinesandlawofJihad.TheultimateaimofJihadisthe
impositionofShariaonallnations,includingtheUnitedStates.
ShariaDefinitionforthepurposeofU.S.Code
ThemainstreaminterpretationofShariabytheauthoritiesofIslamisthe
totalitarianversionaimedatenforcedimpositionworldwide.Thisbeliefsystem,
especiallyitsdominationofallaspectsoflife,isnotsharedbyallMuslims.The
UnitedStateshasanationalsecurityinterestintruly“modern”(i.e.,post-Sharia)
MuslimsprevailingintheinternecineIslamicdebate.
Therefore,itisnecessarytorepudiateexpresslytheanti-constitutionaltenetsof
politicalIslam’sconstructionofSharia(e.g.,unequaltreatmentunderthelaw,antidemocraticgovernancestructure,denialofFirstAmendmentfreedoms,etc.)in
order,amongotherthings,tohelpthosemoderatesmarginalizetheextremistswho
threatenusall.
TheimpositionofShariaisaccomplishedusingbothviolentmeans,non-violent
techniques,includingsubversion,andinsomecaseslawfulones(e.g.,immigrationfueledpopulationgrowth).Irrespectiveoftheapproachemployed,thegoalisthe
same:increasingthepoliticalinfluenceandpowerofSharia’sadherents.Adherence
toandadvocacyforSharia-adherenceisasignificantindicatoroflikelycommission
ofmaterialsupportforandactualactsofterrorism.
Shariamustbeconsideredatotalitarianideologyforthepurposesofthe
ImmigrationandNaturalizationAct.Inlightofthesefacts,theadmissionintothe
UnitedStatesandnaturalizationascitizensofindividualswhoadheretoSharia
posesclearandpresentdangerstotheU.S.Constitution,thiscountryanditspeople,
andshouldbeprecluded.
ApplicableU.S.LawAuthorizingEntryBansandSuggestedModifications
ThecurrentImmigration&NationalityAct(INA)haslanguagethatprovidesabasis
fordeterminingthatSharia-adherentsandmembersofgroupswiththeavowedgoal
ofimposingShariashouldbebannedfromentry.Thisisbasedonthedetermination
thatShariaisatotalitarianideologyincompatiblewiththeU.S.Constitutionandthat

itsavowedgoalistoreplaceoursystemofgovernancewithatotalitariansystem
basedonSharia’sdictates.
DefiningTotalitarianism
Thecurrentdefinitionoftotalitarianforthesepurposesisin8U.S.Code§1101–
Definitions:

Theterm“totalitarianparty”meansanorganizationwhichadvocatesthe
establishmentintheUnitedStatesofatotalitariandictatorshipor
totalitarianism.Theterms“totalitariandictatorship”and“totalitarianism”
meanandrefertosystemsofgovernmentnotrepresentativeinfact,
characterizedby(A)theexistenceofasinglepoliticalparty,organizedona
dictatorialbasis,withsocloseanidentitybetweensuchpartyanditspolicies
andthegovernmentalpoliciesofthecountryinwhichitexists,thattheparty
andthegovernmentconstituteanindistinguishableunit,and(B)theforcible
suppressionofoppositiontosuchparty.

basedonthepracticeofSharia.ThecurrentlawdirectlynamesCommunismasa
prohibitedtotalitariandoctrine.Itshouldbeamendedtocoveranytotalitarian
doctrinethatadvocatessupplantingtheU.S.Constitution.Membershipingroups
thatrequireactiveeffortstoreplaceexistingU.S.lawandgovernmentwithSharia
andpropagatingmaterialsadvocatingthisanti-constitutionaldoctrineshouldalso
begroundsfordenyingnaturalization.

Conclusion
TheUnitedStatesgovernmentistaskedwithensuringthatanyoneenteringthis
countrydoesnotactivelyseektooverthrowoursystemofgovernmentorimpose
anotherformofgovernanceincompatiblewiththeU.S.Constitution.Itmustalso
ensurethosewhoseektobecomenaturalizedcitizenssharethevaluesenshrinedin
thenation’sfoundingdocumentsorbedeniedthatprivilege.
TheIslamictotalitarianideologyofShariaisfundamentallyincompatiblewiththe
freesocietyandgovernmentenjoyedbyallAmericans.Itcontainselementsof
religion,butitsrequirementstomandateallaspectsofprivateandpubliclifefor
bothitsadherentsandnon-believersexceedstheboundariesforreligious
protectionundertheFirstAmendment.Sharia’sassertionofsupremacyoverall
man-madelawsanditsrequirementthatthosewhoattachtoitmustactivelystrive
toimposeShariaworldwideconstitutesufficientgroundstoconsiderShariaananticonstitutionaltotalitariandoctrineandrestrictitsadherents’entryand

naturalizationinaccordancewithexistinglaw.Amendmentscan,however,
helpfullyclarifyandeliminatebasesforcontestingthatrestriction.
Allexecutivebranchagenciesresponsibleforinternationalandhomelandsecurity
andimmigrationshouldbeimmediatelyinformedofthisguidanceforinvestigations
anduseindenyingentryandnaturalization.Congressshouldevaluateandenactthe
proposedchangestostrengthenthegovernment’sabilitytoscreenoutfromboth
entryandnaturalizationnon-citizensholdingandactingonthisanti-constitutional
Shariaideology.
